Internationalism, Regionalism, And National Culture: Music Control In Bavaria, 1945–1948, David Monod Jan 2000

Internationalism, Regionalism, And National Culture: Music Control In Bavaria, 1945–1948, David Monod

History Faculty Publications

For many Germans in the immediate postwar period, all that remained of their country was its art. Subjugation, destruction, the pain of unfathomable guilt: these had ripped away at the national psyche, severing nation from nationalism, person from people, the present from the past. “We are,” wrote Wolfgang Borchert in 1946, “a generation without a homecoming, because we have nothing to which we can return.” Nation: what would that word now mean? An occupied state no longer possessing statehood, a conquered people starved even of the moral strength that might come from resisting. Even if the institutions of national governance …

Are Business Method Patents Bad For Business?, Rochelle C. Dreyfuss Jan 2000

Are Business Method Patents Bad For Business?, Rochelle C. Dreyfuss

Faculty Articles

This article examines business method patenting. After describing State Street Bank & Trust Co. v. Signature Financial Group, Inc., the Federal Circuit's 1998 decision recognizing business method patents, I discuss the problems arising from extending patent law to the business environment. First, I show why many invalid patents are likely to issue. Second, I review the rationales for intellectual property protection and demonstrate why none are relevant to business methods. Third, I argue that business model patenting can distort competition by insulating inefficient business operations. Because of network effects and lock in, these inefficiencies?and the resulting distortion?can persist even if …

Personal Harms And Political Inequities, Suzanne B. Goldberg Jan 2000

Personal Harms And Political Inequities, Suzanne B. Goldberg

Faculty Scholarship

When we think back to where the legal battle for gender equality and the rights of gay people stood a century ago, we see that, in fact, there was not much of a battle. Indeed, advocates for change were seldom triumphant. A survey in 1900 would have shown that American women were twenty years away from obtaining the right to vote, were unfit to be lawyers according to the U.S. Supreme Court, and were nowhere near being eligible-let alone required-to serve on juries. The survey would also have revealed a wide-ranging web of federal and state laws and policies that …

'Rather Say I Play The Man I Am': Shakespeare's Coriolanus And Elizabethan Anti-Theatricality, Kent Lehnhof Jan 2000

'Rather Say I Play The Man I Am': Shakespeare's Coriolanus And Elizabethan Anti-Theatricality, Kent Lehnhof

English Faculty Books and Book Chapters

In the second act of Shakespeare's Coriolanus, the hero is informed that his acceptance as a Roman consul is dependent upon donning the robe of humility and petitioning the common people in the market-place for their ratifying vote. Coriolanus recoils from the custom, outraged at the idea of acting a part—complete with costume, dialogue, and stage directions— that does not correspond with his inner truth. At this moment and others, Coriolanus echoes the anti-theatricalist rhetoric of Elizabethan pamphleteers like the popular and prolific Stephen Gosson. In many ways, Coriolanus serves as a stand-in for the anti-theatrical ideology of Gosson and …

The Repudiation Of The Marvelous: Jonson’S The Alchemist And The Limits Of Satire, Ian Mcadam Jan 2000

The Repudiation Of The Marvelous: Jonson’S The Alchemist And The Limits Of Satire, Ian Mcadam

Quidditas

Our present conception of alchemy is, at best, shadowy and confused. As Charles Nicholl states in The Chemical Theatre, "The modern image...tends in two directions: one scientific, the other magical. The first defines alchemy simply and chronologically as early chemistry...out of which modern chemistry began to emerge during the seventeenth century.” On the other hand, “alchemy is popularly defined as one of the ‘occult arts’.... To us, the alchemist’s avowed quest for miraculous substances—the Philosopher’s Stone which converts all to gold, the Elixir Vitae which confers immortality—belongs to the realm of magic rather than science.” Nevertheless, to consider Renaissance …
