The Debt-Equity Distinction In A Second-Best World, Katherine Pratt May 2000

The Debt-Equity Distinction In A Second-Best World, Katherine Pratt

Vanderbilt Law Review

This Article discusses the time-honored but outdated tax law distinction between corporate debt and equity. Economic and legal commentators and the Treasury Department have made various proposals to eliminate the debt-equity distinction. The theory of the second best posits that eliminating an economic distortion does not necessarily increase efficiency if other economic distortions remain.' Policymakers cannot simply assume that eliminating the distortionary debt-equity distinction will automatically increase efficiency because other distortions in the income tax will remain. This Article evaluates a number of the proposals to eliminate the debt-equity distinction, taking into account numerous distortions that are likely to remain …

Impact Of Employee Performance And Job Status On Perceptions Of Sexual Harassment, Charla Arnold May 2000

Impact Of Employee Performance And Job Status On Perceptions Of Sexual Harassment, Charla Arnold

Masters Theses & Specialist Projects

Once unnoticed and unreported, sexual harassment claims have risen dramatically within the last two decades. Although guidelines published by the Equal Employment Opportunity Commission in 1980 provided a definition of sexual harassment, researchers continue to examine variables affecting individual perceptions of sexual harassment. Contextual factors impacting the labeling of sexual harassment include the type and severity of the harassment, the ambiguity of the sexually harassing behaviors, and gender differences in perceptions of sexual harassment. The present researcher examined the impact of employee performance and employment status on perceptions of sexual harassment. Results indicated that female participants were more likely than …

Anxiety And Efficacy: Are They Related To Students' Choice Of Major?, Camille Johnson May 2000

Anxiety And Efficacy: Are They Related To Students' Choice Of Major?, Camille Johnson

Masters Theses & Specialist Projects

Research suggests that anxiety characteristics play a role in determining the courses students choose in college. Other research suggests that efficacy may play a similar role as well. The purpose of the present study was to investigate the relationship between anxiety and efficacy and choice of major for English and mathematics majors. Ninety-nine undergraduate and graduate students from Western Kentucky University (49 males and 50 females) participated in the study. All participants were officially declared mathematics (or mathematics-related, i.e., computer science) or English majors. Instruments included a measure of mathematics anxiety, mathematics efficacy, writing efficacy, writing anxiety, facilitating anxiety, debilitating …

The Effects Of Interviewer Self-Monitoring On Male Appearance Discrimination In Employment Decisions, Charles Mcdowell May 2000

The Effects Of Interviewer Self-Monitoring On Male Appearance Discrimination In Employment Decisions, Charles Mcdowell

Masters Theses & Specialist Projects

This research examined the effects of appearance discrimination toward men as regards employment decisions and the extent to which the degree of interviewer selfmonitoring influences these decisions. Past research has indicated that discrimination does indeed occur for women, but no empirical research has been conducted on male discrimination in which hair length has been manipulated. Specifically, length of hair (shoulder length, approximately 1 inch, and balding) was manipulated for potential job applicants. These conditions were examined across different types of jobs (traditionally conservative, neutral, and traditionally liberal). Several hypotheses are offered, with most focused on the concept that those scoring …

A Life Of Paradox: Thomas Merton's Asian Trajectory, Gary Houchens May 2000

A Life Of Paradox: Thomas Merton's Asian Trajectory, Gary Houchens

Masters Theses & Specialist Projects

Anthony Padovano called Thomas Merton a "symbol of the century" inasmuch as he embodied many of the changes facing Christianity during the often tumultuous and violent, but increasingly pluralistic, middle decades of the twentieth century. Merton engaged in a "total ecumenism," in which he intensely studied other religious traditions, most notably the religions of Asia, in order to better understand his own Roman Catholic tradition. This paper will trace the trajectory of Asian ideas and experiences throughout Merton's life and analyze how these experiences transformed him from a narrow-minded monk to an ecumenical mystic. An ever-present subject emerges: the coincidence …

Transformations: A Folkloric Exploration Of The Musical Comedy Into The Woods By Stephen Sondheim And James Lapine, Cara Hoglund

Masters Theses & Specialist Projects

The purpose of this thesis is to examine the use of folktales in Stephen Sondheim and James Lapine's 1987 award-winning musical Into the Woods. In doing so, I hope to accomplish several directives. First, to enrich understanding of the musical for all audience members, especially those with a folklore or theater background. I feel that understanding the underlying goals and standards that Stephen Sondheim and James Lapine used in creating the musical will provide a much deeper understanding of the genius of their work. I also aim clearly elucidate the merger of folk narrative and popular musical theater form in …

Truth Commissions And National Reconciliation: Some Reflections On Theory And Practice, Charles O. Lerche Iii May 2000

Truth Commissions And National Reconciliation: Some Reflections On Theory And Practice, Charles O. Lerche Iii

Peace and Conflict Studies

Excerpt

The “Post-Cold War” world presents staggering contrasts. On the one hand, the threat of annihilation has receded, totalitarianism seems to be in retreat and there is greater interest in such issues as sustainable development, human rights and good governance. On the other hand, however, political and economic instability seem chronic in many regions, and there is a sense of drift both within many countries and at the global level. Prominent on the “new agenda” of world politics is the apparent rising tide of communal conflicts around the planet: a trend which has both positive and negative aspects. Communalism is …

Peace Negotiations And The Dynamics Of The Arab-Israeli Conflict, Amr G.E. Sabet May 2000

Peace Negotiations And The Dynamics Of The Arab-Israeli Conflict, Amr G.E. Sabet

Peace and Conflict Studies

Excerpt

The saga of the Middle East ‘peace process’ and the fanfare that has surrounded it, obscured the fact that little has been subjected to detailed systematic and objective analysis. Nor has it been sufficiently put to the test of negotiation principles in a fashion that would shed light on its underlying nature and substance. This caveat hindered addressing important questions regarding the very structure of the process and its ability to deliver on its purported promises. It further raises questions as to whether one could speak of a real peace in the making, or whether the whole endeavor is …

Vanderbilt Law Review

On October 31, 1997, eleven-year-old Nathaniel Abraham was at school and enjoying Halloween with his grade school classmates. The festivities ended, however, when members of the Pontiac, Michigan police department entered the classroom and arrested Nathaniel for first degree murder. Two days before, on October 29, eighteen- year-old Ronnie Lee Greene was walking out of a convenience store in Pontiac when a .22 caliber bullet struck him in the head and killed him.' Police suspected Nathaniel who, at the time of his arrest, had over twenty encounters with law enforcement. Once in custody, Nathaniel eventually confessed to shooting Greene and …

Leadership Competencies For The New Millennium, John David Silvernail May 2000

Leadership Competencies For The New Millennium, John David Silvernail

Education Masters

Effective leadership is one of the major factors that impacts the success of an organization. Mergers, acquisitions and corporate downsizings have created a more competitive work environment. As a result of the rapidly changing work environment, the need for effective leadership has increased. However, there s currently a leadership gap in the workplace whereby there are not enough competent successors waiting to fill the soon to be vacant leadership positions. Leadership is the ability to create an environment and motivate an individual or groups to have favorable results. In order to be an effective leader, one must have a certain …

Ceasefire: The Impact Of Republican Political Culture On The Ceasefire Process In Northern Ireland, Montgomery Sapone

Peace and Conflict Studies

Excerpt

On August 31, 1994, the Provisional IRA (PIRA) declared a cessation of military operations. For the past thirty years, the conflict in Northern Ireland has been raging almost without pause.1 British security forces have attempted to control the violence by establishing road blocks, conducting house searches, altering the judicial system to allow conviction on informant testimony, instituting internment without trial for paramilitary suspects, garrisoning over thirty thousand British soldiers in Northern Ireland, instituting broadcasting bans of Sinn Féin, and conducting intensive interrogation of suspects. Despite the best attempts of the British government over the past few decades to thwart …

Methamphetamine Treatment: A Hermeneutic Study, Sandra S. Hamann May 2000

Methamphetamine Treatment: A Hermeneutic Study, Sandra S. Hamann

Theses and Graduate Projects

This hermeneutic study examines and compares the life experiences of three methamphetamine users who have been in chemical dependency treatment for their methamphetamine use. Findings of this researcher indicate that cognitive behavioral practice models have the best results when working with chemical users. There are few chemical dependency treatment programs which address methamphetamine users as needing different treatment approaches than other chemical users. Research indicates that those chemical dependency programs that address the multiple needs of the methamphetamine users and not just their drug use have the best results with helping them maintain long-term recovery from their chemical use. The …

From A Father's Point Of View: A Hermeneutic Study Of Non-Custodial Fathers And The Contributions That They Make To Their Children's Lives, Susan Pohl May 2000

From A Father's Point Of View: A Hermeneutic Study Of Non-Custodial Fathers And The Contributions That They Make To Their Children's Lives, Susan Pohl

Theses and Graduate Projects

This research is a hermeneutic study of three non-custodial fathers and contributions that they make to their children's lives. The literature review explores how children benefit from the presence of their fathers in their lives. The hermeneutic design was used asking the question, "What do you believe are the contributions that you make to your child's life?" The findings reveal that the fathers believe that they are contributing to their children's cognitive development, the development of humor, educational support, social emotional development, and identity. Implications for social work practice and programming are discussed.

The "Tao Te Ching:" A Primer For Developing A Leadership Philosophy, Merilee J. Light May 2000

The "Tao Te Ching:" A Primer For Developing A Leadership Philosophy, Merilee J. Light

Theses and Graduate Projects

A leader's behavior and actions flow from their values and beliefs. The focus of this thesis is to create a forum where people can explore their beliefs around how to positively influence others when in a position of leadership.

The forum is a three-session study group using a 2,500 year-old book of Chinese philosophy called the "Tao Te Ching." The 5,100-word book of 81 aphorisms provides pearls of wisdom on leadership--using nature as the model. Participants documented their leadership philosophy in session 1 and after reading the "Tao Te Ching" in session 3. Session 1 is an introduction to the …

Diagrams Based On Structured Object Perception, Pourang Irani, Colin Ware May 2000

Diagrams Based On Structured Object Perception, Pourang Irani, Colin Ware

Center for Coastal and Ocean Mapping

Most diagrams, particularly those used in software engineering, are line drawings consisting of nodes drawn as rectangles or circles, and edges drawn as lines linking them. In the present paper we review some of the literature on human perception to develop guidelines for effective diagram drawing. Particular attention is paid to structural object recognition theory. According to this theory as objects are perceived they are decomposed into 3D set of primitives called geons, together with the skeleton structure connecting them. We present a set of guidelines for drawing variations on node-link diagrams using geon-like primitives, and provide some examples. Results …
