Qualified Intimacy, Celebrity, And The Case For A Newsgathering Privilege, Rodney A. Smolla
Qualified Intimacy, Celebrity, And The Case For A Newsgathering Privilege, Rodney A. Smolla
University of Richmond Law Review
In this symposium issue Robert Nagel, Diane Zimmerman, Robert O'Neil, and Erwin Chemerinsky explore the intersection of privacy and freedom of the press. In his fascinating inquiry into privacy and celebrity in modern American life, Robert Nagel demonstrates the connection between the American public's strong commitment to privacy and its simultaneous passion for robust protection of freedom of speech. Among his most important insights is the exposure of "pseudo-intimacy" as a principal currency of contemporary celebrity status. Diane Zimmerman, Robert O'Neil, and Erwin Chemerinsky all investigate the legal principles that ought to surround aggressive and surreptitious newsgathering techniques, each in …

Against Constitutional Law (Populist Or Otherwise), Michael Mandel
University of Richmond Law Review
Mark Tushnet has written a great critique of constitutional judicial review. With his sure grasp of the scholarship, his commit- ment to the issues and the real people behind them, and his methodical, flawless reasoning, he has effectively blasted the theoretical foundations of judicial constitutional law to smithereens. As such, he has made a valuable contribution to legal scholarship that will remain so for a long time to come.

Annual Survey Of Virginia Law: Antitrust And Trade Regulation Law, Michael F. Urbanski, James R. Creekmore
University of Richmond Law Review
During the past year, this country has devoted much attention, with good reason, to the Microsoft trial and appeal. Not since the breakup of Ma Bell's stronghold on the telecommunications industry in the early 1980s has a single legal battle posed so significant a change for both an industry and its consumers. In fact, given the far-reaching effects of this decision on other related industries and consumers, it likely will be years before its ultimate impact can be assessed.

Some of the elk (Cervus elaphus nelsoni) of the Greater Yellowstone Area (Wyoming, Idaho, Montana; USA) are infected with Brucella abortus, the bacterium that causes bovine brucellosis. Brucella abortus strain RB51 vaccine is being considered as a means to control B. abortus induced abortions in cow elk. However, the most probable vaccination strategies for use in free-ranging elk might also result in some bull elk being inoculated, thus, it is important to insure that the vaccine is safe in these animals. In the winter of 1995, 10 free-ranging bull elk calves were captured, tested for B. abortus antibodies, and intramuscularly …

Faculty Publications
Brucella abortus strain RB51 is a laboratory-derived rough mutant of virulent B. abortus strain 2308 used as a vaccine because it induces antibodies that do not react on standard brucellosis serologic tests. Strain RB51 vaccine was evaluated in pregnant captive elk (Cervus elaphus) to determine (1) if it induced abortion and (2) if it protected against abortion following subsequent challenge. The time period of this study (February-June, 1998) was similar to field conditions where elk are vaccinated and possibly exposed to B. abortus. Fourteen elk were randomly and equally divided into vaccinated and control groups. The vaccinated group was vaccinated …
Influence Of Mechanical Processing On Utilization Of Corn Silage By Lactating Dairy Cows, T. R. Dhiman, M. A. Bal, Z. Wu, V. R. Moreira, R. D. Shaver, L. D. Satter, K. J. Shinners, R. P. Walgenbach

We conducted three experiments to determine the influence of mechanical processing on corn silage utilization by lactating dairy cows. Total mixed rations contained either unprocessed or processed corn silage harvested between 1/4 and 3/4 milk line. In trial 1, 12 multiparous Holstein cows were used in a replicated double switchback design with 21-d periods. Intake of dry matter (DM) was increased 1.2 kg/d by processing, but milk yield was unaffected. Processing did not affect apparent total-tract DM digestibility, but processing tended to lower starch and corn excretion in feces and reduced concentration of sieved corn kernel particles in feces. In …
Cracking The Code: "De-Coding" Colorblind Slurs During The Congressional Crack Cocaine Debates, Richard Dvorak
Cracking The Code: "De-Coding" Colorblind Slurs During The Congressional Crack Cocaine Debates, Richard Dvorak
Michigan Journal of Race and Law
This article proposes "de-coding" as a method for unveiling the racist purpose behind the enactment of race-neutral legislation. Through the use of "code words," defined as “phrases and symbols which refer indirectly to racial themes, but do not directly challenge popular democratic or egalitarian ideals,” legislators can appeal to racist sentiments without appearing racist. More importantly, they can do so without leaving evidence that can be traced back as an intent to discriminate. This article proposes to use "de-coding" as a method to unmask the racist purpose behind the enactment of the 100:1 crack versus powder cocaine ratio for mandatory …

American Holocaust Films: A Case Study In Jewish American Identity (1937-1993), Jeff Daniels
American Holocaust Films: A Case Study In Jewish American Identity (1937-1993), Jeff Daniels
Honors Theses
When examining the image of the Jew in American Holocaust films, one is truly determining how American Jews view themselves. These films' presentation of Jews exposes not only how Jewish Americans wished to see themselves but also how much Gentile Americans wanted to see of Jewish culture. An exploration of America's Holocaust films from the late 1930s to the early 1990s reveals an increasing concentration of Jews as the main victims of the event. The degree to which this specificity is emphasized exhibits how much the American public accepted Jews and their plight. At the same time, the prevalence of …
Experimental Study Of Colorant Scattering Properties When Printed On Transparent Media, Anthony Calabria
Experimental Study Of Colorant Scattering Properties When Printed On Transparent Media, Anthony Calabria
Theses
It is extremely beneficial to predict the behavior of a printing device. There has been much research done developing printer prediction and simulation models dealing with printing on a paper substrate. This research is a study of the behavior of inks when printed on a transparent substrate. It is an effort to determine the possibility of using ink scattering and transmissive properties to predict the reflectance of the image, and thus help lead to a better understanding of the printing process. The approach taken utilizes the transmittance of the ink and the substrate, and an Expanded Murray-Davies Model of Tone …
Automatic Optical Matched Filtering An Evaluation Of Reflexite And Transitions Lenses In An Optical Matched Filtering Role, Timothy Hattenberger
Automatic Optical Matched Filtering An Evaluation Of Reflexite And Transitions Lenses In An Optical Matched Filtering Role, Timothy Hattenberger
Theses
A matched filter is a device used to detect the presence and position of known objects in a scene. The ability to create an optical matched filter has been around for many years. The current filters have some aspects that are troublesome. The problems encountered by these filters include quantization error, and complexity in generating the matched filters. The optical matched filter being studied eliminates these problems in an attempt to generate a better filter. There are also other potential implications of this research. One can envision such a system being used for real-time target detection. The primary advantage over …

Fermentation Of Glucose And Fructose By Leuconostoc Mesenteroides, Hüseyi̇n Erten
Fermentation Of Glucose And Fructose By Leuconostoc Mesenteroides, Hüseyi̇n Erten
Turkish Journal of Agriculture and Forestry
The preferred order of glucose and fructose uptake by Leuconostoc mesenteroides was investigated in Glucose Fructose Yeast Extract Amino Acid medium with and without the addition of salt under anaerobic conditions. Strains NCIMB 8023 and NCFB 811 preferentially utilised glucose over fructose. A higher biomass was obtained when employing strain NCIMB 8023 compared with strain NCFB 811. The strains studied produced lactate and ethanol as major end-products, with lactate synthesis being greater than ethanol. Small amounts of acetate and mannitol were also formed.
Does "Gangsta Rap" Music Cross Good Judgment Lines And Decency Values?, Ajay Kumar Ojha
Does "Gangsta Rap" Music Cross Good Judgment Lines And Decency Values?, Ajay Kumar Ojha
Masters Theses
There has been much controversy associated with "gangsta rap" music over the 1990's decade. This manuscript takes a closer look at "gangsta rap" music through a descriptive analysis, exploring these topics: social construction of reality, sexism, violence, community actions, and their possible negative influences on societal values. The positive and negative implications involving "gangsta rap" music are compared using lyrics from artists whose music has been in question in the past. Using a semantic differential survey and focus group interviews, "gangsta rap" music is analyzed, examining its exposure to people, possible promotion and communication of negative societal values. The study …

Audre Lorde's Expansive Influence On Black Lesbians: Jewelle Gomez, Cheryl Clarke, And Kate Rushin, Denise L. Fitzer
Masters Theses
Audre Lorde, who named herself black, feminist, lesbian, mother, poet, and activist, was a pioneer for black lesbians everywhere. In her poetry and prose, Lorde challenged the myths and taboos associated with black women, lesbians, and feminists. Although her work focused on a broad range of topics that illuminated her many identities, she concentrated most heavily on issues of multiple oppression and its resulting fear and silence. In naming herself, Lorde urged others to do the same — to fight the self-imposed and socially-imposed silence surrounding triple oppression.
Countless women from the black community of writers have paid tribute to …
African American Poets Of The Vietnam War, Megan Guernsey
African American Poets Of The Vietnam War, Megan Guernsey
Masters Theses
Almost 6000 African American men gave their lives in the Vietnam War. While peaceful protests, voter registration drives, and racial confrontations occurred throughout the United States, the government continued to send young Black men to Southeast Asia to preserve the "freedom" of the Vietnamese people. The irony of this situation lies in the fact that these soldiers were asked to fight a War in the name of democracy, to kill in order to secure rights that they themselves were being denied. Although many Black Americans saw military service as a means of escaping poor ghetto life, they often were confronted …
"Television And Reality: Are They Different?", Tammy L. Holmes
"Television And Reality: Are They Different?", Tammy L. Holmes
Masters Theses
The purpose of this paper is to discover if there is any significance between the images of television viewed by people and the increase of the social construction of reality. Stephen LittleJohn (1999) states, [Social construction of reality] consists of meanings and understanding arising from communication with others. This notion known as reality that is deeply embedded in sociological thought. The objective of this topic is to explore the effects that mass media have on life and specifically how television often distorts, and does not accurately communicate the everyday lived experiences in our lives. Television often mimics reality. Television only, …

The Recommended Dissociation Constants For Carbonic Acid In Seawater, Kitack Lee, Frank J. Millero, Robert H. Byrne, Richard A. Feely, Rik Wanninkhof
Marine Science Faculty Publications
A coherent representation of carbonate dissociation constants and measured inorganic carbon species is essential for a wide range of environmentally important issues such as oceanic uptake of anthropogenic CO2 and carbon cycle depictions in ocean circulation models. Previous studies have shown varying degrees of discordance between calculated and measured CO2-system parameters. It is unclear if this is due to errors in thermodynamic models or in measurements. In this work, we address this issue using a large field dataset (15,300 water samples) covering all ocean basins. Our field data, obtained using laboratory-calibrated measurement protocols, are most consistent with …
Statutory Rape Law And Enforcement In The Wake Of Welfare Reform, Rigel C. Oliveri
Statutory Rape Law And Enforcement In The Wake Of Welfare Reform, Rigel C. Oliveri
Faculty Publications
The recent national efforts at reforming the welfare system and new research on the connection between teen pregnancy and statutory rape have led many states to enact stricter laws against statutory rape and to increase the enforcement of existing laws. Punitive statutory rape laws are being viewed more and more as a mechanism for shrinking the welfare rolls by reducing teen pregnancy. Rigel Oliveri documents the resurgence of statutory rape law and enforcement and explores the ramifications it will have on teen parents. In particular, Oliveri approaches the issue from several analytical frameworks, discussing arguments for consent-based standards, the privacy …
