Reconciling Trade And Environment: A Legal Analysis Of European And North American Approaches, Bradly J. Condon Apr 2000

Reconciling Trade And Environment: A Legal Analysis Of European And North American Approaches, Bradly J. Condon

Cardozo Journal of International and Comparative Law

The article examines the differing approaches of the European Union (EU) and the North American Free Trade Agreement (NAFTA) in reconciling trade liberalization with environmental protection. While the EU employs a proportionality principle that prioritizes environmental protection over trade in cases of conflict, NAFTA uses a least-trade-restrictive principle to balance these interests. The analysis highlights that both systems reflect distinct political, economic, and legal frameworks but could benefit from learning each other's strengths and addressing their respective weaknesses.

Decriminalization Of Sodomy Under South Africa's 1996 Constitution: Implications For South African And U.S. Law, Heidi Joy Schmid

Cardozo Journal of International and Comparative Law

The note examines the landmark decision of the South African Constitutional Court in National Coalition for Gay and Lesbian Equality and Another v. Minister of Justice and Another, which invalidated sodomy laws as unconstitutional. The court held that these laws violated rights to dignity, privacy, and equality under the South African Constitution of 1996. Judge Sachs emphasized the interconnectedness of privacy and equality rights, advocating for a broad interpretation of privacy and the importance of dignity in challenging discriminatory laws. The decision not only advanced sexual minority rights in South Africa but also highlighted broader implications for global jurisprudence, …

An Analysis Of The Effectiveness Of A Constructive Induction-Based Virus Detection Prototype, Kevin T. Damp Apr 2000

An Analysis Of The Effectiveness Of A Constructive Induction-Based Virus Detection Prototype, Kevin T. Damp

Theses and Dissertations

Computer viruses remain a tangible threat to systems both within the Department of Defense and throughout the greater international data communications infrastructure on which the DoD increasingly depends. This threat is exacerbated continually, as new viruses are introduced at an alarming rate by the growing collection of connected machines and their operators. Unfortunately, current antivirus solutions are ill-equipped to address these issues in the long term. This thesis documents an investigation into the use of constructive induction, a form of machine learning, as a supplemental antivirus technique theoretically capable of detecting previously unknown viruses through generalized decision-making techniques. A group …

A Socio-Cultural Comparative Study Of Freshmen Of Mexican Descent Attending Western Michigan University, Diane M. Ariza

Dissertations

Institutional racism, encouraged assimilation, and ignorance of Latino/a values are current barriers to the academic success and leadership development of students of Mexican descent in higher education. This study examined the lives and personal stories of 22 college freshmen of Mexican descent from Texas and Michigan and how they transitioned and adapted their first year at Western Michigan University. This study used interviews and participant observation to examine the individuals in each cohort in order to construct their life stories.

An additional purpose was to critically examine the role of the researcher who was highly involved in the recruitment and …

Identification And Classification Of Coryneform Bacteria Isolated From Bovine Mammary Glands, Jeffrey L. Watts Apr 2000

Identification And Classification Of Coryneform Bacteria Isolated From Bovine Mammary Glands, Jeffrey L. Watts

Dissertations

Coryneform bacteria are frequently isolated from bovine mastitis and these infections are associated with economic losses. Corynehacterium bovis, a lipid requiring species, has been the most frequently isolated coryneform from the milk of infected bovine mammary glands. However, the taxonomic status of this organism is uncertain. In the current study, a polyphasic approach was used to identify coryneform bacteria isolated from bovine mastitis and determ ine the phylogenetic relationships among the identified species. A total of 212 coryneform bacteria isolated from bovine mastitis was obtained from mastitis reference laboratories in the United States and Canada. Presumptive identification based upon …

Pulsed Optoacoustics In Solids, Zibiao Wei Apr 2000

Pulsed Optoacoustics In Solids, Zibiao Wei

Electrical & Computer Engineering Theses & Dissertations

Optoacoustic techniques are widely used to probe and characterize target materials including solids, liquids and gases. Included in such applications are diagnoses of thin films and semiconductor materials. The need to obtain greater spatial resolution requires the generation of shorter optoacoustic pulses. For such pulses, non-thermal effects may be quite important. On the other hand, even when an optoacoustic pulse is generated by an initially non-thermal technique, the thermal aspects become important in its evolution and propagation. The research undertaken in this Ph.D. dissertation included the generation and detection of optoacoustic signals through the thermal elastic mechanism. Several applications in …

Process Flow Optimization Studies Through Discrete Event Simulation, Milind Chokshi Apr 2000

Process Flow Optimization Studies Through Discrete Event Simulation, Milind Chokshi

Electrical & Computer Engineering Theses & Dissertations

Computer-aided simulation has begun to emerge as a powerful tool for numerical analysis of the behavior and anticipated performance of industrial systems and their optimization. Applications include materials handling, storage and controls systems, prediction of manufacturing efficiencies, and production optimization. Simulations are used to test baseline models and subsequently analyze new production concepts, operating strategies, and planned procedures prior to costly implementation.

The study of process flows in a manufacturing environment is difficult due to its inherent stochastic nature. Breakdown of the sub-systems and failures of machines is a random process and needs to be solved based on concepts of …

Kinetic Characterization Of Tetracycline Binding And Release By Demineralized Bone - Dfdba, Orner Kabil

Biological Sciences Theses & Dissertations

The microbial etiology of periodontal diseases has led to widespread research in the development of methods and local delivery systems to increase the efficacy of antibiotic therapy. Several drug delivery systems employing biodegradable and nonbiodegradable carriers have been shown to release antibiotics directly into periodontal pockets. The purpose of this study was to determine the binding and release kinetics of tetracycline by demineralized bone. Further aspects of the study include in vitro evaluation of DFDBA (demineralized freeze-dried bone allografts) as a tetracycline carrier system for periodontal therapy. Experiments were performed which employed different tetracycline concentrations with constant amounts of bone …

Relationship Between Reported Childhood And Adult Physical Activity, Kipp Ryan Kissinger Apr 2000

Relationship Between Reported Childhood And Adult Physical Activity, Kipp Ryan Kissinger

Student Work

It was the purpose of this research to examine the relationship between reported childhood and adult physical activity (PA), with special regards to the types of activities that correlate with habitual activity. Subjects were 249 male and female students age 19 to 30 years (M = 21.9 years) enrolled at the University of Nebraska at Omaha. Subjects were surveyed from all departments on campus. Subjects were asked to complete a survey instrument that assessed past and present PA. The results o f the current study reported that there is a significant positive correlation (r = 0.284, p < 0.05) between the total score of past childhood PA and present adult PA. When past PA was divided into preteen and adolescent periods, there were also significant relationships (p < 0.05) with all of the four indices of present PA (work, sport, leisure and total). Regression analysis explained 17.6 % of the variance in exercise when predicting adult PA from the total score of past PA. The prediction equation is as follows: Y ' = 27.761 + 0.775 (Xi) + 0.276 ( X 2 ) + 0.945 ( X 3 ) + 1.787 (3Ct) - 1.254 ( X 5 ) ; where Xi = number o f varsity athletic letters received as an adolescent, X 2 = informal activities as a preteen, X 3 = level of athletic ability or coordination in favorite sport as an adolescent, X4 = P.F.. classes as an adolescent, and X5 = activity level compared to peers as a preteen. It was concluded that there was a significant positive correlation (p < 0.05) between the total score of past PA and each of the four indices of present PA.

Effects Of Acid Adaptation Of Escherichia Coli O157:H7 On Efficacy Of Acetic Acid Spray Washes To Decontaminate Beef Carcass Tissue, Elaine Berry, Catherine N. Cutter Apr 2000

Effects Of Acid Adaptation Of Escherichia Coli O157:H7 On Efficacy Of Acetic Acid Spray Washes To Decontaminate Beef Carcass Tissue, Elaine Berry, Catherine N. Cutter

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Exposure to low pH and organic acids in the bovine gastrointestinal tract may result in the induced acid resistance of E. coli O157:H7 and other pathogens that may subsequently contaminate beef carcasses. The effect of acid adaptation of E. coliO157:H7 on the ability of acetic acid spray washing to reduce populations of this organism on beef carcass tissue was examined. Stationary-phase acid resistance and the ability to induce acid tolerance were determined for a collection of E. coliO157:H7 strains by testing the survival of acid-adapted and unadapted cells in HCl-acidified tryptic soy broth (pH 2.5). ThreeE. coli …

The Effectiveness Of The Comprehensive Test Ban Treaty On Nuclear Weapons Proliferation: A Review Of Nuclear Nonproliferation Treaties And The Impact Of The Indian And Pakistani Nuclear Tests On The Non-Proliferation Regime, Vejay Lalla Apr 2000

The Effectiveness Of The Comprehensive Test Ban Treaty On Nuclear Weapons Proliferation: A Review Of Nuclear Nonproliferation Treaties And The Impact Of The Indian And Pakistani Nuclear Tests On The Non-Proliferation Regime, Vejay Lalla

Cardozo Journal of International and Comparative Law

The Comprehensive Test Ban Treaty (CTBT) and the Nuclear Non-Proliferation Treaty (NPT) are insufficient to curb nuclear proliferation due to weaknesses in their enforcement mechanisms, loopholes in their provisions, and challenges posed by new nuclear states like India and Pakistan. The treaties fail to address critical issues such as arbitrary withdrawal clauses and inadequate verification systems, undermining their effectiveness in achieving global nuclear disarmament.
