To Donate Or Not To Donate Your Organs: Texas Can Decide For You When You Cannot Decide For Yourself, Jennifer Rutherford-Mcclure

Texas Wesleyan Law Review

Part I of this comment illustrates the historical background of the organ shortage. Part II discusses the response of the federal government, other states, and other countries to the organ shortage. Part III discusses Texas's response to the organ shortage and Texas's version of the Uniform Anatomical Gift Act. It also discusses why Texas should repeal section 521.405 of the Texas Transportation Code and provides alternative methods of procuring organs for transplantation other than the aforementioned statute. This comment is not meant to sway anyone from organ donationquite the contrary. The purpose of this note is to illustrate the importance …

Death Penalty: Texas Law - Subsequent Writs And Abuse Of The Writ Doctrine In Texas, Charles M. Mallin

Texas Wesleyan Law Review

The purpose and scope of this paper is to introduce the practitioner to the concept of the "abuse-of-writ" doctrine as made applicable to death penalty habeas litigation via the recent enactment of article 11.071, section 5(a) of the Texas Code of Criminal Procedure.' It is generally pertinent in the context of serial or subsequent writ filings by the applicant. It is hoped that this article will help guide both the State's and defendant's habeas attorney through the various intricacies of the subsequent application for a writ of habeas corpus in death penalty litigation. Part I of this article examines the …

Redefining Trademark Alteration Within The Context Of Aesthetic-Based Zoning Laws: A Blockbuster Dilemma, Jeffrey W. Strouse Mar 2000

Redefining Trademark Alteration Within The Context Of Aesthetic-Based Zoning Laws: A Blockbuster Dilemma, Jeffrey W. Strouse

Vanderbilt Law Review

In 1978, a Nevada Federal District Court permitted the Nevada Real Estate Advisory Commission to regulate the registered service mark' of Century 21, a national franchisor of real estate brokerage firms.' Prior to this state regulation, Century 21's mark occupied approximately 80 percent of the surface area of any given display, while the name of the local franchisee covered the remaining 20 percent. To prevent consumer confusion," the Commission required that the 80:20 ratio be changed to a 50:50 ratio, effectively making the franchisee's logo as large as its counterpart. Century 21 objected to this mandate, arguing in part that …

Georgia State University Law Review

The Act allows the Department of Natural Resources (DNR) to issue permits to trap, transport and release, or kill wildlife and feral hogs when such action is otherwise prohibited by law. The law allows removal of white-tailed deer from airport property, only in the interest of public safety. With respect to fur-bearing animals, the DNR must approve and implement a bona fide wildlife management plan, and with respect to feral hogs, DNR-approved activities must comply with the Georgia Department of Agriculture's rules and regulations. The DNR must prescribe all methods and details of animal control. Furthermore, the DNR cannot issue …

Making Government Pay: Markets, Politics, And The Allocation Of Constitutional Costs, Daryl J. Levinson Mar 2000

Making Government Pay: Markets, Politics, And The Allocation Of Constitutional Costs, Daryl J. Levinson

University of Chicago Law Review

Instrumental analysis of private law damage remedies assumes rational economic actors in a market environment. A privately owned factory forced by the tort system to pay $1000 in pollution costs suffered by a downstream neighbor will continue to pollute if, and only if, the private benefits of its pollution-producing activity exceed $1000. At least within the law and economics paradigm, we can safely take for granted the rather strong assumptions upon which this analysis rests. No one doubts, for example, that a profit-maximizing firm will tend to ignore social costs that are not reflected in financial outflows, or that it …

The United States And Colombia: Untying The Gordian Knot, David Passage Ambassador Mar 2000

The United States And Colombia: Untying The Gordian Knot, David Passage Ambassador

Books, Monographs & Collaborative Studies

Twenty-five years after the end of the Vietnam War, the ghost of that war still haunts the corridors of the decision makers when it comes to making long-term commitments to situations that remotely resemble anything like our Indochina experience. That is the case in with Colombia, which is embroiled in an internecine struggle with two guerrilla movements bent on overthrowing the government as well as from narcotraffickers. The author details the complicated but increasingly clear nexus between the political and social insurgencies and the drug traffickers. This, he maintains, has obliged a highly reluctant United States to reexamine whether its …
