Anti-Ballistic Missile Defense Systems And Rhetorical Madness, Ibpp Editor Jun 2000

Anti-Ballistic Missile Defense Systems And Rhetorical Madness, Ibpp Editor

International Bulletin of Political Psychology

This article describes examples of political rhetoric on anti-ballistic missile defense systems from the two main presidential candidates in the United States. These examples may be undone by their consequential implications for military and politico-military deterrence and the development and proliferation of nuclear weapons even as they may garner success as campaign attack vehicles.

Crimes Against Children Research Center

The kidnaping of children has generated a great deal of public concern, not to mention confusion and controversy. These crimes, from the kidnaping of the Lindbergh baby to the abduction and murder of Adam Walsh, have been some of the most notorious and highly publicized news stories of recent history, occupying a central place in the fears and anxieties of parents. Yet, an ongoing debate has raged over how frequently such crimes occur, which children are most at risk, and who the primary offenders are.

Biology For Feminists, Katharine K. Baker Jun 2000

Biology For Feminists, Katharine K. Baker

Chicago-Kent Law Review

Feminists and sociobiologists have more in common than many people realize. In this Essay, Baker argues that feminists can use insights from sociobiology to validate feminist theories about patriarchy and to bolster claims for a greater legal commitment to feminist normative agendas. Paying particular attention to the laws regarding rape, marriage, and parenthood, Baker shows how biology helps confirm what feminists have long argued about the law's inadequate protection of women. Moreover, she shows how biology helps demonstrate the keen need for feminist social norms that help alleviate the harms caused by nature's inequities.

The "Normal" Successes And Failures Of Feminism And The Criminal Law, Victoria Nourse Jun 2000

The "Normal" Successes And Failures Of Feminism And The Criminal Law, Victoria Nourse

Chicago-Kent Law Review

Feminist reforms have brought both success and failure to the criminal law in the past several decades. Nourse examines this simultaneous success and failure in three different areas: rape reform, marital rape immunities, and self-defense law. Her analysis urges that the criminal law has not been able to shake itself free of social norms governing intimate relationships-social norms that tend to perpetuate the very sexism feminists aimed to extinguish. Relational norms are upwardly mobile and easily nurtured by the "deliberate ambiguities" necessary to forge legislative and judicial change. Nourse argues that, in this sense, the failures of feminist reform should …

The Effects Of Role-Taking And Embarrassability On Undergraduate Drinking: Some Unanticipated Findings, Lizabeth A. Crawford, Katherine B. Novak Jun 2000

The Effects Of Role-Taking And Embarrassability On Undergraduate Drinking: Some Unanticipated Findings, Lizabeth A. Crawford, Katherine B. Novak

Scholarship and Professional Work - LAS

This paper focuses on the relationship between role-taking, affect, and alcohol use among college undergraduates. Role-taking is the process through which people anticipate the perspectives—expectations, evaluations, and behaviors—of others (Mead, 1934). Reflexive role-taking (i.e.,viewing oneself through the eyes of others) was significantly related to four distinct types of embarrassment. However, in opposition to our hypotheses, embarrassment resulting from becoming the center of others’ attentions was the only form of embarrassability significantly related to undergraduate drinking. Moreover, it was those students least susceptible to this type of embarrassment who were the most likely to be drinkers. While role-taking, in general, was …

"Ready? Induce. Sting!": Arguing For The Government's Burden Of Proving Readiness In Entrapment Cases, David D. Tawil Jun 2000

"Ready? Induce. Sting!": Arguing For The Government's Burden Of Proving Readiness In Entrapment Cases, David D. Tawil

Michigan Law Review

For over 100 years the United States judiciary has struggled with the sting and the entrapment defense, examining whether government agents deviously manufacture crimes or merely afford criminals the opportunity to commit them. The sentiments of Justice Holmes were rare for his time, but today they are reflected in a growing sympathy for sting victims. While courts are now more willing than ever to find entrapment, they still differ over the burden of proof that the government must satisfy to overthrow an entrapment defense. Specifically, courts disagree about whether the burden includes proof that the defendant had the ability and …

The United Kingdom Bill Of Rights 1998: The Modernisation Of Rights In The Old World, Clive Walker, Russell L. Weaver

University of Michigan Journal of Law Reform

Into a steadfastly conservative constitutional landscape, the United Kingdom Parliament has now introduced a Bill of Rights, the Human Rights Act of 1998, which takes effect in October 2000. The Act provides for a full catalogue of civil and political rights which are enforceable by the courts. This development raises two questions in evaluating the future of English law. First, does this signify the dawn of a new British radicalism? And second, why has it happened now? In answering these questions in relation to England and Wales, Part I of this Article provides an introduction to the traditional treatment of …

The Impact Of Individual, Organizational, And Environmental Attributes On Voluntary Turnover Among Juvenile Correctional Staff Members, Ojmarrh Mitchell, Doris Layton Mackenzie, Gaylene Armstrong, Angela Gover

Criminology and Criminal Justice Faculty Publications

In this study we assessed the impact of individual employee characteristics, organizational attributes, and quality of the correctional environment on the turnover intentions of juvenile correctional staff members. Both individual characteristics and organizational attributes were significant predictors of turnover intentions. The individual characteristics were age, race, and education; the organizational variables were job satisfaction, stress, and staff support and communication. In general, the organizational attributes were stronger predictors of turnover. Only one variable pertaining to the quality of correctional environment, facility's amount of care toward juveniles, was significantly related to turnover. In contrast to findings of previous research, dangerousness, gender, …

Not-So-Candid Camera, Please: Law Enforcement Officers Violate The Fourth Amendment When The Media Tags Along , Lynn S. Brackman Jun 2000

Not-So-Candid Camera, Please: Law Enforcement Officers Violate The Fourth Amendment When The Media Tags Along , Lynn S. Brackman

Missouri Law Review

The proliferation of television shows such as "Cops" evidences how common it has become for members of the media to accompany law enforcement officers while they perform their daily duties. This recent proliferation has sparked questions as to when the media's involvement in law enforcement impinges on an individual's constitutional rights. The federal courts of appeals have disagreed over whether the Fourth Amendment is violated when the media tags along with law enforcement officers executing a warrant in a private home. In Wilson v. Layne and Hanlon v. Berger, the United States Supreme Court settled the debate over this issue …
