Estimating The Economic Value Of The Ocean In A National Income Accounting Framework, Charles S. Colgan Jul 2000

Estimating The Economic Value Of The Ocean In A National Income Accounting Framework, Charles S. Colgan

Publications

A key part of the effort to estimate the economic value of the ocean is to develop estimates of the appropriate values of the goods and services traded in the market economy. Such estimates should include the output of industries associated with the ocean, as well as other measures of economic activity, including income generated, employment, the number of firms, etc. Providing the information that permits seeing the economy of the ocean within the context of other economic activity requires preparing estimates that are consistent with the National Income and Product

Accounts (NIPA). The key component is Gross Product Originating …

Faculty Publications

On October 12-13, 2000, the U.S. Sentencing Commission sponsored its Third Symposium On Crime and Punishment in the United States: Federal Sentencing Policy for Economic Crimes and New Technology Offenses. The afternoon of the first day of the meeting was devoted to discussing the concept of “loss” as a measurement of defendant culpability and offense seriousness. The conferees were divided into small groups to discuss discrete sub-issues relating to “loss” and its place in sentencing economic crimes under the Guidelines. Following the small group discussions, the discussion leaders (“facilitators”) addressed a plenary session of the conference to report on the …

The 1% Solution: American Judges Must Enter The Internet Age, Henry H. Perritt, Ronald W. Staudt

The Journal of Appellate Practice and Process

The internet has made it easier and affordable to share information than ever before. Many legal institutions have taken advantage of this innovation by using the internet to disseminate decisions and other legal texts or for rulemaking. Most legal institutions, however, only use the internet for approximately 1% of adjudication.

The Efficacy Of Public Affairs In The Federal Courts, Jacqueline Todd Jul 2000

The Efficacy Of Public Affairs In The Federal Courts, Jacqueline Todd

Theses and Dissertations

The federal courts are undeniably one of the most important institutions in our society, yet we know little of this nebulous entity since the federal court system does not directly communicate to the public. The judiciary relies solely on the media to disseminate court decisions and information to the public.

The purpose of this study was to underscore the need for a public affairs office in the federal court system. This researcher held that a court public affairs office would serve to educate the public about the judiciary, as well as correct media accounts of court decisions that exhibit negative …

Lawyer Communications On The Internet: Beginning The Millennium With Disparate Standards, Louise L. Hill Jul 2000

Lawyer Communications On The Internet: Beginning The Millennium With Disparate Standards, Louise L. Hill

Washington Law Review

Lawyer communications on the Internet constituting commercial speech are subject to state ethics rules governing lawyer advertising and communication. Because each state operates as a separate entity with its own rules that govern the lawyers of its jurisdiction, the profession is faced with disparate standards on a jurisdictional basis. Of the forty-three states that have adopted the Model Rules of Professional Conduct, four-fifths have standards on lawyer communications that vary from those in the Model Rules. Not only is there variation in the rules themselves, but differences exist in the specific applicability and interpretation of these rules to components of …

The Attorney-Client Privilege: Practical Military Applications Of A Professional Core Value, Joshua E. Kastenberg, Norman K. Thompson

Faculty Scholarship

This article examines the historical development of the attorney-client privilege and then explores the privilege generally before tackling some specific areas where the privilege commonly arises in military practice. We explore important aspects of the privilege from three different perspectives: (1) a prosecution perspective-saving court-martial cases involving alleged compromise of attorney-client privileged material by trial counsel and/or investigators, (2) a defense perspective-using the privilege to protect information about the whereabouts of a client and the contents of a defense counsel's appointment schedule, and, (3) a general military practice perspective-the potential conflicts of interest which may arise when the privilege is …
