Why do so many executives and other employees receive fixed stock options as part of their compensation packages? There is an impressive literature on compensatory options, and yet it raises more puzzles than it solves. Tax law, option theory, and agency theory all suggest that we might have expected to find quite different practices than we do observe. In particular, there is a puzzle in the popularity of conventional fixed options when indexed options would seem to be relatively attractive. Biofilms are complex communities of microorganisms attached to surfaces or associated with interfaces. Despite the focus of modern microbiology research on pure culture, planktonic (free-swimming) bacteria, it is now widely recognized that most bacteria found in natural, clinical, and industrial settings persist in association with surfaces. Furthermore, these microbial communities are often composed of multiple species that interact with each other and their environment. The determination of biofilm architecture, particularly the spatial arrangement of microcolonies (clusters of cells) relative to one another, has profound implications for the function of these complex communities. This article explores the presuppositions that preceded Ex Corde Ecclesiae and offers an analysis of the recently approved ordinances for its implementation. Candid discussion of the challenges that remain in the implementation process concludes the article. Calling the 1967 Land O’ Lakes Statement by the presidents of the major American Catholic universities “not the path to follow,” the author explains how a successful implementation of Ex Corde Ecclesiae might look.

Foundation trustees and professional staff are giving greater attention to issues of accountability and return on investment, while voices of those with significant experience in the private sector inquire with increasing frequency and vigor about the organizational performance of foundations. For these reasons there must be renewed attention on the competencies and attributes of grantmaking practitioners. This study is a self-assessment by grantmakers based on the construct of Emotional Intelligence (Goleman, 1995) as well as competency studies in organizational management and leadership.

Both imply a systematic approach beginning with clarity in problem definition, understanding the objectives and constraints, characterising the alternatives (these three steps constitute  model building), evaluating (analysing) them and finally selecting an alternative for implementation. Vicarious Traumatization: An Examination Of The Effects Of Exposure To Traumatic Material In Child Abuse Counselors, Stacey A. Waller

Counselors who deliver services to children who have suffered maltreatment confront on a daily basis horrific examples of human suffering inflicted on society's most vulnerable members. Such repeated exposure may put these professionals at risk for adverse psychological consequences, including vicarious traumatization (VT), which can include symptoms similar to posttraumatic stress disorder (PTSD). The present study examined the unique effects of providing trauma services to children on 34 counselors who work primarily with child survivors of maltreatment. While the prevalence of PTSD symptoms in this sample was low, respondents reported higher levels of depression and emotional exhaustion than found in …

A Gene Expression Screen Identifies Earli1 As A Novel Vernalization-Responsive Gene In Arabidopsis Thaliana, Richard K. Wilkosz, Michael Schläppi

Vernalization promotes early flowering in late ecotypes of Arabidopsis thaliana. The mechanisms of vernalization are poorly understood. A subtractive hybridization approach was used to isolate vernalization-responsive genes from a late-flowering ecotype of Arabidopsis thaliana based on the premise that transcript levels of such genes would increase with cold treatment and remain high even after removal of the vernalization stimulus. EARLI1 is the first Arabidopsis gene shown to be stably activated by vernalization. The abundance of its RNA is progressively elevated by vernalization and remains high for at least 20 days at room temperature. The basal level of EARLI1 RNA …

Since it began promulgating rules to implement the local competition provisions of the Telecommunications Act of 1996, the FCC has been under attack in the courts. The road has been a rough one, and the Commission has lost on a good many issues. The Commission has regularly accused its opponents in these legal battles-chiefly the incumbent local exchange carriers-of using litigation to impede the implementation of the 1996 Act’s local competition provisions. When analyzing issues surrounding minority ownership of media, scholars have often noted that policy discussions in the area suffer from the linked problems of inadequate data and a lack of tools with which to analyze the data that do exist and might be collected. In Issue Three of Volume 51, several authors made this particular observation. To address this problem, This Article shows how one may use economic analysis and a financial model of a "typical" radio broadcaster to quantify the effects of specific policies. The Rights Of Common Carriers And The Decision Whether To Be A Common Carrier Or A Non-Regulated Communications Provider, James H. Lister

The decision whether to be a regulated common carrier or a non-regulated communications provider carries with it numerous benefits and burdens that must be weighed. Although one may automatically assume that non-regulation is preferable, that may not always be the case. This Article directly addresses the decision of whether to be a lightly-regulated non-dominant common carrier or a non-regulated private carrier. The Article argues that certain statutory and regulatory rights enjoyed by common carriers are more important than the minimal regulatory burdens associated with non-dominant common carrier regulation.

In the "new economy" driven by the telecommunications industry, the FCC is a busy agency. Given the myriad legal issues faced daily by agency decisionmakers and the lack of perfect clarity in major communications legislation, a few legal missteps here and there by the FCC might be expected. In one area, however, the public can and should demand a first-rate agency record: regulation of communications media without regard to the viewpoint expressed via that media, as the First Amendment requires. The Fcc And Section 312(A)(7) Of The Communications Act Of 1934: The Development Of The “Unreasonable Access” Clause, Philip J. Gutwein Ii

Section 312(a)(7) of the Communications Act of 1934 requires that broadcast stations provide legally qualified candidates for federal elective office with reasonable access to advertising time on behalf of their candidacies. The FCC has long struggled with defining "reasonable access." On September 7, 1999, the FCC issued a Memorandum Opinion and Order in which it ruled that broadcast stations may not refuse a request for political advertising time solely because the station does not sell or program such lengths of time. The character of a regulatory agency is most severely tested at the zenith of its power. When the Federal Communications Commission ("FCC" or "Commission") breaks free of the limitations imposed by the law, the Commission’s leadership sets its own course. It is at these times, when legal oversight is at a minimum, that it becomes most important for the agency to "pay more attention to justice."
