The Second Amendment: Structure, History, And Constitutional Change, David S. Yassky Dec 2000

The Second Amendment: Structure, History, And Constitutional Change, David S. Yassky

Elisabeth Haub School of Law Faculty Publications

Part I of the Article engages the revisionists squarely on the turf they have staked out: the intent of those who framed and ratified the Second Amendment. Here I credit the revisionists with some important insights. Their research reminds us how greatly the world in which the Second Amendment was adopted differed from our own. This perspective helps us understand how the Founders could have placed the right to bear arms on par with the right to free speech--a decision that baffles many modern Americans. Yet while the revisionists correctly perceive that the right to keep and bear arms was …

The Japanese Law On Communications Interception During Criminal Investigatons: Translator's Introduction, Yohei Suda Dec 2000

The Japanese Law On Communications Interception During Criminal Investigatons: Translator's Introduction, Yohei Suda

Washington International Law Journal

Japan enacted the Law on Communications Interception During Criminal Investigations last year to help control organized crime. The legislation is, in part, a reaction to domestic and international pressure that grew from recent, well-publicized crimes such as the Aur Shinrikyo attack on a Tokyo subway. The Interception Law is a powerful tool for Japanese law enforcement, however the question of whether the Interception Law violates Japan's constitutional rights to privacy and secrecy of communication has not yet been resolved.

Performance Comparison Of A Roundabout Versus Two-Way Stop Controlled (Twsc) Intersections, Deogratias Eustace Dec 2000

Performance Comparison Of A Roundabout Versus Two-Way Stop Controlled (Twsc) Intersections, Deogratias Eustace

Civil and Environmental Engineering and Engineering Mechanics Faculty Publications

The superior safety record of modern roundabouts is well known in Western Europe, Australia and in most British-influenced countries around the world. The experience from a single modern roundabout installed in the City of Manhattan, Kansas, some three years ago, also shares the same experience. A major study of the performance of Manhattan, Kansas, modern roundabout was conducted at Kansas State University (KSU) and was co-sponsored by Mac-Blackwell National Rural Transportation Study Center, Kansas State University, and the City of Manhattan. The study examined three intersections, one modern roundabout and two Two-Way Stop Controlled (TWSC) intersections with similar traffic conditions. …

A Reflection On Examinations As An Assessment Of Student Performance, Chiu-Yin Kwan.Ph.D Dec 2000

A Reflection On Examinations As An Assessment Of Student Performance, Chiu-Yin Kwan.Ph.D

Journal of Medical Education

Examinations and tests have traditionally been the primary if not the sole yardstick in measuring student performance in educational institutes ranging from elementary schools to universities. Medical schools in the Asian-Pacific region are no exception to this. In fact, it may not be an over-exaggeration to state that examinations, to some students, can seemingly be a matter of life and death. The author illustrates the commonly perceived flaws of conventional examinations through the telling of a true story of Doris, a medical student in Hong Kong, victimized by the competitiveness of conventional examinations, If not for the author's early detection …

C. Vann Woodward's Exceptionalism, Morgan Knull Dec 2000

C. Vann Woodward's Exceptionalism, Morgan Knull

Civil War Book Review

Although the Civil War is a topic that historian C. Vann Woodward directly addressed only in late life, with the publication of Mary Chesnut's Civil War (Yale University Press, $21.00, ISBN 0300029799), it had long proven formative to his historical consciousness. The grandson of an Arkansas....

Abraham Lincoln, Christianity, And Civil Religion, Harold Holzer Dec 2000

Abraham Lincoln, Christianity, And Civil Religion, Harold Holzer

Civil War Book Review

Allen C. Guelzo's new book fills a distinct void in modern Lincoln literature: it is an authoritative and rewarding study of Lincoln's evolving relationship to God and to ideas. And while the character who emerges may be a less-than-great Emancipator, he is also a greater-than-ever Unionist, and a f....

Conrad's Chapbook: Sacred Duty Drew An Artist Home From Old Rome', John M. Coski

Civil War Book Review

A wartime memoir by Conrad Wise Chapman, the most important soldier-artist of the Confederacy, represents a potential bounty for historians. Unfortunately, the memoir covers only one year and does not include Chapman's service in Virginia or in South Carolina, where hedocumented with paintings Charl....

Duty First: Robert Gould Shaw In His Own Words And His Biographer's, James D. Hardy Jr.

Civil War Book Review

On May 28, 1863, the 54th Massachusetts Infantry (Colored) paraded through Boston on its way to the seat of war. It marched to the Common and the reviewing stands and passed "through the streets of Boston and into glory," as Duncan comments in his biography of Colonel Robert Gould Shaw. Frederick Do....

Civil War Book Review

Only Connect: Railroad Development And Race In The Confederate Corridor, Loren Schweninger

Civil War Book Review

The scholarship on the middle period of the 19th century in the South has prolifer-ated to such an extent over the past few decades, that it seems almost impossible to offer a new and fresh interpretation of events, whether they are political, social, economic, or racial. Scott Reynolds Nelson has d....

The Arousal Of Passions: Mob Rhetoric As An Antebellum Political Device, Andrew Burstein Dec 2000

The Arousal Of Passions: Mob Rhetoric As An Antebellum Political Device, Andrew Burstein

Civil War Book Review

The Dominion of Voice is an intelligent study in the character of democratic politics before the Civil War, challenging the ideal that reasoned argument is the healthiest means to resolve political conflict. The underlying issue in the book is anti-slavery. Instead of viewing passion as an un....
