New Technology Clauses Aren't Broad Enough: Why A New Standard Of Interpretation Must Be Adopted For Internet Distribution, Lisa A. Flate
New Technology Clauses Aren't Broad Enough: Why A New Standard Of Interpretation Must Be Adopted For Internet Distribution, Lisa A. Flate
UC Law SF Communications and Entertainment Journal
The distribution of films, specifically independent films, over the Internet often violates the distribution rights of multiterritorially distributed films created before Internet distribution was foreseeable. This article explores the history and development of Internet-distributed entertainment, what Internet distribution means to the independent film industry, how new technology clauses have been interpreted and why Internet distribution requires a fresh construction of these clauses, as well as the role technology plays in preventing problems with Internet distribution. The author poses an equitable solution to make Internet distribution possible and lucrative for all parties under United States and international copyright laws.

Soil Quality Assessment After Weed-Control Tillage In A No-Till Wheat–Fallow Cropping System, Timothy A. Kettler, Drew J. Lyon, John W. Doran, W. L. Powers, Walter W. Stroup
Department of Statistics: Faculty Publications
Adoption of reduced-tillage fallow systems in the western USA is limited by winter annual grass weeds such as downy brome (Bromus tectorum L.). Moldboard plowing is an effective means of controlling downy brome in winter wheat (Tritcum aestivum L.)–fallow systems. The purpose of this study was to assess the influence of plowing and secondary tillage operations, for the purpose of weed control, on soil quality attributes of a silt loam soil that had been cropped in a subtill or no-till (NT) winter wheat–fallow system for more than 20 yr. Compared with undisturbed NT, downy brome populations in plowed …

Modeling Fuzzy Data In Qualitative Marketing Research, Sajeev Varki, Bruce Cooil, Roland T. Rust
Modeling Fuzzy Data In Qualitative Marketing Research, Sajeev Varki, Bruce Cooil, Roland T. Rust
College of Business Faculty Publications
In marketing, qualitative data are used in theory development to investigate marketing phenomena in more depth. After qualitative data are collected, the judgment-based classification of items into categories is routinely used to summarize and communicate the information contained in the data. In this article, the authors provide marketing researchers with a method that (1) provides useful substantive information about the proportion and degree to which items belong to several categories and (2) measures the classification accuracy of the judges. The model is called the fuzzy latent class model (FLCM), because it extends Dillon and Mulani's (1984) latent class model by …

Recalibrating The Cost Of Harm Advocacy: Getting Beyond Brandenburg, S. Elizabeth Malloy, Ronald Krotoszynski Jr
Recalibrating The Cost Of Harm Advocacy: Getting Beyond Brandenburg, S. Elizabeth Malloy, Ronald Krotoszynski Jr
Faculty Articles and Other Publications
This Article explores the possibility of shifting the cost of antisocial acts to artists, writers, and musicians when individuals decide to act on a creative artist's suggestions or, in some cases, detailed directions. The Article concludes that, at least in some limited circumstances, the First Amendment should not preclude the imposition of civil liability for those who write and distribute speech that both advocates and facilitates harm to others and proposes the creation of a new category of unprotected speech activity called Harm Advocacy.

X-Rays From Orion: Identification And Cross Correlations Of Young Stars In The Orion Nebula, Erik Bergstrom
X-Rays From Orion: Identification And Cross Correlations Of Young Stars In The Orion Nebula, Erik Bergstrom
Theses
Recently formed, sun-like stars frequently display large x-ray luminosities. Therefore, x-ray observations provide a powerful means to identify newly formed stars, for the first time. The high spatial resolution of The Chandra X-ray Observatory has given us the ability to identify many stars seen in the x-ray wavelength regime for the first time also. The Orion Nebula is a very well studied region of star formation, and therefore is a good place for initial observations with Chandra. We have analyzed Chandra imaging observations of The Orion Nebula for the purposes of source detection and source identification. The visualizations of the …
Using Technology To Educate The Public, Stephen M. Johnson
Using Technology To Educate The Public, Stephen M. Johnson
Articles
While the primary focus of any law faculty will always be its law students, the Internet and other new technologies enable law teachers to assume a central role in providing free legal education to the public. Although many schools are experimenting with distance learning and computer-assisted legal educa- tion to train law students, the real power of those tools may be their potential to facilitate public access to legal information. Traditionally, educating the general public has not been a primary responsibility of law professors, but today we have not only an opportunity, but an obligation, to develop computer-based legal education …

The Short Tenure Of A Woman Superintendent: A Clash Of Gender And Politics, Margaret Grogan
The Short Tenure Of A Woman Superintendent: A Clash Of Gender And Politics, Margaret Grogan
Education Faculty Articles and Research
This article reports the two-year tenure of a woman superintendent in a small southern city. Placed against the background of local community politics and school district politics it shows that women in the superintendency still face Issues of gender stereotyping that influence the way they are perceived as leaders of school systems. A feminist poststructuralist framework is used to understand how the various subject positions available to women collide with the discourse of the superintendency. lt is recommended that women leaders resist the images that have been traditionally reserved for them and begin to reinvent the superintendency on their own …
Parents' Role In Their Children's Language Acquisition, Selina L.P. Mushi
Parents' Role In Their Children's Language Acquisition, Selina L.P. Mushi
Teacher Education Faculty Publications
A study was conducted in 32 families in Chicago, with children ranging from 18 months to 5 years, to examine the role of parents in their young children's language acquisition. Specifically investigated were parents' attitudes on language acquisition, opportunities used to prompt their youngsters to say a new word/utterance, and the utterances learned. Four instruments were used to collect data: a parents' questionnaire which provided background information on attitudes about language and languages used in the family; a word acquisition chart which documented prompts, contexts, words/utterances heard and learned in their complexity; audio-recording which provided parent-child linguistic interaction and complexity …

Genetic Diversity And Transcriptional Analysis Of The Bys1 Gene From Blastomyces Dermatitidis, James L. Bono, Basam Jaber, Mark A. Fisher, Raed O. Abuodeh, Erin O’Leary-Jepson, Gene M. Scalarone, Laurens H. Smith Jr.
Roman L. Hruska U.S. Meat Animal Research Center: Reports
Blastomyces dermatitidis, a pathogenic fungal organism, is able to exist in two differentmorphologies, a multicellular mycelium or a unicellular yeast, according to temperature, 25˚C and 37˚C respectively. The switching between morphologies must be accompanied by a cascade of signaling events in which expression of genes responsible for the change of morphology is increased or decreased. bys1, a gene from B. dermatitidis isolate #58, is expressed at high levels in the unicellular yeast, but gradually diminishes as the temperature is lowered and the organism converts to the mycelial phase where there is no transcription of bys1. We explored …

Conflict Resolution : A Counseling Skill, Carol Jean Friedmann
Conflict Resolution : A Counseling Skill, Carol Jean Friedmann
Graduate Research Papers
Conflict resolution is a counseling skill (Ivy, 1994; Haley, 1976; Pearce, 1996). Counselors are in a unique place to both promote conflict resolution skills and use counseling skills while practicing conflict resolution for longer lasting and therapeutic resolutions. Two environments in which counselors have been especially active regarding conflict resolution have been in the schools and in the family (Moore, 1996).
To take a closer look at conflict resolution, this paper will do the following: define conflict resolution; look at common attitudes and ways of handling conflict; examine the effects of destructive conflict resolution and the effects of teaching constructive …
