Microfinance And Poverty Alleviation: Lessons From Indonesia's Village Banking System, Yoko Miyashita

Washington International Law Journal

Indonesia needs an aggressive poverty reduction strategy to counter the 1997 Asian financial crisis, which has propelled millions of its citizens into poverty. Microfinance is a proven method of reducing poverty and has been successfully used within Indonesia in government-supported programs. In addition to continuing its state-run microfinance programs, Indonesia should support increased non-governmental organization ("NGO") participation in microfinance programs by permitting NGOs to conduct the full range of activities of a state-run microfinance program. Such a move would help to ensure that microfinance services reach people with the least access to the formal financial sector.

Title IX's three-part test for measuring discrimination in the provision of athletic opportunities to male and female students has generated heated controversy in recent years. In this Article, Professor Brake discusses the theoretical underpinnings behind the three-part test and offers a comprehensive justification of this theory as applied to the context of sport. She begins with an analysis of the test's relationship to other areas of sex discrimination law, concluding that, unlike most contexts, Title IX rejects formal equality as its guiding theory, adopting instead an approach that focuses on the institutional structures that subordinate girls and women in sport. …

Pay Equity For Coaches And Athletic Administrators: An Element Of Title Ix?, Barbara Osborne, Marilyn V. Yarbrough

University of Michigan Journal of Law Reform

In this Article, Professors Osborne and Yarbrough address the issue of gender discrimination in the compensation of coaches and athletic administrators. They discuss the application of the Equal Pay Act of 1963 and Title VII to pay inequity claims and conclude that both have proven to be inadequate as a means of addressing the problem. Professors Osborne and Yarbrough then present Title IX as a way of countering the problem of gender discrimination in the compensation of coaches. They also discuss the prospects for gender equality in compensation by considering several cases addressing the issue. Finally, they offer recommendations both …

The legal system should rely much more than it now does on statistical evidence. It should be cautious about the judgments of experts, who make predictable cognitive errors. Like everyone else, experts have a tendency to blunder about risk, a point that has been shown to hold for doctors, whose predictions significantly err in the direction of optimism. We present new evidence that individual doctors' judgments about the ordinary standard of care are incorrect and excessively optimistic. We also show how this evidence bears on legal determinations of negligence, by doctors and others.

This Article begins with the puzzle of why law does not embrace the "product rule"; a mathematically-inclined judge or jury that thought a defendant .6 likely to have been negligent and .7 likely to have caused plaintiff's harm might conclude that plaintiff had failed to satisfy the preponderance of the evidence standard. Following some discussion of a number of reactions to this puzzle, the Article advances the idea that the process of aggregating multiple jurors' assessments overlooks valuable information. First, following the Condorcet Jury Theorem, agreement among jurors might raise our level of confidence beyond what the jurors themselves report. …

Evolutionary Psychology, Meet Developmental Neurobiology: Against Promiscuous Modularity, David J. Buller, Valerie Gray Hardcastle

Evolutionary psychologists claim that the mind contains “hundreds or thousands” of “genetically specified” modules, which are evolutionary adaptations for their cognitive functions. We argue that, while the adult human mind/brain typically contains a degree of modularization, its “modules” are neither genetically specified nor evolutionary adaptations. Rather, they result from the brain's developmental plasticity, which allows environmental task demands a large role in shaping the brain's information-processing structures. The brain's developmental plasticity is our fundamental psychological adaptation, and the “modules” that result from it are adaptive responses to local conditions, not past evolutionary environments. Biofilms are complex communities of microorganisms attached to surfaces or associated with interfaces. Despite the focus of modern microbiology research on pure culture, planktonic (free-swimming) bacteria, it is now widely recognized that most bacteria found in natural, clinical, and industrial settings persist in association with surfaces. Furthermore, these microbial communities are often composed of multiple species that interact with each other and their environment. The determination of biofilm architecture, particularly the spatial arrangement of microcolonies (clusters of cells) relative to one another, has profound implications for the function of these complex communities. This dissertation revolves around Alexander von Humboldt's research on Indian origins. Humboldt conducted investigations on Indians during his precedent-setting scientific expedition to Meso- and South America during the years 1799--1804. Officially sponsored by the Spanish crown, the main purposes for this expedition were twofold: to examine, evaluate, and discredit Buffon's "degeneracy" claims about America and its inhabitants, and to gather empirical evidence on geography, climate, flora, fauna, and the indigenous cultures. From these results Humboldt published three major works about the expedition, particularly a thirty-volume work condensed to two volumes, Vues de Cordilleres et monuments des peuples d' Amerique.;From this …

In response to elevated serosal or mucosal tonicity, guinea-pig tracheal epithelium releases the non-nitric oxide, non-prostanoid, epithelium-derived relaxing factor (EpDRF), which subsequently diffuses to the underlying airway smooth muscle to initiate relaxation. Hypertonicity-induced smooth muscle relaxation via EpDRF involves epithelial Na+ and Cl- channels and is preceded by a depolarization of the transepithelial potential difference (Vms). By utilizing two different experimental systems, this study sought to characterize further the airway epithelial bioelectric mechanisms associated with the effects of EpDRF in guinea-pig isolated trachea.;First, this study attempted to elucidate which epithelial ion channels and/or transporters are involved in the depolarization of …

The goal of this research is to explore techniques with which long-term physiologic time-series data can be analyzed, so that relevant changes in physiological signals, particularly the electrocardiogram signal, can be captured, processed, quantified and stored. A new experimental model was developed such that the electrocardiogram can be monitored continuously over thirteen weeks. Cardiotoxicity was progressively induced with doxorubicin in a rabbit model, and electrocardiographic progressions from normal state to diseased state were continuously tracked. Automated methods for analyzing the data were developed to manage and control the extensive electrocardiogram dataset. A significant challenge to this work is the sheer …

Session-reduction procedures have been employed to assess molar control of avoidance responding. By conceptualizing session reduction as a delayed timeout from avoidance, the present study investigated the limits of molar control while minimizing several methodological limitations inherent in such procedures. Six times during each session, a two-link chain schedule was superimposed on a baseline schedule of variable-cycle shock avoidance. Completion of the initial link (fixed-ratio 10 schedule) produced a timeout following a signaled delay during which the avoidance schedule remained operative. For most rats, the delay was manipulated across conditions from 0 s to 60 s. Control by the delayed …

The use of Fly-By-Wire digital flight control systems in commercial aviation (Airbus 320 and Boeing FBW-B777) is a clear sign of this trend. The increased automation goes in parallel with an increased complexity of flight control systems with obvious consequences on reliability and safety. For thirty-five years, the civil rights community has paid scant attention to administrative law principles. Those interested in advancing on-the-job equality for this country's working men and women (or in preserving employer autonomy vis-a-vis federal encroachment) have all but ignored what many consider the arcane technicalities of administrative law. This state of affairs is strange when one considers that administration and enforcement of each of our major federal laws outlawing employment discrimination have been confided to an administrative agency, the Equal Employment Opportunity Commission ("EEOC"). In the late 1980s, a series of well-publicized defense contractor abuses brought the ordinarily obscure topic of government contracting into the public eye. These abuses included not only instances of seemingly wasteful charges, like the infamous $600 toilet seat, approved by a complicit Department of Defense, but also examples of truly fraudulent activity such as knowingly overbilling and supplying inferior quality goods. The fraud cases grabbed the public attention for three primary reasons. First, enormous sums of money were involved. A fierce debate about the Second Amendment has been percolating in academia for two decades, and has now bubbled through to the courts. The question at the heart of this debate is whether the Amendment restricts the government's ability to regulate the private possession of firearms. Since at least 1939 - when the Supreme Court decided United States v. Miller, its only decision squarely addressing the scope of the right to "keep and bear Arms" - the answer to that question has been an unqualified "no." This paper documents the foreign asset ownership and investment theory of the dynamic GTAP model (GTAP-Dyn). The new investment theory offers a disequilibrium approach to modeling endogenously international capital mobility. It permits a recursive solution procedure, a feature that allows easy implementation of dynamics into any static AGE model without imposing limitations on the model's size. The method involves treating time as a variable, not as an index. Having time as a variable allows the construction of dynamic GTAP with minimum modifications to the existing structure of GTAP, by separating the theory of static GTAP from the length of run.

In his article, "Comparative Literature in India," Amiya Dev bases his discussion on the fact that India has many languages and literatures thus representing an a priori situation and conditions of diversity. He therefore argues that to speak of an Indian literature in the singular is problematic. Nonetheless, Dev also observes that to speak of Indian literature in the plural is equally problematic.
