Toward A Pragmatic Understanding Of Status-Consciousness: The Case Of Deregulated Education, Tomiko Brown-Nagin

Duke Law Journal

This Article discusses the relationship between federal equal protection doctrine and the states' experiment with deregulated education-in particular, charter schools whose student bodies are identifiable on the basis of status. I argue that the states' experiment with deregulated education and the Supreme Court's understanding of the limitations imposed by the federal Equal Protection Clause on status-conscious state action are substantially in conflict, though not inevitably so. Reconciling state policy and federal constitutional law requires, first, that state legislatures draft laws that are consistent with the Court's skepticism of explicitly status-conscious state action, and its ambivalence toward state action that addresses …

The Rogue River is located in west central lower Michigan and is a major tributary of the Grand River. The Rogue River Watershed refers to all the land that is drained by the Rogue River. This area is 167,625 acres and includes portions of Kent, Montcalm, Muskegon, Newaygo, and Ottawa counties. The City of Rockford and Cedar Springs, and the villages of Sparta, Kent City, Sand Lake, and Casnovia are within the Rogue River Watershed boundaries. The Rogue River is fed by wetlands, county drains, lakes, and both warm and cool-cold water tributaries. The cool-cold water tributaries help to sustain …

This study was designed as a qualitative investigation and it focuses on the non-graded self-assessment adult ESL students make of their performance. It is based upon findings from previous studies of self-assessment in several settings (Glazer, 1999; Glazer et al., 1995; Optiz, 1995; Manning, 1997; Levy, 1999; Fazey, 1993; Boud, 1992; Orsmond et al., 1997; Sullivan and Hall, 1997; and Lan, 1996). The present research reports and analyzes data collected from eleven students who expressed their views concerning their performance through a checklist, two questionnaires and an interview in an ESL setting. Effects Of Pain And Fear Stimulus Intensity Levels On Pain Responding In Chronic Pain Patients, John Thomas Sorrell

Fear has been found to increase and decrease pain responding in various contexts, and the effects of fear and pain stimulus intensity levels on pain responding have not been examined. Forty chronic pain patients were exposed to an algometer pressure pain device which stimulated different fingers; there were two levels of pressure pain (i.e., high and low). Also, there were two levels of induced fear (i.e., high and low). Significant main effects of pain stimulus intensity level were found on threshold pain time, tolerance pain time, and self-reports of fear and pain. Also, a significant main effect of gender was …

The purpose of this study was to determine how West Virginian's perceive and use complementary medicine. The first objective was to determine the frequency of respondents who had used at least one complementary therapy in the last year. The second objective was to determine the most commonly used complementary therapies among respondents. The third objective was to examine the demographic characteristics of respondents who used complementary therapies. The purpose of this study was to demonstrate associations between perception of body image among women and their body image behaviors. A study was needed to determine the extent to which subjective norms, attitudes, beliefs, Body Mass Index, and self esteem were associated with body image behaviors. The target population in this study was female students at West Virginia University. Data collection was facilitated through an anonymous mailed questionnaire sent to 400 female students at West Virginia University. Speech-language pathologists and audiologists have begun using computer technology for information storage and retrieval and as one means of providing clinical services to communication-disordered patients. The purpose of this study is to develop a protocol to assess the written communication of brain-injured clients whose communication therapy milieu includes interactions with the world outside the treatment room through computer-mediated communication (CMC).;A panel of experts reviewed a series of discourse analysis procedures and rated their perceptions of validity, reliability, and ease-of use for the procedures as means of evaluating CMC discourse. This article analyzes the results of an empirical study to illustrate the effect of billable hour requirements on associate satisfaction and law firm culture. Part I briefly describes the survey design and the general profile of the survey respondents. Part II discusses current billing practices and pressures analyzing the study results related to billing expectations and guidance as well as firm culture and work alternatives. Using findings from the study, Part III considers the detrimental micro and macro effects of increasing billable hour expectations. Alzheimer's disease is a devastating illness that is common among the nursing home population. Treatment for Alzheimer's disease is usually palliative and consists of using psychotropic medications to control aggressive and agitated behaviors exhibited by its victims. The purpose of this descriptive study was to identify behaviors exhibited by Alzheimer's disease patients before and after receiving psychotropic medications. Johnson's Behavioral System Model was used as the theoretical framework for this study. The sample (N = 33) consisted of nursing home residents with a diagnosis of Alzheimer's disease who were treated with one psychotropic medication. The researcher used chart review to …

Few studies have examined gender-specific factors associated with the nonuse of condoms among homeless and runaway youths (HRYs)–a population at high risk for HIV infection. In this article, we evaluate these factors and explore gender differences in background experiences, psychosocial functioning, and risk behaviors among HRYs from four U.S. metropolitan areas. Of 879 sexually active HRYs sampled, approximately 70% reported unprotected sexual intercourse during a 6-month period, and nearly a quarter reported never using condoms in the same period. Among males and females, having only one sex partner in the previous 6 months had the strongest association with nonuse of …

Spirituality has become an increasingly important topic in healthcare and specifically in occupational therapy. Previous studies of spirituality in occupational therapy indicated that while therapists believed spirituality was important to health and rehabilitation potential, few therapists reported incorporating spirituality into treatment (Engquist, Short-DeGraff, Gliner, & Oltjenbruns, 1997; Howe, 1996; Rose, 1999). This study utilized a survey design to examine occupational therapists' current beliefs and practices regarding spirituality, as well as asking therapists to identify barriers to the use of spirituality in treatment.

The results of this study indicate that beliefs and practices regarding spirituality in occupational therapy may be changing. …

A gap has developed in the research agenda of contemporary anthropology with regard to a phenomenon which has received notable attention from research professionals in other fields, such as history and psychiatry. What has been called the "alien abduction phenomenon" has had considerable impact, not only on those who sincerely believe these events are an everyday part of human experience (called "abductees") but also on the changing tapestry of American culture. Using standards established by Lovejoy et al. (1985) to score and estimate age at death from auricular surface morphology, the auricular surfaces of 266 individuals of documented age from two different skeletal collections (Terry and Bass Donated Collections) were examined. The age, sex and race of the individuals used in the study were unknown to the investigator during analysis. This study supports the claim proposed in the original study that auricular surface morphology is unaffected by an individual's sex or race. However, this study indicates that auricular surface morphology does not change as regularly with age as was originally proposed. …

Progenics's rCD4-IgG2 (PRO-542) is a recombinant fusion protein, which has been developed using the company's Universal Antiviral Binding (UnAB) technology, and is in phase I/II clinical trials for the treatment of human immunodeficiency virus type I (HIV-1) infection [273391]. At the beginning of 1997, Progenics received a Phase II Small Business Innovation Research Program (SBIR) grant from the National Institute of Allergy and Infectious diseases (NIAID) to fund the development of PRO-542 [236048]. A further grant of $2.7 million was awarded in August 1998 for the clinical evaluation of PRO-542 and other anti-HIV therapies [294200]. Progenics is collaborating with the …
