Ambiguous Quality Changes From Taxes And Legal Rules, Henry E. Smith
Ambiguous Quality Changes From Taxes And Legal Rules, Henry E. Smith
University of Chicago Law Review
Legal rules have long been analogized to taxes. Conventional analysis has often assumed that the mix of attributes within commodities is either fixed or costlessly measured. This Article explores the consequences for legal rules from dropping this neoclassical assumption of constant quality. Instead, attributes are costly to measure, and substitution can occur by altering levels of attributes (such as durability) within commodities, services, and activities. The Article extends models of quality under commodity-excise taxes to the more complex case of legal rules mandating product enhancements (such as nondisclaimable warranties) and to rules aimed at pricing external harms (such as pollution …
Corporate Strategies: A Comprehensive Handbook Based On Indian Experience: By Bani P Banerjee, New Delhi: Oxford University Press, 1998., K R S Murthy
IIMB Management Review
These are two very different, but complementary, books on strategy. Strategy is a term used widely with different meanings and in different contexts. It is often also used with various prefixes and suffixes, as in these two books. The basic notion of strategy underlying the two books, and therefore their approaches, differ, and it is important to understand the bias of the authors to be able to use the books properly.
Past-Dependency, Pragmatism, And Critique Of History In Adjudication And Legal Scholarship, Richard A. Posner
Past-Dependency, Pragmatism, And Critique Of History In Adjudication And Legal Scholarship, Richard A. Posner
University of Chicago Law Review
Using Nietzsche's great essay on the uses and disadvantages of history for life as his jumping-off point, Judge Posner examines the utility of the study of history for adjudication and legal scholarship. He argues, following Nietzsche, that the wrong kind of historical study can be very bad for "life," including law, while the right kind -- the kind deployed by a pragmatic judge or a policy-oriented legal scholar -- may deviate from literal accuracy in the direction of a rhetorical and imaginative narrative of historical events that can be constructively employed in a forward-looking approach to legal problems.

Alaska Justice Forum ; Vol. 17, No. 2 (Summer 2000), Wood S. N/A, Sharon Araji
Vols 11-20 (1994-2004)
The Summer 2000 issue of the Alaska Justice Forum features findings from a study of officer turnover in Alaska's Village Public Safety Officer (VPSO) program, a review essay of the book "A Natural History of Rape" by Randy Thornhill and Craig T. Palmer, and national data on rape rates in the U.S. from 1973 to 1999 based on figures from the National Crime Victimization Survey (NCVS).
Drag = Blackface, Kelly Kleiman
Drag = Blackface, Kelly Kleiman
Chicago-Kent Law Review
Performance in drag is indistinguishable conceptually from performance in blackface, yet the former is embraced while the latter is shunned. This Essay argues that the analogy is powerful enough to justify making drag performance anathema. It outlines the parallel features of the two modes of performance and then rebuts the com- mon defenses of drag performance-that drag subverts gender stereotypes, that it is a matter of private sexual compulsion, that it is a privileged activity of gay men, and that it's just a joke.
Pretrial Mediation Of Complex Scientific Cases: A Proposal To Reduce Jury And Judicial Confusion, Susan E. Cowell
Pretrial Mediation Of Complex Scientific Cases: A Proposal To Reduce Jury And Judicial Confusion, Susan E. Cowell
Chicago-Kent Law Review
This Note proposes pretrial mediation using scientist-mediators for complex scientific disputes. Complex scientific disputes reflect the inherent tension between law and science. This tension results in dissatisfaction among judges, juries, and scientists because of the uncertainties embraced by science, but eschewed by law. Pretrial mediation would address some of these uncertainties before they are introduced into the courtroom. In short, the proposed pretrial mediation should reduce jury confusion and provide judges with guidance to assess the admissibility of scientific evidence and expert opinions by eliminating and clarifying scientific issues.
Before It's Too Late: Neuropsychological Consequences Of Child Neglect And Their Implications For Law And Social Policy, Janet Weinstein, Ricardo Weinstein
Before It's Too Late: Neuropsychological Consequences Of Child Neglect And Their Implications For Law And Social Policy, Janet Weinstein, Ricardo Weinstein
University of Michigan Journal of Law Reform
Recent developments in the neurosciences have led to dramatic breakthroughs in the area of brain development and the understanding of consequences of neglect. Because this process was heretofore not understood, legislators have been wary of drafting child protection statutes that afforded the possibility for arbitrary interference with families. Strict statutory standards have been adopted that allow coercive intervention only in cases where the child is at substantial risk of imminent physical harm, or after some of the most severe consequences of neglect have been identified. These laws do not consider developmental harm because it does not present an imminent danger …

Advanced Placement Science Programs In Catholic High School, Daniel D. Schinzel
Journal of Catholic Education
The purpose of this study was to examine Advanced Placement (AP) science programs in participating Catholic high schools and develop guidelines for the implementation of similar programs at other Catholic schools. The areas of interest were curriculum, instruction, and Advanced Placement examination results. Administrators and teachers at Catholic high schools with Advanced Placement science programs were surveyed using instruments developed by the researcher. The responses of AP teachers and administrators were analyzed and compared in order to determine important features of existing science programs.
Analyzing Women's Use Of The Internet Through The Rights Debate, Reem Bahdi
Analyzing Women's Use Of The Internet Through The Rights Debate, Reem Bahdi
Chicago-Kent Law Review
Women's use of the Internet has received very little attention from feminist legal commentators. While they increasingly turn to it as a source of information and as an advocacy tool, feminist legal scholars and advocates have failed to analyze the Internet in terms of its significance to women. In this Essay, Bahdi argues that feminists must be concerned that access to the Internet is often limited to relatively privileged women in relatively privileged countries. Yet, we can harness the Internet in the promotion of women's rights and recognize it as an important feminist medium, as long as we understand its …

The Impact Of Individual, Organizational, And Environmental Attributes On Voluntary Turnover Among Juvenile Correctional Staff Members, Ojmarrh Mitchell, Doris Layton Mackenzie, Gaylene Armstrong, Angela Gover
Criminology and Criminal Justice Faculty Publications
In this study we assessed the impact of individual employee characteristics, organizational attributes, and quality of the correctional environment on the turnover intentions of juvenile correctional staff members. Both individual characteristics and organizational attributes were significant predictors of turnover intentions. The individual characteristics were age, race, and education; the organizational variables were job satisfaction, stress, and staff support and communication. In general, the organizational attributes were stronger predictors of turnover. Only one variable pertaining to the quality of correctional environment, facility's amount of care toward juveniles, was significantly related to turnover. In contrast to findings of previous research, dangerousness, gender, …

Power And Influence In Organizations: Edited By Roderick M Kramer And Margaret A Neale, New Delhi: Sage Publications, 1998., Abhoy K Ojha
IIMB Management Review
Power and Influence in Organizations examines the role of social influence in organisations. It is a compilation of edited versions of papers presented at a conference at Stanford University. Unlike some other collections of essays from conferences that are subsequently released as books, the articles in this volume display a very high degree of academic depth and rigour. Most, if not all, articles could easily meet the requirements of the refereeing process of a premier journal in the field of organisational studies.

Tanf Policy Implementation: The Invisible Barrier, Roberta Rehner Iversen
Tanf Policy Implementation: The Invisible Barrier, Roberta Rehner Iversen
The Journal of Sociology & Social Welfare
Barriers to participation in welfare-to-work programs are generally described in terms of human and social capital. Findings from case examination of four Philadelphia-areaw elfare-to-work programs under TANF suggest that theory about policy implementation is more applicable. Faulty policy logic, organizational and personnel incompetence, and inadequate coordination between and within funding, referral, program, and employer organizations regularly resulted in delayed program start-ups and strained program operations. Generally invisible and absent from research attention, these implementation delays and strains impeded program staff efforts and harmed TANF recipients. States' 24-month time limit policies are a critical target for advocacy efforts.
Exploitation-The Invisible Hand Guided By A Blind Eye: Confronting A Flaw In Economic Theory, Phillip Dybicz
Exploitation-The Invisible Hand Guided By A Blind Eye: Confronting A Flaw In Economic Theory, Phillip Dybicz
The Journal of Sociology & Social Welfare
Economics is alone among the social science disciplines in failing to have a sound theory to explain behaviors when people do not act according to their self-interest, that is, with compassion. This has resulted in a fundamental flaw in economic thought. As economies have grown in scale and complexity, there has been a corresponding distancing between consumers and producers. This flaw has revealed itself through a lack of economic structures which bridge this distance, restore a level of intimacy within the economic interaction, and hence facilitate the expression of compassion.
Performance Improvement In International Environments: Designing Individual Performance Interventions To Fit National Cultures, Carol M. Sanchez
Performance Improvement In International Environments: Designing Individual Performance Interventions To Fit National Cultures, Carol M. Sanchez
Peer Reviewed Articles
This article examines how internationalization might affect the design of individual performance improvement approaches in organizations. It begins by examining knowledge that has been learned principally from the North American context of what improves an individual's performance. Then, we discuss motivators, attitudes. and behaviors of workers and how they may vary among workers in different national cultural contexts. In short, we examine individual performance improvement for its cross‐border effectiveness, using various models of national cultural differences. By doing this, we hope to provide an understanding of how performance improvement systems might require modification to fit with non‐North American work environments.
