Stopping Hate Without Stifling Speech: Re-Examining The Merits Of Hate Speech Codes On University Campuses, Catherine B. Johnson

This Note explores legislative attempts to help reduce incidents of hate speech on university campuses. It begins by analyzing the rise in hate speech codes at public universities and examining two U.S. Supreme Court decisions in R.A.V. v. City of St. Paul and Wisconsin v. Mitchell. The author argues that a hate speech code that implements forward-looking, long-term education objective would work towards stopping hate on campus without violating students' First Amendment rights. This Note reaches the conclusion that a narrowly drawn hate speech code based on recognized First Amendment exceptions, implemented along with with education initiatives, could facilitate the …

Comparative law and legal anthropology have for long theorized on the basis of a traditional geography which saw states, regions, locales and social fields as having durable boundaries containing stable and homogenous cultures. This idea of place is now undergoing a massive transformation in response to the effects of and theories about globalization. The emerging ‘process geography’ rejects these traditional ideas, arguing that they are not, and indeed have never been aspects of reality, which is better represented by an imagery of processes. However, it is argued here that globalization is not a synonym for homogenization, nor has place suddenly …

Black Gaius: A Quest For The Multicultural Origins Of The "Western Legal Tradition", P. G. Monateri

This article is divided into two parts. The first is devoted to reconstructing the historical self-consciousness of the Western Legal Tradition, showing the emergence of a model based on the more or less explicit assumptions of Roman, and subsequently Western, legal originalism and supremacy. In the second part, different areas are investigated--contract, theories of government, dispute settlements, and legal culture-to challenge the same existence of a Roman law at the root of modem Western laws. In this way the package of received ideas in legal scholarship about the history and nature of the Western legal culture is revealed to be …

Lifting The Veil: The Arts, Broadcasting And Irish Society, Brian O'Neill

This article examines the role played by broadcasting in Irish artistic and cultural life from independence in 1922 to 1960 with the onset of formal modernization. It examines the cultural context for the arts in early independent Ireland in which a mood of ambivalence and sometimes outright hostility to high culture prevailed. Rather than a profound disjunction between pre- and post-modernizing phases of Irish history, however, this article argues that there were important lines of continuity in cultural experience, in particular middle-class experience of the arts, which continue to inform Irish cultural life up to the present. Masked Criticism: The Whore And The Breeches Role As Articulators Of Sexual Economic Theory In The Intrigue Plays Of Aphra Behn., Mary Katherine Politz

Aphra Behn was an important playwright in the Restoration, second only to John Dryden in the number of plays produced during the period. In some of her early plays based on Spanish intrigue comedies, she uses the roles of whores and cross dressed women to articulate her criticism of the sexual economy within patriarchy. Masks and disguises create confusion in all the plays. Her characters, plots, structure, humor and economic concerns change with each successive play. The first play in the series, The Dutch Lover (1673) is a tale of romance where women are exchanged between men for the benefit …

This study, focusing on select novels by women writers of the African diaspora, discovers a surprising commonality among works with obvious geographical, cultural and linguistic differences---an affirmation of the philosophical essence of the Vodun religion as an antidote to Western spiritual and cultural moribundity. Each of the novels---Zora Neale Hurston's Their Eyes Were Watching God, Simone Schwarz-Bart's Pluie et Vent sur Telumee Miracle, and Paule Marshall's Praisesong for the Widow---alludes to the Vodun pantheon, ancestor veneration and/or rituals in order to valorize the holistic Vodun worldview that recognizes the interconnectedness of all living things and the fluidity of boundaries between …

This study examines how problematic representations of brides reflect anxiety about women's roles in the marriage market of the early twentieth-century United States in Grace Lumpkin's The Wedding, Eudora Welty's Delta Wedding, and Alice Childress's Wedding Band: A Love /Hate Story in Black and White. The study develops a theoretical model of stages young women negotiate in order to participate in the sexual economic process underlying the marriage exchange: initiate, self-fashioner, marriageable woman, bride, wife, and mother. In moving through these stages, the young woman increasingly loses her identity as she fashions herself into the socially-constructed persona "lady," or marriageable …

The Royal Court Theatre's current renovation invites a reexamination of the English Stage Company (ESC). The ESC has entered a crucible of change, raising new questions concerning the Royal Court's architectural semiotics and company's aesthetic mission as London's most acclaimed producer of new plays. This study seeks to understand the ways in which its identity has been shaped and consolidated over the last forty-two years and how the current chapter in ESC history redefines the company's identity and future achievement. Rights Of Passage: A Cross -Cultural Study Of Maroon Novels By Black Women., Randi Gray Kristensen

This study investigates the use and implications of the trope of marronage, the African-American practice of self-emancipation to forge alternative New World communities, in selected novels by Black women writers of North America and the Anglophone and Francophone Caribbean. It draws on theories of liminality to posit a theory of liberatory practice that deconstructs hegemonic narratives, both personal and historical. Postmodern approaches are deferred in favor of locating these texts and their concerns as deriving from the epistemological consequences of modernity. Johnny Simons is a Commedia Dell' Arte master who brought contemporary commedic movement theatre to the American Southwest and deserves academic attention. Simons and his collaborators, Diane Simons and Doug Balentine, founded the Hip Pocket Theatre to explore original theatre that reflected their chthonic identity. Simons is an auteur, serving as playwright, lyricist, director, choreographer, designer, and technical director for his productions. His works synthesize classical forms with the archetypal associations of his childhood. This study examines Simons' pedagogical approach to his "lyric grotesque" genre of movement theatre. The on-going comparison of the sister arts (poetry and painting) in the eighteenth century recommends a reassessment of Francis Hayman's role as an artist reading and interpreting literary texts. A founding member of the Royal Academy in 1768, Francis Hayman began his artistic career as a scene painter at the Goodman's Fields and Drury Lane theaters. Although Hayman was one of the most prolific book illustrators in mid eighteenth century Britain, relatively little critical attention has been devoted to his work. (First paragraph)My sister, Nahid, is four years younger than me. She suffers from osteomyelitis, which began from an infected umbilicus at birth, the result of unsanitary conditions at Morsalin hospital in Iran. She was given massive doses of antibiotics to help fight the infection, followed by surgery at the age of one to drain the affected area. Despite these efforts, the top of Nahid 's right femur was eroded by the infection. It left her with a hanging hip and a severe limp.

College writing teachers often consider the reading and writing experiences students have had in elementary and high school classes as their only relevant discursive influences. When they do so they risk ignoring what is perhaps the most powerful and ubiquitous form of public discourse and communication in our society: television. This dissertation explores how the pervasive discourse of popular culture on television influences the ways in which incoming college students perceive and engage in writing and reading when they enter a first-year composition course. Through interviews with students and observations of them watching television, I have studied the skills students …
