Korean Attitues Towards Law, Chan Jin Kim Dec 2000

Korean Attitues Towards Law, Chan Jin Kim

Washington International Law Journal

Transformation is the key word to explain the Korean attitudes towards law. In the early 1950's, nation building gave impetus to economic growth and allowed Korea to quickly pass through the preliminary stages of development. Industrialization, urbanization and eventual emigration of the populace have, in many senses, displaced the traditional social value system based on Confucianism. However, a new value system has yet to take hold. The lack of such guidelines has left Koreans in a state of confusion in a world that continues to change. The Korean Constitution clearly mandates equal protection under the laws for all Koreans. However, …

One Country, Three Systems? Judicial Review In Macau After Ng Ka Lling, Judith R. Krebs Dec 2000

One Country, Three Systems? Judicial Review In Macau After Ng Ka Lling, Judith R. Krebs

Washington International Law Journal

The Ng Ka Ling decision by the Hong Kong Court of Final Appeals and its reversal by the Standing Committee of China's National People's Congress, raise serious concerns regarding the adequacy of judicial review and the protection of the rule of law in the new special administrative regions under China's "One Country, Two Systems" approach. Judicial review lies at the forefront of this controversy because it largely delineates the contours of local autonomy and the extent to which those who experience legal violations will have remedies. This Comment explores the roots of the conflict in Hong Kong and examines whether …

Law On Communications Interception During Criminal Investigations, Yohei Suda

Washington International Law Journal

Whereas organized crime severely damages the peace and health of society, and increasingly it is extremely difficult to clarify the truth in criminal investigations without intercepting the telephone communications or other telecommunications of criminals in serious crimes committed by conspiracy, such as organized murder and unlawful trade of drugs or firearms, the purpose of this law is to set forth the requirements, procedures, and other matters that are relevant to the invasive action of intercepting telecommunications, as provided in the Code of Criminal Procedure (Law No. 131, 1948), and are essential for dealing appropriately with such crimes, in such a …

The Indian Software Industry: What Makes For Commitment, Abhoy K Ojha

IIMB Management Review

The impact of the demographic characteristics of people on their work attitudes and organisational behaviour has been of interest to organisational theorists for a long time. While some studies have examined the impact of demographic characteristics on attitudes and behaviour, others have investigated the impact of the composition of these demographic characteristics on individual attitudes and behaviour, and organisational outcomes. Against the background of these studies, a study was conducted to examine the impact of demographic characteristics of software professionals on their organisational commitment

Ownership Patterns And Corporate Performance, Jinesh Panchali Dec 2000

Ownership Patterns And Corporate Performance, Jinesh Panchali

IIMB Management Review

Corporates have emerged as vital economic institutions for growth, commanding a large proportion of social resources. Hence, they are, like the State, answerable to society for the efficient use of resources. Corporate governance is the social, legal, and economic process through which companies function and are held accountable1 . The structure of corporate ownership has a major impact on the way companies are managed and controlled. An attempt has been made here to explore ownership structure in India and abroad and to empirically analyse corporate performance in the Indian context, at various levels of ownership across ownership categories.

Vehicle Routing For Milk Procurement, Janat Shah Dec 2000

Vehicle Routing For Milk Procurement, Janat Shah

IIMB Management Review

In a typical co-operative dairy, one of the significant operating costsunder the control of the management is the cost of milk collectionand transportation. (Exhibit 1 shows the typical cost structure of adairy) The dairy under study picked up milk from 500-800 pick uppoints (nodes) twice a day. The vehicle routes were decided manu-ally keeping in mind the peak load expected at the nodes during thecoming year. The dairy had about 50 odd routes, each route cover-ing an average of 15 nodes. Usually dairies do not own the ve-hicles but use transport contractors who enter into an annual con tract with …

Yield Management In The Airline Industry, B Venkateshwara Rao Dec 2000

Yield Management In The Airline Industry, B Venkateshwara Rao

IIMB Management Review

The Airline Deregulation Act of 1978 changed the competitive landscape for air travel. The CAB allowed low-cost (nonunionised and no-frill chartered service) carriers to compete in the scheduled air travel markets. Scheduled air carriers were at a disadvantage due to their high-cost structure. For example, during the winter of 1976, passengers could travel from New York to Florida on a charter for as little as $99. This fare was less than the average cost for a scheduled carrier to fly that market.

Melting Into Air? Downsizing, Job Stability, And The Future Of Work, Sanford M. Jacoby Dec 2000

Melting Into Air? Downsizing, Job Stability, And The Future Of Work, Sanford M. Jacoby

Chicago-Kent Law Review

Contrary to popular belief, career-type employment practices remain the norm in the U.S. labor market, and employers continue to shoulder risks for employees. Evidence to support this claim is drawn from a variety of sources: data on tenure and mobility; analysis of new job creation and job quality; recent employer responses to labor-market tightness; and data on wage premiums, fringe benefits, and training. Yet employees are bearing more risk today, including risk of job loss and of compensation fluctuations. This is an important change from the past. Nevertheless, there are limits—economic, demographic, and political—to the risk-shifting process.

Don't Take His Eye, Don't Take His Tooth, And Don't Cast The First Stone: Limiting Religious Arguments In Capital Cases, John H. Blume, Sheri Lynn Johnson Dec 2000

Don't Take His Eye, Don't Take His Tooth, And Don't Cast The First Stone: Limiting Religious Arguments In Capital Cases, John H. Blume, Sheri Lynn Johnson

William & Mary Bill of Rights Journal

Professors John H. Blume and Sheri Lynn Johnson explore the occurrences of religious imagery and argument invoked by both prosecutors and defense attorneys in capital cases. Such invocation of religious imagery and argument by attorneys is not surprising, considering that the jurors who hear such arguments are making life and death decisions, and advocates, absent regulation, will resort to such emotionally compelling arguments. Also surveying judicial responses to such arguments in courts, Professors Blume and Johnson gauge the level of tolerance for such arguments in specific jurisdictions. Presenting proposed rules for prosecutors and defense counsel who wish to employ religious …

Ecogeographic Aspects Of Greater Prairie-Chicken Leks In Southeastern Nebraska, Paul A. Johnsgard Dec 2000

Ecogeographic Aspects Of Greater Prairie-Chicken Leks In Southeastern Nebraska, Paul A. Johnsgard

Papers in Ornithology

An analysis of the distribution of 104 Greater Prairie-chicken leks in Pawnee and Johnson counties indicates that the birds favor using those mile-square sections having no more than two dwellings per section, ones that are located at least two miles from the nearest town, and at least a half-mile from the nearest lek. Relationships with the nearest water were not clear, but most leks were located at least a half-mile from it, perhaps reflecting a general avoidance of heavy cover during the display season.

A Communitarian Critique Of The Child Protective System, Toni Terling-Watt Dec 2000

A Communitarian Critique Of The Child Protective System, Toni Terling-Watt

The Journal of Sociology & Social Welfare

Child Protective Services (CPS) has been defined as an ineffective system. Common criticisms are that the system is overburdened and that family preservation policy pressures CPS to reunite families that can't be repaired. However, empirical analyses that identify the deficiencies of this organization are limited. This study utilizes case files and in-depth interviews with interventionists within and outside of CPS to explore the issue. Results reveal that the most common criticisms of the system do have merit. However, it reveals additional system limitations. Results suggest that the child protective system is characterized by an individualistic approach and that this focus …

Estimating Poverty Rates In A Metropolis: The Example Of Los Angeles/Long Beach, Robert G. Mogull Dec 2000

Estimating Poverty Rates In A Metropolis: The Example Of Los Angeles/Long Beach, Robert G. Mogull

The Journal of Sociology & Social Welfare

This study develops a technique to estimate and project annual rates of poverty for a large metropolitan area for various segments of its population. The annual estimates and projections are based upon the official rates compiled by the Bureau of the Census.

Using Los Angeles/Long Beach as the site of the experimental example, the evidence reveals a substantially increasing trend in the incidence of poverty for the overall metropolitan population. This increase is caused by the dramatic rise in poverty within the Hispanic and Children population groups. Trends in poverty are negative, however, for the Elderly, Blacks, Female Family Heads …
