The Power Of The Treasury: Racial Discrimination, Public Policy, And "Charity" In Contemporary Society, David A. Brennen

The Treasury Department is empowered to enforce “established public policy” with respect to tax-exempt charities. Under this public policy power, the Treasury has revoked the tax-exempt charitable status of organizations that discriminated against blacks, organizations whose members engaged in civil disobedience against war, and organizations involved in illegal activity. The Treasury interprets its public policy power as applying to any activity that violates clear public policy. Thus, presumably, the Treasury could use this power to deny tax-exempt charitable status to an organization that engages in conduct that violates assisted suicide laws, anti-abortion laws, or other sufficiently “established” public policies.

How do you modify laws that simultaneously exist as statutes and rules of court? For reasons that are described elsewhere and need not be repeated here, the Kentucky Rules of Evidence (K.R.E.) came into existence through concurrent enactment by the General Assembly and Kentucky Supreme Court and thus are endowed with all the attributes of both statutes and rules of court. Mental illness, in the context of severe and enduring mental illness, is a growing problem particularly among incarcerated individuals and is likely to have implications for the way mental health services are utilized in local jails, state prisons, and federal prisons. The goal of the current study was to determine a relationship between persons suffering from mental illness among individuals with a criminal background.
As the prison populations increase, so do the number of mentally ill individuals involved in the criminal justice system. Many criminals suffer from homelessness and health-related concerns (e.g., substance abuse, HIV infection), these individuals may alternate …

Effects Of Nonstandard Work Schedules On Marital Satisfaction Among Law Enforcement Officers, Annette Marie Jansen

The purpose of this study was to determine if there was a difference in level of marital satisfaction among police officers who worked standard hours (day shift) and those who worked nonstandard hours (afternoon/midnight shifts). Thirty police officers employed during standard hours, and 33 police officers employed during nonstandard hours were administered a demographic questionnaire and the Index of Marital Satisfaction Inventory. Scores were tabulated and it was concluded that there was not a significant difference in marital satisfaction among the two groups (t = -.483; p = .631).

The previous section reviewed the results of a survey that asked African American citizens of Nebraska their opinions on several issues and concerns facing Nebraska's AfricanAmerican community. This section uses these results to develop actions and recommendations in several areas: Youth Issues, Government Issues, Jobs and Economic Development, Criminal Justice, and Health. Because some of these areas overlap, actions and recommendations suggested for one area may also apply to another area.

The State of Black Nebraska 2000 is based on a survey sponsored by the Urban League of Nebraska and conducted by the Center for Public Affairs Research at the University of Nebraska at Omaha. The State of Black Nebraska Survey was conducted through telephone interviews with 474 adults from African-American households in Douglas, Sarpy, and Lancaster Counties. Together these three counties account for approximately 97 percent of the African-American population in Nebraska. Among the topics examined in the survey were ratings of the Omaha and Lincoln area's quality of life; problems to be addressed by the Urban League of Nebraska; …

Believing that volunteers are a powerful force for community improvement, whose efforts make the most of limited resources, the Mississippi Commission for Volunteer Service (MCVS) seeks to involve Mississippians to make a difference in every community in the state. As the state's official organization to promote community service and volunteerism, the MCVS invests in Mississippi communities by building public/private coalitions, linking communities and organizations to local and national resources, coordinating state resources for volunteers, and initiating volunteer programs to address unmet needs.

There is an ever growing body of criticism noting the homosocial underpinnings of comedia society in which women serve primarily to cement the relationships among men. Barbara Simerka, Harry Vélez de Quiñones, and others have convincingly begun to establish the homosocial nature of the stage society in which women, often as objects given signification only when they acquire exchange value, frequently have little say in their marriages or in other important aspects of their lives. One would be hard-pressed to identify a more extolled, and storied, aspect of the Anglo-American legal tradition than the writ of habeas corpus. Tracing its lineage back to the Magna Carta, the Great Writ was so revered by the Framers of the U.S Constitution that they expressly prohibited its suspension except in times of extreme governmental distress. Writing in 1868, Chief Justice Salmon Chase characterized habeas as "the most important human right in the Constitution," the ''best and only sufficient defense of personal freedom." Justice Brennan, writing almost one hundred years later, observed that the history of habeas "is …

The Continuing Tobacco War: State And Local Tobacco Control In Washington, Alan E. Scott

This Article examines Washington's exemplary tobacco control efforts in the context of the larger, historical struggle to regulate tobacco. The Article begins in Part II with a brief description of the history of tobacco regulation in the United States. Part III examines the Master Settlement Agreement and its weaknesses. Part IV discusses the preference for local government regulation and the obstacles encountered. Part V examines the scope of legal authority of Washington's local governments to enact tobacco control measures, and Part VI describes Washington's tobacco control measures and the interplay between local, state, and federal laws.
