Coverage Denials In Erisa Plans: Assessing The Federal Legislative Solution, Karen A. Jordan Apr 2000

Coverage Denials In Erisa Plans: Assessing The Federal Legislative Solution, Karen A. Jordan

Missouri Law Review

Whether patients who obtain their health coverage through private employment ought to be able to sue managed care plans for injuries resulting from coverage denials has been a significant health policy issue for years. The debate became more intense as recent judgments against major managed care plans highlighted the inequity caused by the preemption provisions in federal employment law

Partial Privatization Of Social Security: Assessing Its Effect On Women, Minorities, And Lower-Income Workers, Kathryn L. Moore Apr 2000

Partial Privatization Of Social Security: Assessing Its Effect On Women, Minorities, And Lower-Income Workers, Kathryn L. Moore

Missouri Law Review

This Article explains why partial privatization would likely have a disproportionately adverse effect on the benefits of three specific subpopulations: women, minorities, and lower-income workers. The Article focuses on these three groups principally because they are at a heightened risk of poverty in old age.' Since one of the fundamental purposes of Social Security is to provide for progressive redistribution to lift the elderly out of poverty, policymakers should be (and are)' concerned with how Social Security reform would likely affect these subpopulations.' Of course, not all women and minorities are at heightened risk of poverty in old age.' s …

Population-Based Survey Of Complementary And Alternative Medicine Usage, Patient Satisfaction, And Physician Involvement, Robert Oldendick, Ann L. Coker, Darryl Wieland, James I. Raymond, Janice C. Probst, Bruce J. Schell, Carleen H. Stopskopf

CRVAW Faculty Journal Articles

Background. With an increasing proportion of Americans using complementary or alternative medicine (CAM), physicians need to know which patients are using CAM to effectively manage care.

Methods. In this cross-sectional study, telephone interviews were conducted with 1,584 South Carolina adults (ages 18 and older); 66% responded to the survey of demographics, general health, frequency of CAM use, perceived CAM effectiveness, and physician knowledge of CAM use.

Results. A total of 44% had used a CAM during the past year. Increasing age and higher education were significantly associated with CAM use. More than 60% perceived CAM therapy as very effective, and …

Mental Health Parity: National And State Perspectives 2000: A Report To The Florida Legislature, Bruce Lubotsky Levin, Ardis Hanson, Richard D. Coe, Sara A. Kuppin Apr 2000

Mental Health Parity: National And State Perspectives 2000: A Report To The Florida Legislature, Bruce Lubotsky Levin, Ardis Hanson, Richard D. Coe, Sara A. Kuppin

Dean's Office Publications

By failing to appropriately treat adults and children with severe mental illness, we incur enormous social costs through payments for disability benefits (Medicaid, SSI, SSDI), increased medical expenses, accidents and suicides, avoidable criminal justice proceedings, lost productivity, and increased need for homeless shelters and services. People who are underinsured are forced by arbitrary caps and limits to increasingly rely on the public sector. By providing parity for mental health, Florida will bring mental health into the mainstream of health care and become a leader in dispelling the prejudice that surrounds treatment of persons with severe mental illness.

The Search For A Distinct Religious-Liberty Jurisprudence Under The Washington State Constitution, Katie Hosford Apr 2000

The Search For A Distinct Religious-Liberty Jurisprudence Under The Washington State Constitution, Katie Hosford

Washington Law Review

Article I, Section 11, of the Washington Constitution, titled "Religious Freedom," provides more protection for free exercise of religion and the separation of church and state than the First Amendment to the U.S. Constitution. Because the state constitution provides broader protection for each right, a natural tension arises between the two rights. However, rather than relying on the text of the state constitution, the Supreme Court of Washington has imposed an entirely federal analysis on free exercise cases brought under Washington law. In addition, the establishment cases under Article I, Section 11, have inconsistently interpreted the language of the state …

Executive Privilege: The Clinton Administration In The Courts, Neil Kinkopf Apr 2000

Executive Privilege: The Clinton Administration In The Courts, Neil Kinkopf

William & Mary Bill of Rights Journal

Exploring the role of the judicial branch of the federal government in Clinton-era executive privilege claims, Neil Kinkopf suggests that courts have misunderstood executive privilege. Professor Kinkopf points out that federal courts have given different treatment to executive privilege claims asserted in judicial and congressional arenas, protecting the Judiciary from encroachment by the executive branch, while avoiding becoming involved in controversies among the political branches. He argues that the judicial confusion about executive privilege stems from the fact that courts have interpreted cases such as Clinton v. Jones to be about the separation of powers between the executive and judicial …

Liberal Education And The Challenge Of Intergrative Learning, Bernice Braid Apr 2000

Liberal Education And The Challenge Of Intergrative Learning, Bernice Braid

Journal of the National Collegiate Honors Council Online Archive

The 1990 publication of Ernest Boyer's Scholarship Reconsidered was a benchmark occasion. Almost immediately the academy endorsed his document's usefulness as a framework within which to examine, maybe rethink, practices of both institutions and individuals which appeared to reflect a riven enterprise. Boyer's perception that exclusive emphasis on "scholarship" for status and rewards in American colleges was, as the term remained narrowly defined, incompatible with the demands of proliferation and access, and it struck a chord.

An Nih- And Nsf -Funded Program In Biological Research For Community College Students, Thomas P. Arnold, Frances A. Frierson, Neil Sebacher Jr.

Journal of the National Collegiate Honors Council Online Archive

In a program supported by grants from the National Institutes of Health and the National Science Foundation, selected students in biology courses at Valencia Community College actively pursue the scientific method in a series of laboratory exercises. Results are then published as reports written in the format of a scientific paper. Faculty from the disciplines of biology and English composition evaluate students' work. Students are required to collaborate and present findings as if they are researchers. Students interested in science careers can subsequently enroll in a research training course, upon completion of which they are eligible for a summer internship …

Leading A College As A Liberal Arts Practice, Leon Malan, Judith Muyskens, Anne Ponder, Ann Page Stecker Apr 2000

Leading A College As A Liberal Arts Practice, Leon Malan, Judith Muyskens, Anne Ponder, Ann Page Stecker

Journal of the National Collegiate Honors Council Online Archive

A common and rather prevalent model for leading and planning in higher education is a contest of wills optimizing local, current matters. In contrast, at Colby-Sawyer College, we are explicit, careful, and collaborative about working together respectfully on qualitative and institutional and long-term matters. We hope that the model for leadership that we have provided below, one that demonstrates how we make our decisions and conduct our business in a style that differs from academic political business as usual, will serve as a model for other institutions.
