This Essay focuses on Duncan Kennedy's argument for a "post-rights" position, in the wake of the earlier critical legal studies critique of rights and the ensuing response by Critical Race Theorists. I argue that, notwithstanding Kennedy's loss of faith in rights discourse, rights talk might still be pragmatically useful for communities of color to operate strategically within the accepted legal framework, or to subvert that framework in order to advance particular political commitments for particular communities of color at particular moments in history.

If nothing else, this Review Essay, like Professor Viteritti's book, should be timely. As I write, the United States Supreme Court in Mitchell v. Helms has just decided that publicly funded computers and other educational materials may be loaned to private and religious schools. The decision is widely viewed as signaling, if not determining, the constitutional fate of school-choice experiments like those in Cleveland and Milwaukee. As it happened, just one week before Mitchell, the Sixth Circuit heard oral arguments in Simmons-Harris v. C-nitroso compounds are reactive intermediates in the toxic sequelae of nitroarene metabolism. Alcohol dehydrogenase (ADH) contributes significantly to NADH-dependent C-nitroso reduction by cytosol relative to NAD(P)H: quinone oxidoreductase (NQOR). NADPH-dependent pNSP reduction by liver cytosol of ADH+ animals is mostly dicumarol-sensitive which implicates NQOR as the major NADPH-dependent activity. Although, extensive structural homology between horse and different isozymes of human ADH exist, significant differences occur within the active site, which account for great variability among substrate specificities, kinetic constants, and response to inhibitors. For a variety of reasons, the history of crusading in the later middle ages (after c. 1300) has, until recently, been a topic largely ignored by historians. Acre, the last Christian outpost in Palestine, fell in 1291, and within twenty years, one of the major corporations associated with the crusading movement, the Knights Templar, came under attack and were ultimately suppressed as a religious order. The protection of civilians and their property in war is an accepted norm of international law - even where the putatively "noncombatant" populace openly supports the immoral use of force by its military. NATO's Kosovo operation suggests, however, that the imposition of hardship on the sentient, adult "noncombatant" population through property loss can erode a society's appetite for malevolence. While civilians should not be targeted, a new paradigm for noncombatancy that allows the destruction of certain property currently protected by international law but not absolutely indispensable to civilian survival may well help shorten conflict and effect necessary societal change.

Quartering Species: The Living Constitution, The Third Amendment, And The Endangered Species Act, Andrew P. Morriss, Richard L. Stroup

The authors argue that the fundamental flaw in the Endangered Species Act (ESA) is that it fails to force government decision makers to consider the opportunity cost of their actions, resulting in flawed decision making that imposes heavy costs on landowners without actually protecting endangered species. The authors develop this analysis through an examination of the ESA in light of the modern "living Constitution" theory of interpretation. They conclude that under this theory the ESA's "quartering of species" on private land violates the Third Amendment's ban on quartering soldiers.

Since the 1970s there has been a paradigm shift away from mass marketing towards the establishment and maintenance of individual relationships known as relationship marketing. Customer loyalty programs can be seen as the tactical strategies that have resulted from this change in focus, as they attempt to retain existing customers by developing a long-term, mutually satisfying relationship. The first of these such strategies was introduced in 1981, and they are still a relatively new and unexplored phenomenon. Tortured Confessions presents an innovative perspective on the relationship between torture and propaganda. While much has been written about the way propaganda spurs and sanctifies torture by demonizing "the enemy," few have explored the way torture itself is used to create propaganda. Abrahamian's work explores how the primary purpose of torture in Iran has been to extract ideological recantations from prisoners.

The following section provides an overview of how to think about air power and coercion, addressing several key limits of the current literature. We next examine NATO goals in Kosovo and the mixed success eventually achieved. Using that baseline, we explore various explanations for Belgrade's eventual capitulation and clarify how air power's role in each of them should be understood; we leave aside the issue of whether coercion was a proper strategy for addressing the Balkan crisis and focus instead on how to assess air power as a tool of that strategy. This thesis examines the rhetoric of Wilma Mankiller, first woman elected Principal Chief of the Cherokee Nation. Although some research has addressed Native American oratory, this study is the first to this writer’s knowledge, that critically evaluates the public discourse of Mankiller. This analysis reveals a distinct relationship in the characteristics of the rhetoric of Wilma Mankiller that are inherent in the unique cultural heritage of Native American oratory.

After this, the Portuguese came to stay in the main ports in the region, such as Ayuthaya, Pattani, Mergui, Martaban, and Pegu. West Virginia's South Branch Valley of the Potomac River played a crucial, but little studied, role in the American Civil War. Writing of the August 7, 1864, Battle of Moorefield, historian Robert K. Krick has noted that it “has received far less attention than it deserves.” In this work, it will be demonstrated that not only the August 7, 1864, Battle of Moorefield, but the conflict in the region in general is deserving of in-depth study. This research introduces the social world of gaming and looks at how one achieves the identity of gamer. The methods are a form of triangulation in order to strengthen the research, consisting of participant observation, written questionnaire, and one-to-one interviews, with an emphasis on the personal narrative. The main venues for the research were the two largest US gaming conventions, Origins and GenCon. From the data collected, elements of the world of gaming and becoming a gamer were learned and are presented. Essentially, the identity of gamer comes from the individual but is reinforced through the world of gaming.
