Dna Fingerprinting - Justifying The Special Need For The Fourth Amendment's Intrusion Into The Zone Of Privacy, Deborah F. Barfield

The Fourth Amendment prohibits the government from conducting unreasonable searches and seizures.When claims arise against the government's Fourth Amendment transgressions, usually those claims turn on interpretation of the term "reasonable." Traditionally, a search and seizure conducted under the authority of a judicial warrant for "probable cause" is unquestionably reasonable.In some, albeit very limited, types of searches reasonableness is met with at least "individualized suspicion."When searches intrude into the human body, however, they implicate a person's most deep-rooted expectation of privacy - the right to be left alone.

The service life of highway bridges is limited by the deterioration of their substructure components. In the U.S., it is estimated that more than 240,000 (about 40%) of the highway bridges are functionally or structurally deficient. Repairing these deteriorated bridges using traditional methods is usually time-consuming and expensive. Furthermore, these methods are such that they can cause a number of problems, such as being a threat to public safety and severe traffic disruption. Thus, it is important that new safer and more efficient methods be developed. Fiber Reinforced Plastics (FRP) have a great potential to provide such a solution. Due …

The Westrail Midland Workshops had serviced the Western Australian Government Railway fleet for 90 years when they were closed by the Court Government in 1994. As the State's largest and best equipped industrial establishment employing over 900 workers, the announcement of the closure was unexpected and controversial. The research questions asked in this thesis are: Why did the Workshops close? What were the economic and political issues involved? Prosecutorial Discretion And Prosecution Guidelines: A Case Study In Controlling Federalization, Michael A. Simons

In this Article Michael Simons examines the ways in which the federalization of crime can be controlled. Simons argues that prosecutorial discretion is the most important variable in the federalization process and that controlling prosecutorial discretion is the key to controlling federalization. He presents the Child Support Recovery Act as a model for how prosecution guidelines for federal criminal statutes can provide such control Federalization of criminal child support enforcement has been successful because federal prosecutors have exercised discretion in a manner consistent with the concerns expressed by the bench and the academy about federalization. Their Promises Of Paradise: Will Olmstead V. L.C. Resuscitate The Constitutional Least Restrictive Alternative Principle In Mental Disability Law, Michael L. Perlin

This article argues that the Supreme Court's decision in Olmstead v. L.C., 119 S. Ct. 2176 (1999), finding a qualified right to community treatment and services for certain institutionalized persons under the Americans with Disabilities Act (ADA) and endorsing an "integration mandate," forces us to reconsider the role of the "least restrictive alternative" in institutional mental disability law, and may serve to resuscitate and revitalize the constitutional foundations of that principle in this area of the law. Developments in Virginia construction law during the year 1999-2000 were more modest than those of 1998-1999. Still, several decisions by the Supreme Court of Virginia, the Virginia Court of Appeals, and the United States Court of Appeals for the Fourth Circuit justify the attention of those involved in the construction industry and its related legal practice. These cases address topics involving mechanic's lien waivers, the bar of sovereign immunity, recovery of direct and consequential damages, surety obligations, tortious interference with the bid process, and sanctions by the Virginia Board of Contractors. This study addresses the issue of whether the message content of variable message signs (VMS) can be used as a control variable to favorably influence traffic conditions in real-time. The focus is on the level of detail of information displayed on the VMS, and not human factor issues. It implies an understanding of driver sensitivity to information content. Also, for real-time implementation, the displayed information should be consistent, timely, and reliable. Government endorsed and government imposed religious persecution is a growing phenomenon worldwide. From Central America to the Far East, people are arrested, tortured, and even killed for having and expressing their faith, despite the existence of universal covenants expressing acceptance of religious differences as among the most basic of human rights. Seeing the apparent futility of U.N. and other international efforts to curb such persecution, the U.S. Congress in 1998 passed the International Religious Freedom Act. A widening variety of applications is diversifying geomorphometry (digital terrain modelling), the quantitative study of topography. An amalgam of earth science, mathematics, engineering and computer science, the discipline has been revolutionized by the computer manipulation of gridded terrain heights, or digital elevation models (DEMs). Its rapid expansion continues. This article reviews the remarkable diversity of recent morphometric work in 15 selected topics and discusses their significance and prospects. The quantitative analysis of industrial microsurface topography is introduced to the earth science community.
