Legislation By Assembly, Jeremy Waldron Jan 2000

Legislation By Assembly, Jeremy Waldron

Faculty Articles

Political scientists often remind us that real legislative power is vested in a much smaller number of people than the full membership of Parliament or the full membership of Congress. They emphasize the power of the executive in Westminster-style systems, under which the parliament very seldom fails to enact any bill proposed by the executive and very seldom enacts any bill not proposed by the executive. Or, in American legislatures, political scientists point to the power of committees as the effective legislative power. This might suggest' that the disparity of numbers to which I have called your attention is more …

Housing Discrimination And Economic Opportunity In The Chicago Region, Center For Urban Research And Learning, Michael Leachman, Philip Nyden Jan 2000

Housing Discrimination And Economic Opportunity In The Chicago Region, Center For Urban Research And Learning, Michael Leachman, Philip Nyden

Center for Urban Research and Learning: Publications and Other Works

In 1990, the Human Relations Foundation of Chicago was created in response to a publication called Report on Race, Ethnic and Religious Tensions in Chicago, released by the Chicago Community Trust Human Relations Task Force in 1989. The human relations task force released recommendations for the creation of a foundation to energize efforts to combat racism. The Human Relations Foundation of Chicago implements the recommendations of the task force's report, targeting Chicago leadership by concentrating on issues related to, but not limited to, housing, education, religion, media, government and business.

Continued racial and ethnic segregation has continuing implications for the …

A Need To Know Basis: Record Keeping, Information Access, And The Uniform Status Of Children Of Assisted Conception Act, Amy Shelf Jan 2000

A Need To Know Basis: Record Keeping, Information Access, And The Uniform Status Of Children Of Assisted Conception Act, Amy Shelf

UC Law Journal

This note examines the delicate legal issues surrounding recent medical advances in reproductive technology, which have dramatically transformed the way humans reproduce. The ability to manipulate fertility raises difficult ethical issues, particularly when embryo and gametes donors choose to remain anonymous. The note addresses the current legal system's unsuccessful attempts at dealing with requests for information made by the offspring created through these new methods. The author analyzes the Uniform Status of Children of Assisted Conception Act, and, while agreeing with the Act's goal of putting the rights of children to the fore, also notes its failure to address record-keeping …

Re-Orienting Law And Sexuality , Ratna Kapur, Tayyab Mahmud Jan 2000

Re-Orienting Law And Sexuality , Ratna Kapur, Tayyab Mahmud

Cleveland State Law Review

This symposium issue of the Cleveland State Law Review emerges from the Reorienting Law and Sexuality Conference hosted by Cleveland-Marshall College of Law in October 1999. The symposium locates itself as a continuation of the discourse that surfaced in the American legal academy in 1979 with a symposium issue of the Hastings Law Review. It is a discourse that brings into sharp relief technologies of power and strategies of resistance that contend at all sites where law aims to regulate human sexuality. While the initiative of 1979 was further cultivated by other forums of knowledge production within the American legal …

A Child Conceived After His Father's Death: Posthumous Reproduction And Inheritance Rights - An Analysis Of Ohio Statutes, Cindy L. Steeb Jan 2000

A Child Conceived After His Father's Death: Posthumous Reproduction And Inheritance Rights - An Analysis Of Ohio Statutes, Cindy L. Steeb

Cleveland State Law Review

This Article will argue that the posthumous child and the rights and responsibilities relating to such a child, are directly related to the fundamental right to procreate, thus statutes must support rather than prohibit posthumous conception. It will argue that legislation must necessarily incorporate that right in determining issues and forming legislation related to the posthumous child. It will show that current legislation, both the various Uniform Codes and Ohio's Revised Code, is not sufficient to protect and provide for this new class of children. In reaching this conclusion, Part II of this Article will review the history of artificial …

Etnografía De Trabajadores Informales En Un Barrio De Inmigrantes Mexicanos En El Silicon Valley, Christian Zlolniski Jan 2000

Etnografía De Trabajadores Informales En Un Barrio De Inmigrantes Mexicanos En El Silicon Valley, Christian Zlolniski

Sociology & Anthropology Faculty Publications - Archive

This article describes a set of informal activities engaged in by Mexican immigrants in a poor district of San Jose, California. Based on ethnographic field research, the study posits that the informal economy in Mexican immigrant communities does not constitute a labor niche of subsistence activities for workers excluded from the formal sector, or a set of jobs generated by an ethnic economy. On the contrary, it serves as a complement to the income generated by unqualified work in the formal sector, in which most workers are inserted, while in other cases, it represents an advantageous alternative form of work. …

Preserving Indigenous Paradigms In An Age Of Globalization: Pragmatic Strategies For The Development Of Clinical Legal Aid In China, Michael William Dowdle Jan 2000

Preserving Indigenous Paradigms In An Age Of Globalization: Pragmatic Strategies For The Development Of Clinical Legal Aid In China, Michael William Dowdle

Fordham International Law Journal

This Essay uses the experiences of international efforts to promote clinical legal aid in China to explore one such unexpected consequence of globalization: international assistance's understandable focus on more familiar kinds of legal aid institutions and activities can unintentionally impede the development of indigenous legal aid practices and institutions that might ultimately be better suited for the particular domestic environment. Part I of this essay will discuss international efforts to promote clinical legal aid in China, Part II will discuss reductive strategies for promoting legal development and the problems they present, Part III will discuss pragmatic strategies for promoting legal …

Women And Poverty, Carlos Ani Jan 2000

Women And Poverty, Carlos Ani

Trotter Review

The issue regarding relationships between the status of women, economic health for all people, and social justice is a challenge in every society today. Until fairly recently, poverty and under development were assumed to put all members of affected households - men, women, and children - at an equal disadvantage. "Households" were regarded as static entities where labor and resources are pooled and equally shared. The implicit conclusion was that changes thought of as beneficial for development would be neutral in their effects on the different members of the households. Empirical evidence reveals, however, that the costs and benefits of …

Kenyan Women And The Harambee: Community Development Or Unpaid Work?, Anne Gathuo Jan 2000

Kenyan Women And The Harambee: Community Development Or Unpaid Work?, Anne Gathuo

Trotter Review

Since gaining independence from Britain in 1963, the Kenyan government has encouraged self-help activity, known as "harambee" which is aimed at supplementing government efforts in the provision of social services. The term harambee conjures positive images of community spirit and people pooling together for a common cause. Indeed, the term is synonymous to community development. The United Nations Report on Community Development and Economic Development defines community development as the process by which the efforts of the people themselves are combined with those of government authorities to improve the economic, social and cultural conditions of communities, to integrate these communities …

Responding To Poverty Through Community Development: The Role Of Women In South Africa, Junette Davids Jan 2000

Responding To Poverty Through Community Development: The Role Of Women In South Africa, Junette Davids

Trotter Review

The World Bank reported that during the past three decades the developing world has made enormous economic progress. This is illustrated in the rising trend for incomes and consumption: between 1965 and 1985 consumption per capita in the developing world went up by almost 70%. Midgley, also reported that developing countries have recorded high rates of economic growth, achieved high degrees of industrialization and made significant social progress. Given this scenario one would assume that poverty has also decreased markedly. However, even though some developing countries have recorded high rates of economic growth, achieved high degrees of industrialization, and made …

Business Ownership Patterns Among Black, Latina, And Asian Women In Massachusetts, Russell E. Williams

Trotter Review

Using data from the most recently released Survey of Minority Businesses, this article explores the significance of businesses owned by minority women in Massachusetts. I describe the number of such businesses, the rates at which the number of such businesses are expanding, and the average sales and receipts of women-owned businesses — and I compare these statistics for White, Black, Latino and Asian businesses.

The Meaning Of Black Entrepreneurship In Constructing Community, Stacey Sutton Jan 2000

The Meaning Of Black Entrepreneurship In Constructing Community, Stacey Sutton

Trotter Review

The small business sector in the United States has traditionally been viewed as a strong source of economic growth and prosperity, as entrepreneurship epitomizes the quintessential American fantasy of rugged individualism. Given the myths about larger-than-life entrepreneurial heroes, business development has historically been touted as a viable trajectory toward economic and social mobility for immigrant groups and marginalized people. Stories about "great" American businessmen such as John D. Rockefeller, Bill Gates, Steve Jobs among others, often highlight rags-to-riches myths about innumerable possibilities within American capitalism given diligence, fierce competition, and an uncompromising work ethic. The work values of small business …

Women Creating Social Capital And Social Change, Marilyn Gittell, Isolda Ortega-Bustamante, Tracey Steffy Jan 2000

Women Creating Social Capital And Social Change, Marilyn Gittell, Isolda Ortega-Bustamante, Tracey Steffy

Trotter Review

As Community Development Organizations (CDOs) are the primary vehicle for development in low-income neighborhoods, scholars have begun to examine them in terms of the degree to which they increase citizen participation, increase civic capacity, as well as stabilize and revitalize neighborhoods through the creation of social capital. According to Putnam, civic action requires the existence of social capital; he defines social capital as "norms, trust, and networks." As Gittell and Vidal note, there has been a "virtual industry of interest and action created around the implication of Putnam's findings for the development of low-income communities."

This article is an excerpt …

Democratic Economic Participation And Humane Urban Development, Jessica Gordon-Nembhard Jan 2000

Democratic Economic Participation And Humane Urban Development, Jessica Gordon-Nembhard

Trotter Review

Humane economics, democratic economic participation, and democratic economic control are words not often combined and terms rarely used by traditional economic developers and urban planners, especially when addressing inner-city redevelopment. Most often, discussions about economic development and the elimination of poverty focus on job creation, workforce development, and access to job opportunities - promoting the corporate model of growth and fortifying big business's penetration into and control of community economics. Income receives a bit of attention, in the peripheral discussions about "living wages' or family-supporting wages and "good" jobs. However, concepts such as a guaranteed income or payment for the …

But Why Not Marriage: Some Thoughts On Vermont’S Civil Unions Law, Same-Sex Marriage, And Separate But (Un)Equal, Barbara Cox

Faculty Scholarship

This article is divided into three sections. Section one considers the positive results from the civil unions law. It recognizes that this legislation represents an important step along the path toward full recognition of same-sex couples by extending significant rights, benefits, and responsibilities beyond opposite-sex marriage." With these benefits, however, come several problems. Section two places the civil unions law along side other examples of "separate but equal" restrictions in the race and sex contexts and considers it within the sexual orientation context. This section explains how government-sponsored segregation has always caused damage to both groups that are taught they …

The Journal of Sociology & Social Welfare

This paper reports findings of a national study of low-income coresident grandmothers and grandchildren between 1967 and 1992. A small increasing minority of women was found to reside with their grandchildren in low-income families over the study period, although the proportion of those who did declined as they reached retirement age. More than half of ever coresident low-income grandmothers (N = 776) were second-generation parents for three or more years. The majority (64 percent) was Black.

Among ever coresident low-income grandmothers in 1992 (N = 521), being Black and being single increased the likelihood of being a secondgeneration parent. Previous …

Corporations Practicing Law Through Lawyers: Why The Unauthorized Practice Of Law Doctrine Should Not Apply, Grace M. Giesel Jan 2000

Corporations Practicing Law Through Lawyers: Why The Unauthorized Practice Of Law Doctrine Should Not Apply, Grace M. Giesel

Missouri Law Review

Historically, a doctrine has existed within the area of unauthorized practice of law regulation which holds that a corporation or other entity cannot be licensed to practice law and thus cannot legally practice law. Even if the entity hires as an employee an attorney duly licensed to render the service, the doctrine forbids the attomey from representing any party other than the employer because if the attorney were to represent a third party, the entity, a nonlawyer, would be representing the third party, and this would violate the rule that corporations may not practice law.2 The primary motivating rationale of …

Respecting Your Elders: The Highly Marketable Skills Standard For Social Security Disability Claimants Over Age Sixty, Thomas G. Pirmantgen

Missouri Law Review

As individuals age, they may face barriers to obtaining employment that did not exist for them when they were younger. Age thus may become a factor in any assessment of the likelihood that persons will successfully find new work. For Social Security disability benefits claimants under age fifty, age is generally not considered to present an obstacle to adjusting to new employment contexts. However, for claimants over age fifty, age is acknowledged as a factor that may significantly impact their ability to adjust to new work

The Changing Structure Of The Homeless Population In Cork City: Implications For Theories Of Homelessness And Service Provision, Michelle Norris, Noreen Kearns

Irish Journal of Applied Social Studies

The last two decades have seen extensive reform of policy on homelessness in Ireland, but these changes have not been underpinned by any extensive research which would shed light on the causes of homelessness and help in the design of settlement services. This article, which describes the results of the first detailed survey of the homeless population of Cork city, is intended to address the dearth of empirical evidence on homelessness in Ireland. This information is presented in three parts. The opening section of this article outlines the methods which were used to collect data on the homeless population in …
