Emerging Issues In The Use Of Binding Arbitration To Resolve Disputes Between Individuals And Health Plans, Karl Polzer Nov 2000

Emerging Issues In The Use Of Binding Arbitration To Resolve Disputes Between Individuals And Health Plans, Karl Polzer

National Health Policy Forum

After briefly describing the federal legal framework fostering the growth of binding arbitration, this paper identifies controversies surrounding arbitration as well as arguments supporting and opposing its use. The paper describes the use of arbitration among certain types of collectively bargained employee health plans regulated under the Employee Retirement Income Security Act of 1974 (ERISA), by health maintenance organizations (HMOs) in California, and by a large employer operating a self-insured ERISA health plan. Evidence cited by the California Supreme Court that the largest HMO in California operated its mandatory arbitration program in an unfair way is presented, along with the …

Medicare, Managed Care, And Behavioral Health Care, Sara J. Rosenbaum, Barbara Markham Smith Nov 2000

Medicare, Managed Care, And Behavioral Health Care, Sara J. Rosenbaum, Barbara Markham Smith

Health Policy and Management Issue Briefs

This issue brief examines Medicare and managed care for Medicare beneficiaries with behavioral health needs. Although only a relatively small proportion of Medicare beneficiaries are enrolled in managed care arrangements at the present time, proposals to expand the use of Medicare managed care can be expected to receive a good deal of attention in the coming years as part of a larger debate over Medicare's long term future. Thus, this issue brief examines the Medicare+Choice (M+C) program from the perspective of Medicare beneficiaries with mental illness and addiction disorders.

Runoff And Soil Loss As Affected By The Application Of Manure, John E. Gilley, L. Mark Risse Nov 2000

Runoff And Soil Loss As Affected By The Application Of Manure, John E. Gilley, L. Mark Risse

Department of Agricultural and Biological Systems Engineering: Faculty Publications

Manure has been used effectively to improve crop production and soil properties because it contains nutrients and organic matter. While it is generally accepted that the improved soil properties associated with manure application lead to changes in runoff and soil erosion, few studies have quantified these impacts. Water quality models used to assess watershed management and estimate total maximum daily load must accurately predict loading rates from fields where manure has been applied. This study was conducted to assemble and summarize information quantifying the effects of manure application on runoff and soil loss resulting from natural precipitation events, and to …

Managing The State Of Readiness Of Army Paratroopers In Malaysia, Lim Kiat Choy Nov 2000

Managing The State Of Readiness Of Army Paratroopers In Malaysia, Lim Kiat Choy

Student Works (2000-2009)

The parachute force of the Malaysian Army was formed less than a decade ago to provide the Armed Forces with the elements of "reach" and "responsiveness". "Reach" because they can be deployed swiftly by air and engaging in tactical air landed operations (TALO). "Responsiveness" because they are always held at a high state of readiness. Hence, expectations on the paratroopers are high and the Army depends on such forces to ensure that its overall mission is accomplished. This study attempts to measure the attitudinal profile of the currentparatroopers in the Malaysian Army and to compare their combat behaviourwith those from …

Must We Talk About That Reasonable Accommodation--The Eighth Circuit Says Yes, But Is The Answer Reasonable , Jill S. Kingsbury Nov 2000

Must We Talk About That Reasonable Accommodation--The Eighth Circuit Says Yes, But Is The Answer Reasonable , Jill S. Kingsbury

Missouri Law Review

The Americans with Disabilities Act (ADA) has been hailed by advocates for persons with disabilities as the most important civil rights act passed since 1964, and as the “Emancipation Proclamation” for Americans with disabilities. Critics of the ADA “cast the law as overly broad, difficult to interpret, inefficient, and as a preferential treatment initiative.” Other question whether the law’s economic benefits outweigh its administrative costs. Empirical data also suggests that “the ADA’s track record in improving employment opportunities for individuals with disabilities appears dismal.” Aggravating the problem, and contrary to the media’s portrayal of the ADA as a windfall statute …

Has Wright Line Gone Wrong--Why Pretext Can Be Sufficient To Prove Discrimination Under The National Labor Relations Act, Michael J. Hayes Nov 2000

Has Wright Line Gone Wrong--Why Pretext Can Be Sufficient To Prove Discrimination Under The National Labor Relations Act, Michael J. Hayes

Missouri Law Review

Every year in the United States, thousands of employees are illegally fired for joining or supporting unions. These employees must bring their claims to the National Labor Relations Board (the “Board”), which applies its famous Wright Line standard to decide thousands of discrimination cases each year. Probably the most common issue in labor discrimination cases is “pretext.” In virtually every case, an employer claims that it fired an employee not for an illegal antiunion motive, but for a legitimate business reason. The pretext issue arises when the evidence shows that the legitimate reason asserted by the employer was most likely …

Dispositifs D’Interverrouillage : Autorisation De L’Ouverture Du Protecteur, Réal Bourbonnière

Vulgarisation

The Use Of Uniaxial And Triaxial Accelerometers To Measure Children's "Free-Play" Physical Activity, Alise E. Ott, Russell R. Pate, Stewart G. Trost, Dianne S. Ward, Ruth P. Saunders Nov 2000

The Use Of Uniaxial And Triaxial Accelerometers To Measure Children's "Free-Play" Physical Activity, Alise E. Ott, Russell R. Pate, Stewart G. Trost, Dianne S. Ward, Ruth P. Saunders

Faculty Publications

In order to effectively measure the physical activity of children, objective monitoring devices must be able to quantify the intermittent and nonlinear movement of free play. The purpose of this study was to investigate the validity of the Computer Science and Applications (CSA) uniaxial accelerometer and the TriTrac-R3D triaxial accelerometer with respect to their ability to measure 8 "free-play" activities of different intensity. The activities ranged from light to very vigorous in intensity and included activities such as throwing and catching, hopscotch, and basketball. Twenty-eight children, ages 9 to 11, wore a CSA and a heart rate monitor while performing …

The Influence Of Leaf Shape Of Passiflora Biflora In Heliconius Spp. Butterfly Oviposition, November 2000, Sarah M. Dempsey Nov 2000

The Influence Of Leaf Shape Of Passiflora Biflora In Heliconius Spp. Butterfly Oviposition, November 2000, Sarah M. Dempsey

Monteverde Institute: Tropical Ecology and Conservation

Between species the leaf morphology of Passiflora (Passifloraceae) differ greatly in leaf shape. These differences may be attributed to the presence of Heliconius larvae, who feed exclusively on Passiflora. Adult females may use leaf shape as an oviposition cue, thus the importance of the changing leaf morphology. This study was conducted in an enclosure in the Monteverde Butterfly Garden where I studied three species of Heliconius butterflies: Heliconius hecale, H. charitonius and H. erato. I studied the oviposition behavior on Passiflora biflora due to the varying leaf shapes present, which are two and three lobed leaves. Egg placement showed that …

CUP Faculty Research

The N-terminal DNA-binding domain of the multidrug transporter activation protein (MtaN) was crystallized by the hanging-drop vapour-diffusion method using lithium chloride as a precipitant. The crystals are orthorhombic and belong to the space group I212121, with unit-cell parameters a = 49.4, b = 67.8, c = 115.0 Å. Diffraction data have been collected at 100 K to 2.75 Å resolution at a synchrotron-radiation source.
