Expanding The Use Of Environmental Trading Programs Into New Areas Of Environmental Regulation, Richard E. Ayres

Pace Environmental Law Review

This article identifies the fundamental policy issues that must be dealt with in designing market-based pollution control systems. Market- based pollution control systems are now well established in America air and water pollution control programs. So far, however, the benefits of such systems have been limited by the unease of regulators and others about quality assurance, environmental justice, and other design issues. In order to realize the full potential benefits of market-based programs these issues must be addressed as part of the program design.

Using Hypermedia And Multimedia To Promote Project-Based Learning Of At-Risk High School Students, Tracy Carr, Asha K. Jitendra

The term at-risk in this article refers to those students who are in danger of dropping out of school (Rodriguez, 199i). Often, these students have low self-esteem resulting from persistently low academic achievement. One possible reason for academic failure is a mismatch between the student's needs and the curricular expectations. Consequently, it is important to plan to meet individual student needs appropriately and minimize the rate of dropouts. Planning more appropriately requires individualization of goals and curricula.

Building Global Democracy, Anne-Marie Slaughter

Chicago Journal of International Law

Instead of disengaging from international institutions, the United States must work within them more equitably and effectively. Bolton's insistence on protecting a narrow and outdated conception of sovereignty will only undermine US power and ability to pursue its interests, including the advancement of its most fundamental values. At the same time, however, the United States should take the lead in designing a new generation of international institutions and redesigning old ones to ensure that they include multiple mechanisms for ensuring popular participation. To date, efforts to encourage such participation have focused on ensuring access and input from non-governmental organizations ("NGOs"). …

In the long run, the most important tensions between Europe and the United States may not derive from differing policies toward Russia, or China, or the Middle East. The most important issues may arise over something that is fundamental to the European Union's own structure and legitimacy-namely, its systematic program of eroding or reconfiguring national sovereignty. This EU posture has many practical ramifications for US policy. But it also presents a clear ideological alternative. Sovereignty And Multilateralism, Kal Raustiala

Chicago Journal of International Law

In the remainder of this essay I explore several issues raised by the linkages between sovereignty and multilateralism. In Part II, I critique McGinnis' positive claims about multilateral cooperation, and his attempt to normatively distinguish international trade law from other forms of multilateralism. Part III then inquires into the nature of the "democracy problem" in international law. I argue that a focus on the substance of international legal agreements is not compelling. I present a basic framework for analysis of the democracy problem, and use it to suggest a better approach, which instead focuses on the structure and process of …
