Bolivar: "Killer" Elephant Or Abused Pachyderm?, Harold E. Lippman Jan 2000

Bolivar: "Killer" Elephant Or Abused Pachyderm?, Harold E. Lippman

Elephant

“Bolivar” was a male Asian elephant (Elephas maximus) which was presented to the Philadelphia Zoo in 1888 by Adam Forepaugh and lived there until 1908. Bolivar was known as a “killer” because he killed at least two men, one of whom offered the elephant a lighted end of a cigar and his trunk was badly burned. The man tried to repeat the “cute joke” and Bolivar grabbed him and crushed his skull. The elephant was kept in confinement, apparently in conditions which might best be described as “inhumane”. He died, according to postmortem pathological report, from arthritis, cardiac, hepatic and …

Absent Abstinence Accountability, Elizabeth Arndorfer Jan 2000

Absent Abstinence Accountability, Elizabeth Arndorfer

UC Law Constitutional Quarterly

Teenage sexual activity has important health and fiscal implications for the United States. In response to this, Congress has in the past increased federal funding for abstinence-only education programs. These federally funded abstinence-only education programs stress abstinence as the only viable option for teenagers and provide no information on other methods of contraception. Congress in the new term must decide whether to reauthorize funds for these abstinence-only programs. This Article reviews the history of how these abstinence-only programs acquired federal backing, the methods employed by these abstinence-only programs, and whether these abstinence- only programs are effective. This Article argues that …

Compositional Changes In Selected Minimally Processed Vegetables, Emer O'Reilly Jan 2000

Compositional Changes In Selected Minimally Processed Vegetables, Emer O'Reilly

Masters

Compositional, physiological and microbiological changes in selected minimally processed vegetables packaged under a modified atmosphere of 2% oxygen and 5% carbon dioxide were monitored over a ten day storage period at 40 C and 80 C. The analysis targeted specific changes in the nutritional, chemical and physiological make up of the vegetables as well as the changes in the microbial levels. In addition the changes in the gas atmospheres within the packs were monitored. It has been widely accepted that modified atmospheres used to package fresh produce can preserve the product quality and thus extend the shelf life of the …

The Impact Of Group Selection On Student Performance And Satisfaction, Sakthi Mahenthiran, Pamela J. Rouse

Scholarship and Professional Work - Business

Investigates whether the performance and attitudes of students could be improved by giving them some control over the group selection process. Groups were formed either by randomly combining paired friends or by randomly assigning all students. Students completed a group exercise and a group case. The dependent variables were the project grades and student satisfaction. Student satisfaction was measured using a questionnaire. The results show that attitudes of students were more positive when they were allowed to choose a single friend in the group. The project grades were significantly higher when students were paired, and this result was true regardless …

Princes Of Darkness And Angels Of Light: The Soul Of The American Lawyer, David R. Barnhizer Jan 2000

Princes Of Darkness And Angels Of Light: The Soul Of The American Lawyer, David R. Barnhizer

Law Faculty Articles and Essays

The increasing belief among many lawyers that life is comprised of "fear and greed and money" has altered the legal profession and helped make lawyers into one of the most feared and powerful groups in American society - and one of the most scorned. In the midst of the widespread contempt American society is showing lawyers, this article seeks to explain the special role the legal profession serves in our complex democracy. At the same time it condemns attitudes such as those reflected in Fritts' statement. The belief that life is driven by fear, greed, and money has created a …

The Unconstitutionality Of Eliminating Estate And Gift Taxes , James G. Wilson Jan 2000

The Unconstitutionality Of Eliminating Estate And Gift Taxes , James G. Wilson

Cleveland State Law Review

This article discusses why the recent proposal to eliminate estate and gift taxes is not only immoral and a poor allocation of resources, but also is unconstitutional. The author argues that the only way to sustain any allegation of unconstitutionality against these tax policy changes is to extend meanings of "constitutionality" beyond the legalistic paradigm of constitutional adjudication. Explaining that to extend notions of constitutionality this additional distance, we would need to resurrect earlier constitutional conceptions from such influential political thinkers as Aristotle, David Hume, James Madison, and Thomas Jefferson. While pointing out that the United States Constitution embodies a …

A Different Kind Of Sameness: Beyond Formal Equality And Antisubordination Strategies In Gay Legal Theory, Nancy Levit Jan 2000

A Different Kind Of Sameness: Beyond Formal Equality And Antisubordination Strategies In Gay Legal Theory, Nancy Levit

Faculty Works

Gay legal theory is at a crossroads reminiscent of the sameness/difference debate in feminist circles and the integrationist debate in critical race theory. Formal equality theorists take the heterosexual model as the norm and then seek to show that gays, lesbians, bisexuals, and transsexuals - except for their choice of partners - are just like heterosexuals. Antisubordination theorists attack the heterosexual model itself and seek to show that a society that insists on such a model is unjust. Neither of these strategies is wholly satisfactory. The formal equality model will fail to bring about fundamental reforms as long as sexual …

The Financial And Operational Performance Implications Of Compensation Practices: A Study Of Relative Wage Practices And Pay Structures., Mark Patton Brown Jan 2000

The Financial And Operational Performance Implications Of Compensation Practices: A Study Of Relative Wage Practices And Pay Structures., Mark Patton Brown

LSU Historical Dissertations and Theses

This research examines the organizational performance implications of relative wage strategies and pay structures. Organizations' relative wage strategies and pay structures are key characteristics useful in describing and delimiting various compensation systems, and are therefore particularly relevant for evaluation at the organizational level. The organizational performance implications of organizations' relative wage strategies and pay structures are investigated in terms of both operational and financial indicators of organizational performance. Initially, relevant theory and past research on relative wage strategies and pay structures are discussed. Following this, hypotheses are developed that predict the operational and financial performance implications of pay structures and …
