Integrating Spiritual Perspectives With The Law School Experience: An Essay And An Invitation, Lucia Ann Silecchia Jan 2000

Integrating Spiritual Perspectives With The Law School Experience: An Essay And An Invitation, Lucia Ann Silecchia

San Diego Law Review

This Essay will reflect on the ways in which the traditional life of law schools may be colored by a new emphasis on spirituality. 10 This Essay will not delve into an extensive theological thesis about the definition of spirituality or the practical and philosophical nuances of the spiritual life. Rather, the pages that follow are an invitation to begin a discussion of spirituality within the life of American law schools. This Essay begins with a discussion of spirituality in professional life generally. It will become apparent very quickly that there are difficulties in defining what spirituality is and in …

"Waive" Goodbye To Tort Liability: A Proposal To Remove Paternalism From Product Sales Transactions, Richard C. Ausness

San Diego Law Review

This Article argues that waivers of tort liability should be permitted in connection with product sales. Currently, sellers cannot limit their liability under tort law for personal injuries caused by defective products even though such waivers are allowed, albeit reluctantly, under principles of negligence and warranty law.

The Brandeis Legacy, Mary Murphy Schroeder Jan 2000

The Brandeis Legacy, Mary Murphy Schroeder

San Diego Law Review

Louis Brandeis was the greatest lawyer of the early twentieth century, and perhaps of the entire century. He was brilliant, driven, charismatic, and absolutely devoted to improving the lives of the common people of the United States. Put in more contemporary terms, he was committed to the notion that technological and economic advances should not widen the gap between the haves and the have-nots. His causes were the environment, citizenship, freedom of expression, quality of life in the workplace, protection against increasing power wielded by large corporations, and protection of individual privacy. All were issues that emerged at the beginning …

What We Do When We Do What We Do And Why We Do It, Leo Katz Jan 2000

What We Do When We Do What We Do And Why We Do It, Leo Katz

San Diego Law Review

But what exactly am I talking about when I speak of symmetry and asymmetry in law and ethics? It may be clear enough what those notions mean in geometry, but how are they to be understood in law, or

for that matter in ethics, more generally? Let me start with symmetry- its meaning and the benefits of exploring it. Rather than try to define the

term, however, I will offer what I think is a pretty self-explanatory example of the phenomenon as it arises in law and ethics. It is an example that has fascinated me for quite some time: …

Deontology At The Threshold, Larry Alexander Jan 2000

Deontology At The Threshold, Larry Alexander

San Diego Law Review

In his 1989 law review article, Torture and the Balance of Evils,' later republished as Chapter Seventeen in Placing Blame, Michael Moore declares himself to be a "threshold deontologist." What he means is this: There are some acts that are morally wrong despite producing a net positive balance of consequences; but if the positive balance of consequences becomes sufficiently great-especially if it does so by averting horrible consequences as opposed to merely making people quite well off-then one is morally permitted, and perhaps required, to engage in those acts that are otherwise morally prohibited. Thus, one may not kill or …

Losing Ground : Locational Formulations In Argumentation Over New Travellers, Rebecca Barnes Jan 2000

Losing Ground : Locational Formulations In Argumentation Over New Travellers, Rebecca Barnes

School of Psychology Theses

This thesis is an exercise in discursive psychology. The body of discourse analysed concerns the defence of rural space against New Travellers. In contrast to previous sociological and human geographical work in this area, instead of newspaper articles and Parliamentary discourse, participants' talk and texts are the starting point for the - investigation. The data corpora have been generated from a variety of sources: Focus group discussions with police officers; interviews with landowners (or their representatives); letters to the editors of local newspapers; and private letters of complaint to a local council. The thesis focuses on the participants' selection of …

Political changes in the former Soviet Union have allowed social scientists to explore a variety of family and child development issues that were closed to systematic investigation for many decades (Maddock, Hogan, Antonov, & Matskovsky, 1994). Prior Soviet psychological research focused on cognitive rather than socioemotional processes for political reasons (Kerig, 1996). Therefore, Western researchers had little opportunity to conduct research on children’s social development in the context of the family in the former Soviet Union.

The Role Of Intercultural Communication In Conflict Resolution Between African Immigrants And Their U.S.-Born Children, Aje-Ori Anna Agbese Jan 2000

The Role Of Intercultural Communication In Conflict Resolution Between African Immigrants And Their U.S.-Born Children, Aje-Ori Anna Agbese

Dissertations and Theses @ UNI

This research examines intercultural communication's role in resolving and managing conflicts between African immigrants and their U.S. -born children. Marriage and close family ties are the backbone of selection in U.S. immigration law. Over 90% of immigrants in the U.S. raise families within the host culture, making immigrant families an area worthy of study. Unfortunately, families are the least studied areas of immigration. Assumptions that immigrants assimilate completely into the host culture through intermarriage and raising children/families are being debunked. Recent studies on immigrants show that their ethnic cultural values are retained for many years, and passed on to children …

The Effect Of Color On A Controlled Accuracy Test, Kaori Araki Jan 2000

The Effect Of Color On A Controlled Accuracy Test, Kaori Araki

Dissertations and Theses @ UNI

Human behavior is influenced by the environment and color is one ever present factor in the environment. Consequently, the impact of color on performance cannot be ignored. Previous research on the effect of color on a fine motor skill has not been systematic and results are inconclusive. The purpose of the present study, then, was to examine the effect of color (green, blue, red, and white) on the performance of a controlled target accuracy task (dart throwing). Based on previous literature, it was hypothesized that color would have an effect on performance. The experiment took place in the Psychomotor Behavior …

The Effects Of Symbol Organization Strategy On Syntactical Language Production In First Grade Children, Daniel Thomas Baier Jan 2000

The Effects Of Symbol Organization Strategy On Syntactical Language Production In First Grade Children, Daniel Thomas Baier

Dissertations and Theses @ UNI

Augmentative and alternative communication (AAC) is the process in which a person's disordered speech is augmented or assisted with communication technology. This study investigated the effects of vocabulary organization using branching capabilities of a high technology device on sentence construction. Information about vocabulary organization strategies might be important for addressing the language and literacy deficits that were noted in previous research with AAC users. The study attempted to investigate whether or not vocabulary organization in a grammatical sequence across one page or multiple pages would improve non-AAC users abilities to retell a story using AAC technology. Six students participated in …

The sample consisted of 93 undergraduate students from the University of Northern Iowa (36 males, 57 females). Students completed questionnaires and were administered the WAIS-III short form individually. Males scored higher on the Arithmetic, Information, and Digit Span subtests and …

The Effects Of Computer Animations On Secondary Students’ Understanding Of The Crushing Can Chemical Demonstration, Resa Marie Kelly Jan 2000

The Effects Of Computer Animations On Secondary Students’ Understanding Of The Crushing Can Chemical Demonstration, Resa Marie Kelly

Dissertations and Theses @ UNI

Understanding chemistry requires the ability to think at three different levels: submicrochemistry, macrochemistry, and representational chemistry. Students often have difficulty making connections among these three areas due to the abstract nature of many chemistry concepts. The purpose of this paper is to investigate how computer animations affected secondary students' understanding of the Crushing Can Demonstration. This investigation compared two groups of chemistry students at a large, suburban high school. The treatment group viewed the animation after seeing and discussing the crushing can demonstration, while the control group received the same instruction as the treatment group but did not see the …

Supporting Survivors Of Sexual Assault: A Feminist Perspective, Geeta Cowlagi

Dissertations and Theses @ UNI

Sexual assault continues to be a serious problem in the United States and in Utah; one that exacts a heavy toll on the survivors as well as society in general. While the issue is an old one, there is still considerable debate around it. Indeed, the myths, misperceptions, and ignorance about the causes and effects of rape and sexual assault impede the recovery process for the survivors of sexual assault. The goal of this thesis is to support survivors of sexual assault in their recovery. The core of the thesis is a manual written for professionals who work with survivors …

Preservice Teachers’ Beliefs About Teaching And Learning, Helga M. Gudenschwager Jan 2000

Preservice Teachers’ Beliefs About Teaching And Learning, Helga M. Gudenschwager

Dissertations and Theses @ UNI

Research shows that knowing what preservice teachers believe about teaching and learning helps their instructors to reinforce those beliefs that are compatible with current approaches in education and challenge those that promote the perpetuation of antiquated and ineffective teaching practices. Four main research questions guided this study: 1. To what extent the beliefs expressed by participants aligned with traditional or constructivist perspectives? 2. Do elementary and secondary majors differ in terms of their preference for practices aligned with these perspectives? 3. Do elementary and secondary majors differ in terms of their beliefs about the goals of education and effective strategies …

A Survey Of Iowa High School Band Directors And Their Students On The Occurrences Of Performing On A Musical Instrument While Experiencing Pain, Crystal M. Franzen Halverson

Dissertations and Theses @ UNI

Learning to play a musical instrument is a challenging and exciting venture for many children. Lessons are the primary means for children to learn to play a musical instrument. Some begin studying an instrument through private lessons and others through a Suzuki program. Many other children begin their study of a musical instrument in the public school system with a music teacher in elementary, junior high, or middle school. Regardless of how one begins to learn to play a musical instrument, by the time high school is reached, it is conceivable that he or she will have had at least …

Findings indicate that prostitution is a highly victimogenic lifestyle, fostered by conditions of extreme deprivation. Policy and practice implications are discussed.

Working Memory And Human Reasoning : An Individual Differences Approach, Alison Jayne Capon Jan 2000

Working Memory And Human Reasoning : An Individual Differences Approach, Alison Jayne Capon

School of Psychology Theses

Experiments 1-3 investigated the relationship between working memory and syllogistic and five-ten-n series spatial inference. A secondary aim was to replicate the findings of Shah and Miyake (1996) who suggested the use of separate central resources of working memory for spatial and verbal ability. The correlational analysis showed that the complex verbal and spatial working memory span tasks were associated together and consistently predicted reasoning performance in both verbal and visual modalities. The confirmatory factor analysis showed that three factors best accounted for the data -a verbal, a spatial, and a general resource. All the span tasks and most of …

Claiming The Victim: Tokenism, Mourning, And The Future Of German Holocaust Poetry, Kathrin M. Bower Jan 2000

Claiming The Victim: Tokenism, Mourning, And The Future Of German Holocaust Poetry, Kathrin M. Bower

Languages, Literatures, and Cultures Faculty Publications

This excerpt from Nelly Sachs's poem "You Onlookers" could be read as support for the contention, reportedly made by Adolf Hitler during a table talk, that "The Jews invented conscience." This statement, although fascinating in itself for what it implies about Hitler's psyche and moral sense, becomes even more provocative if read in association with Marina Zwetajewa's puzzling proclamation, made famous by its appearance as an epigram to a poem by Paul Celan, that "all poets are Jews." The connection of Jews to both conscience and poetry has significant repercussions for the genre of so-called Holocaust lyric, so-called because it …
