Can U.S. Antitrust Laws Open International Markets?, Spencer Weber Waller Jan 2000

Can U.S. Antitrust Laws Open International Markets?, Spencer Weber Waller

Northwestern Journal of International Law & Business

The vigorous and non-discriminatory enforcement of antitrust law can contribute to promoting an international marketplace characterized by an open competitive process. However, antitrust law is, at best, a supporting player in constructing a liberal multilateral trading order, and is incapable of promoting any single country's exports. This article suggests a small, but important, role for United States antitrust law in promoting that competitive marketplace in conjunction with a developing wave of competition law around the globe.

Transnational Competition Law Aspects Of Mergers And Acquisitions, William M. Hannay Jan 2000

Transnational Competition Law Aspects Of Mergers And Acquisitions, William M. Hannay

Northwestern Journal of International Law & Business

As more and more U.S. companies engage in overseas operations, even the most routine merger or acquisition seems to have a transnational component which requires analysis and perhaps premerger notification under an increasing number of foreign "competition laws" (or what we call antitrust laws). An understanding of those competition rules has become an imperative for American lawyers.

Wives For Sale: The Modern International Mail-Order Bride Industry, Kathryn A. Lloyd Jan 2000

Wives For Sale: The Modern International Mail-Order Bride Industry, Kathryn A. Lloyd

Northwestern Journal of International Law & Business

This comment begins by discussing the mail-order bride industry in the context of international human trafficking, focusing on traffic between the United States and the Philippines, and includes an overview of the current regulations that exist regarding this industry. It then gives an overview of the major criticisms of the mail-order bride industry, the international problems created by the practice of trafficking women as brides, and the failure of current regulations in the United States and the Philippines (or the lack thereof) to address these problems. Finally, this comment calls for international regulation that would begin to address these problems, …

The Treatment Of Global Mergers: An Australian Perspective, S.G. Corones Jan 2000

The Treatment Of Global Mergers: An Australian Perspective, S.G. Corones

Northwestern Journal of International Law & Business

The purpose of this article is to examine some recent global mergers from an Australian perspective. The article begins by considering the administrative tribunal and Court structure in Australia, as well as the procedural, substantive. and remedial aspects of Australian laws regulating global mergers. It then considers the Merger Guidelines and their focus on the unilateral and co-ordinated post-merger effects that are likely to occur. The article examines a number of recent global mergers. including Coopers & Lybrand/Price Waterhouse, BAT/Rothmans, Pepsi Co/Smith's Snack Foods and Coca-Cola/Cadbury Schweppes, as well as their assessment by the ACCC. Finally, it considers some of …

Massachusetts, Myanmar, Market Participation, And The Federal Shutdown Of Selective Purchasing Laws: Is The Power To Purchase Really The Power To Regulate , Scott Sommers

Northwestern Journal of International Law & Business

This article does not discuss whether intentionally giving companies an incentive to withdraw from Burma is economically or politically desirable for the people of Burma. The First Circuit did not concern itself with this subject either in rejecting the Massachusetts Burma Law. The question of interest to the court, and which should be of interest to any state citizen or global corporation interested in doing business with state agencies, was whether Massachusetts had the discretion to make a purchasing law directly concerning the business involvement of suppliers in foreign countries. While legitimate legal and practical arguments may be made that …

Bird In A Cage: Chinese Law Reform After Twenty Years, Stanley Lubman Jan 2000

Bird In A Cage: Chinese Law Reform After Twenty Years, Stanley Lubman

Northwestern Journal of International Law & Business

When I wrote in 1979, it was easy to summarize the state of Chinese legal institutions because they were so sparse. Although a judicial system had been created on the Soviet model in the 1950s, it had been politicized by the end of that decade after a brief period of liberalization, and then further wrecked by the Cultural Revolution. A new period of institution-building began in 1979; reconstruction of the courts began and the law schools, closed for a decade, reopened. Most fundamentally, the policies of the Chinese leadership seemed to promise, as I noted then, "attempts to conceptualize and …

Russia's Intactable Economic Problems And The Next Steps In Legal Reform: Bankruptcy And The Depoliticization Of Business , William P. Kratzke Jan 2000

Russia's Intactable Economic Problems And The Next Steps In Legal Reform: Bankruptcy And The Depoliticization Of Business , William P. Kratzke

Northwestern Journal of International Law & Business

Law reform in Russia proceeds on many fronts. This paper takes the position that the most important legal reforms for Russia are those that eliminate the reward system that encourages economic activity that can be highly inefficient. These legal reforms are an effective bankruptcy law and the de-politicization of business. The two go hand-in-hand. It is the politicization of business that renders Russia's bankruptcy laws ineffective by making non-viable business entities .appear to be solvent. These two reforms, were they adequately implemented, would eliminate rewards for inefficiency. Only when the Russian government-and its people-have removed this reward system can conditions …

Estimation Of Evaporation Of Previously Condensed Hydrocarbons In A Tunnel Burn Experiment, Zoran Stefanoski Jan 2000

Estimation Of Evaporation Of Previously Condensed Hydrocarbons In A Tunnel Burn Experiment, Zoran Stefanoski

UNLV Retrospective Theses & Dissertations

As part of the worldwide demilitarization efforts, outmoded solid rocket motor propellant is being destroyed by burning. Often this is done on a repeated basis in a closed chamber. There is concern whether or not previously condensed materials on the chamber wall might be re-evaporated during a new burn; The objective of this thesis is to estimate the amount of evaporation/sublimation possible for different types of organic materials during burns in a tunnel. This was carried out theoretically and compared to measurements. For the estimations, predictions of the wall and ambient temperatures were made. The evaporation/sublimation was then estimated as …

Luis Goytisolo’S La Paradoja Del Ave Migratoria As Postmodern Allegory: A Critique Of Absolutism, Terri Carney Jan 2000

Luis Goytisolo’S La Paradoja Del Ave Migratoria As Postmodern Allegory: A Critique Of Absolutism, Terri Carney

Scholarship and Professional Work - LAS

Luis Goytisolo’s short work of fiction, La paradoja del ave migratoria, was published in 1987 in a Post-Franco Spain and a Postmodern world. I will investigate this unusual novel as a postmodern allegory, relying on Brian McHale’s assertion that postmodern allegory challenges the “unequivocalness of traditional allegories” by problematizing the naive assumption that abstract concepts can be communicated transparently through language (1987, 141). Luis Goytisolo populates his allegory with mythical, and historical characters that hail from a dizzying array of time periods, creating a heterotopic universe in which no one context of references serves as the key to interpretation. …

Financing Intellectual Property Under Federal Law: A National Imperative, Lorin Brennan Jan 2000

Financing Intellectual Property Under Federal Law: A National Imperative, Lorin Brennan

UC Law SF Communications and Entertainment Journal

The information industries have become the center of national growth and opportunity. In the new information economy, intellectual property financing has assumed growing importance. This article suggests that area in urgent need of restructuring is secured financing law. Article 9 and the Revised Article 9 of the Uniform Commercial Code are incapable of effectively financing intellectual property. This article provides a summary of how intellectual property financing works and why it is more efficient to utilize the federal information statute. Additionally, this article provides a detailed description on the law governing the financing of intellectual property. The author argues that …

Come-Outers And Community Men: Abraham Lincoln And The Idea Of Community In Nineteenth-Century America, Allen C. Guelzo Jan 2000

Come-Outers And Community Men: Abraham Lincoln And The Idea Of Community In Nineteenth-Century America, Allen C. Guelzo

Civil War Era Studies Faculty Publications

The most eloquent and moving words Abraham Lincoln ever uttered about any community were those "few and simple words" he spoke on the rear platform of the railroad car that lay waiting on the morning of February 11, 1861, to take him to Washington, to the presidency, and ultimately to his death. As his "own breast heaved with emotion" so that "he could scarcely command his feelings sufficiently to commence" (in the description of James C. Conkling), Lincoln declared that "No one, not in my situation, can appreciate my feeling of sadness at this parting." To leave Springfield was to …

Pre-Employment Character Assessments For United States Pretrial Services And Probation Officers, Michael Blake Baker Jan 2000

Pre-Employment Character Assessments For United States Pretrial Services And Probation Officers, Michael Blake Baker

UNLV Retrospective Theses & Dissertations

Are pre-employment character assessments for federal officers necessary? Can character be tested? What does Aristotle's theory of moral perception and practical wisdom have to do with law enforcement? I will look at what constitutes human flourishing or eudaimonia and how it relates to law enforcement. Moral perception and judgment are discussed and how perception is necessary in the Federal Pretrial Services and Probation Officer's profession. What makes one person's character good and another's less than good? Are there tests currently being used to test for strength of character or are they really testing for ethical sensitivity or moral judgment?

Cleaner Production In Kenyan Small And Medium Enterprises: Prerequisites For Successful Technology Adoption, Evans Kituyi, Martin Marani Jan 2000

Cleaner Production In Kenyan Small And Medium Enterprises: Prerequisites For Successful Technology Adoption, Evans Kituyi, Martin Marani

East Africa Institute

Results of cleaner production initiatives taken so far in Africa amply justify the benefits of cleaner production (CP). The joint UNIDO-UNEP initiative of establishing National Cleaner Production Centres (NCPCs) in developing countries have been successful in establishing such centres in Kenya, Tanzania, Zimbabwe, Tunisia and Morocco. In most of these countries, initial activities have involved demonstration projects such as those funded by DANIDA and NORAD in Zimbabwe and Tanzania. However, experiences in Asian countries such as Thailand and Malaysia have shown that such demonstration projects may not necessarily rise to the original expectation of the multiplication effects of the CP …

Commercial Sex: Beyond Decriminalization, Sylvia A. Law Jan 2000

Commercial Sex: Beyond Decriminalization, Sylvia A. Law

Faculty Articles

This Article argues that: 1) criminal sanctions against people who offer sex for money should be repealed, 2) legal remedies and programs to protect commercial sex workers from violence, rape, disease, exploitation, coercion and abuse should be enhanced and 3) whether or not commercial sex is prohibited by criminal law, government policy should promote decent working conditions for all workers and should not require people to engage in sex as a condition of subsistence. It further addresses how, as a practical matter, people who provide commercial sex can best be protected against exploitation, both physical and economic. This Article demonstrates …

Expressive Theories Of Law: A General Restatement, Elizabeth S. Anderson, Richard H. Pildes Jan 2000

Expressive Theories Of Law: A General Restatement, Elizabeth S. Anderson, Richard H. Pildes

Faculty Articles

Expressive conceptions of practical reason, morality, and law are gaining increasing currency. This article provides the first general statement of the aims and features of expressivism in law and morality. Two central themes structure the analysis. First, what precisely does it mean for action, either of individuals or collectives, such as democratic bodies, to express values? On this point, we distinguish the concept of expression from the narrower concept of communication; actions can express values, attitudes, and purposes whether or not the actor intends to communicate any specific proposition. Second, even if it is appropriate to consider the expressive dimensions …

The Thirty-Ninth Annual Edward G. Donley Memorial Lectures: The Art Of Censorship, Amy M. Adler Jan 2000

The Thirty-Ninth Annual Edward G. Donley Memorial Lectures: The Art Of Censorship, Amy M. Adler

Faculty Articles

Why has "art" been the subject of so many recent censorship attacks? The attacks on art point to an unsolved problem in First Amendment theory: how do we justify protection for art under a vision of the First Amendment that values only rational ideas and straightforward political argument? How does art - nondiscursive, non-verbal, often irrational, expression-fit into this picture? In this piece, I argue that contemporary First Amendment battles over art must be understood in light of the history of iconoclasm and the anxiety that surrounds visual, as opposed to verbal, representation. By refraining the debate in this way, …

Calcitonin Gene-Related Peptide Decreases Expression Of Hla-Dr And Cd86 By Human Dendritic Cells And Dampens Dendritic Cell-Driven T Cell- Proliferative Responses Via The Type I Calcitonin Gene-Related Peptide Receptor, John A. Carucci, Ralf Ignatius, Yang Wei Jan 2000

Calcitonin Gene-Related Peptide Decreases Expression Of Hla-Dr And Cd86 By Human Dendritic Cells And Dampens Dendritic Cell-Driven T Cell- Proliferative Responses Via The Type I Calcitonin Gene-Related Peptide Receptor, John A. Carucci, Ralf Ignatius, Yang Wei

Publications

These studies were performed to establish whether functional receptors for calcitonin gene-related peptide (CGRP) are present on human dendritic cells (DCs) and to investigate potential immunomodulatory effects of CGRP on DCs other than Langerhans cells. Reverse transcriptase-PCR revealed expression of mRNA for a type 1 CGRP receptor by mature and immature blood- derived DCs. Sequence analysis confirmed the identity of the type 1 CGRP receptor (CGRP-R1). Addition of CGRP (10-7 M) to mature and immature DCs resulted in mobilization of intracellular calcium. Treatment of immature DCs with CGRP (10-7 M), before and after maturation in monocyte-conditioned medium, resulted …
