The Evolving Police Power: Some Observations For A New Century, Glenn H. Reynolds, David B. Kopel

The conventional wisdom about the scope of state police powers goes like this: in the early days of the Republic, legitimate regulation existed only to prevent concrete harm to specified interests. Sometime around the previous turn of the century, the scope of state police powers expanded; states could regulate as they chose so long as they claimed to be working to promote the public safety, welfare, or morality. This article examines a number of recent state constitutional decisions having to do with sodomy, parenting, marriage, and procreation and argues that in deciding these cases the courts are returning to the …

Slippery When Wet: The Effects Of Local Alcohol Access Laws On Highway Safety, Reagan Anne Baughman, Michael Edward Conlin, Stacy Dickert-Conlin, John V. Pepper

This paper examines 237 instances of policy changes related to alcohol sales and consumption enacted in Texas communities between 1975 and 1996 to determine their effect on the incidence of alcohol-related motor vehicle accidents. These policies are categorized by location where the alcohol is consumed after sale (on the premises or off) and the type of alcohol available for consumption (beer and wine or hard liquor). After controlling for both county and year fixed effects, we find evidence that (i) the sale of alcohol for consumption on the premises (in bars and restaurants) is associated with a sizeable increase in …

Quartering Species: The Living Constitution, The Third Amendment, And The Endangered Species Act, Andrew P. Morriss, Richard L. Stroup

The authors argue that the fundamental flaw in the Endangered Species Act (ESA) is that it fails to force government decision makers to consider the opportunity cost of their actions, resulting in flawed decision making that imposes heavy costs on landowners without actually protecting endangered species. The authors develop this analysis through an examination of the ESA in light of the modern "living Constitution" theory of interpretation. They conclude that under this theory the ESA's "quartering of species" on private land violates the Third Amendment's ban on quartering soldiers.

Stopping Hate Without Stifling Speech: Re-Examining The Merits Of Hate Speech Codes On University Campuses, Catherine B. Johnson

This Note explores legislative attempts to help reduce incidents of hate speech on university campuses. It begins by analyzing the rise in hate speech codes at public universities and examining two U.S. Supreme Court decisions in R.A.V. v. City of St. Paul and Wisconsin v. Mitchell. The author argues that a hate speech code that implements forward-looking, long-term education objective would work towards stopping hate on campus without violating students' First Amendment rights. This Note reaches the conclusion that a narrowly drawn hate speech code based on recognized First Amendment exceptions, implemented along with with education initiatives, could facilitate the …

Our Drug Laws Have Failed - So Where Is The Desperately Needed Meaningful Reform?, David C. Leven

The article begins by stating that the harsh drug laws of New York have failed to have an effect on the amount of drug dealers and instead have led to overcrowding of prisons with non-addict drug users. It states that the laws must be modified to give greater sentencing to judges, increasing diversion of non-violent offenders to rehabilitation. The article then delineates the problems resulting from current drug law and the criticism thereof. It then states the attempted reforms of drug laws that have been insufficient. This essay cautions that the successes in crime reduction cannot be sustained unless police-community relations improve. The essay discusses progress and development in law enforcement, documents the innovative rise in community policing, and concludes with suggestions on how to improve police-community tension, particularly tension between law enforcement and minority communities.

Environmental anthropology seeks to identify issues and propose resolutions when humans are directly affected by environmental consequences or indirectly by policies that may marginalize the concerns of certain populations. Africanized Honey Bees created both environmental and policy consequences in southern Nevada. Identification of the issues was accomplished with literature review, participant observation, informal interview, and conferencing with academic and agency officials related to the human/bee problem. The controversy in risk assessment has implications for urban residents in southern Nevada. Both agricultural and urban environments may be economically and politically impacted by the colonization of feral Africanized Honey Bees. Urban populations …

The focus of this study was to investigate the relationship between violent criminal activity and alcohol abuse, and to further extend the knowledge about these phenomenon which currently appear in the literature. The association between these two variables has been asserted for many years, but few definitive correlations have been established using representative data. This study sought to determine if a statistical relationship exists between alcohol abuse rates of inmates serving time in Louisiana and their convictions for violent crimes.
