Our Imperial First Amendment, Paul D. Carrington
Our Imperial First Amendment, Paul D. Carrington
University of Richmond Law Review
I come to the First Amendment not as a member of the cogno- scenti, but as an observer of the secondary effects on judicial institutions of some interpretations of the Amendment made over the last thirty-five years or so. I deplore those specific effects and I will be direct in saying so. But in considering them, I have been struck by the extent of the federal courts' progress in subordinating to their own governance a wide range of other issues of great concern to citizens, all in the name of the First Amendment, a text intended to foster democratic institutions.

What Passes For Policy And Proof In First Amendment Litigation?, Rodney A. Smolla
University of Richmond Law Review
In this Allen Chair Symposium issue of the University of Richmond Law Review, three outstanding scholars have written provocative pieces on the First Amendment. Professor John Nowak engages in an exercise of constitutional futurism, "'remembering the future" to propose a number of relatively radical alterations of First Amendment doctrine to achieve what he argues should be the appropriate balance between freedom of speech and fair trials in "cyber world." Professor Paul Carrington, arguing that a communitarian right of citizens to self-government is the principal that ought to animate our politics and law, has launched a broadside indictment against contemporary First …

Before Brown: Charles H. Houston And The Gaines Case, Douglas O. Linder
Before Brown: Charles H. Houston And The Gaines Case, Douglas O. Linder
Faculty Works
In 1895 in Plessy v. Ferguson the Supreme Court announced the legal principle, separate but equal, that would guide American race relations for over half a century. For Charles Houston, the training of black lawyers was a key to mounting an attack on segregation. While at Harvard, Houston wrote that there must be Negro lawyers in every community and that the great majority of these lawyers must come from Negro schools. It was, he concluded, in the best interests of the United States - to provide the best teachers possible at law schools where Negroes might be trained. After graduating …
A Structure-Model For The Hamlet-Tradition, Christopher Scott Chiron
A Structure-Model For The Hamlet-Tradition, Christopher Scott Chiron
Dissertations and Theses @ UNI
The "hero-as-fool" structure-model for the Hamlet-story proposed by William F. Hansen is modified into an "Amlethan" structure-model with five major elements: ( 1) the Usurpation; (2) the First Test (of the Maiden); (3) the Second Test (of the Mother); (4) the Third Test (of the Journey); and (5) the Revenge. The first and last elements emphasize the "avenging son" aspect of the story whereas the middle three elements emphasize the "hero-as-fool" aspect. The Amlethan structure-model is then re-applied to the two "essential" texts in the tradition, Saxo Grammaticus' narrative of Amleth (c. 1200) and William Shakespeare's play Hamlet (c. 1600). …

The Sanctity Of Association: The Corporation And Individualism In American Law, Liam Seamus O'Melinn
The Sanctity Of Association: The Corporation And Individualism In American Law, Liam Seamus O'Melinn
San Diego Law Review
American society and law display a deep reverence for the group, as long as it assumes corporate or quasi-corporate form. This reverence is not fleeting; rather, it has deep historical roots. In fact, it was there before the republic came into being and it played a profound role in the founding of the nation. Moreover, these roots are not only traditional, but philosophical and religious as well. This Article explores those roots, with three goals in mind. First, to correct the mistaken notion that American law has historically demonstrated a commitment to the individual at the expense of the group, …
The Clapham Sect : An Investigation Into The Effects Of Deep Faith In A Personal God On A Change Effort, Victoria Marple
The Clapham Sect : An Investigation Into The Effects Of Deep Faith In A Personal God On A Change Effort, Victoria Marple
Honors Theses
This study was undertaken primarily out of an apparent inability of leadership material to answer the question of "Why" in their studies of change efforts. Despite many scholarly materials on how societal alterations occurs and steps to make social action successful, little has been written regarding the internal influences on individuals involved in these efforts and on how these influences make the leader or group successful. This particular case study has been chosen because of its clear portrayal of various leadership theories including catalytic leadership, charismatic leadership and change theory. Moreover, writings about the Clapham Sect clearly evidence that the …

Copyright As A Model For Free Speech Law: What Copyright Has In Common With Anti-Pornography Laws, Campaign Finance Reform, And Telecommunications Regulation, Rebecca Tushnet
Georgetown Law Faculty Publications and Other Works
Copyright raises real and troubling free speech issues, and standard responses to those concerns are inadequate. This Article aims to put copyright in the context of other free speech doctrine. Acknowledging the link between copyright and free speech can help determine the proper contours of a copyright regime that both allows and limits property rights in expression, skewing the content of speech toward change.

De La Pantalla Al Papel: El Cine Mudo Y La Narrativa Vanguardista Española, Maria Montoya
Dissertations, Theses, and Capstone Projects
The purpose of this interdisciplinary study is to document and explain the influence of silent film on the vanguard works of three outstanding Spanish prose writers—Francisco Ayala, Antonio Espina, and Benjamin Jarnes—during the 1920s, as well as on essays of theirs that appeared in Revista de Occidente and La Gaceta Literaria. Three aspects of film of particular importance to the analysis of these writers' works are: movies as a social phenomenon, Hollywood film stars, and the influence of film on their narrative techniques.
An examination of the main cultural and film magazines of that decade, as well as of …

Live Interpretation: An Asset, Or An Indulgence? In The Fields Of Education And Entertainment, How Valuable Is Live Interpretation As An Effective Tool Of Communication?, Dawn Helen Stevens
Other Faculty of Arts, Humanities and Business Theses
This thesis aims to assess the value of live interpretation as a tool of communication, by treating it as a form of design, and by comparing examples of practice in the field with other contemporary design techniques. Chapter two lists a selection of active practitioners across the field of informal and formal education, and entertainment within the area of Britain's cultural heritage. It provides a taste of the professional industry, and includes information like how many interpreters are employed, what techniques they favour, and what educational programmes they run. Likewise in the voluntary /hobbyist sector, the chapter notes membership numbers, …
Acts Of Writing: Writings On Contemporary Performance, Richard David Allsopp
Acts Of Writing: Writings On Contemporary Performance, Richard David Allsopp
Other Faculty of Arts, Humanities and Business Theses
The work published between 1992- 2000 and presented here forms a continuing meditation on, and exploration of contemporary performance. The term 'contemporary performance' is used to refer to practices and discourses in the performance arts that have occurred over the last decade. There is a particular emphasis on those unstable, hybrid and interdisciplinary areas of performance (including performance art, installation, 'new' dance, 'experimental' theatre, 'live' art) which resist easy definition or categorisation, and which may be further characterised as postmodern in the sense of a reflexive, contextualised and knowingly problematic practice. More specifically the work builds a sustained thesis on …

Minotaur Or The King’S Bull. By Jonathon Ward. Urban Youth Theater, Henry Street Settlement Abrons Arts Center, New York. 23 July 1999 (Performance Review), Patricia Herrera
Theatre and Dance Faculty Publications
The production of Minotaur was not only a reinterpretation of an ancient Greek myth, but an opportunity for Latino hip-hop artists to pass down a cultural tradition to the next generation. Latino artists situated hip-hop as a social movement, and the teen performers physically embodied this in the songs and dance. In this way, the Athenian rebellion became the breaking of stereotypes often associated with urban youths. The performers beautifully portrayed this act of resistance when Theseus took Minos’ golden crown, wore it, and passed it down for all the Athenians to wear.

Directing Jean Anouilh’S Antigone: Dramaturgical Protocol And Director’S Notebook, Jr Norman Luker
Whittier Scholars Program
Dear Reviewer, as my senior project for the Whittier Scholars Program it was my honor to produce, direct, and dramaturg Jean Anouilh’s Antigone as a mainstage production for [the] Whittier College Theater Arts Department. The original documents collected within this binder represent the process through which the production came together. The collection includes dramaturgical research (articles with my original notes), production planning notes, design conceptions, relentless schedules, audition and casting information, dramaturgical notes, critical reviews and most importantly seven weeks of rehearsal journals. However, the real meat of the project were the actual performances where all the planning, designing, and …
The Animus : A Jungian Perspective On The Films Of Jane Campion, Taryn Louise Ricketts
The Animus : A Jungian Perspective On The Films Of Jane Campion, Taryn Louise Ricketts
Theses : Honours
Carl Jung's notion of contrasexuality allows women to embrace the masculine as well as feminine aspects of their personality. This creates a sense of complementarity or balance that is often lacking in the established psychoanalytic interpretation of female representations within mm texts. The 'animus,' or masculine complex, is an empowering theory in understanding representations of women within the filmic text as embarking on a process of self-realisation, self-acceptance, and the discovery of their own authority in the context of their relationships with men. Furthermore, the animus has been credited as Jung's greatest contribution to the study of the female psyche. …
