Originalism is the theory of constitutional interpretation that holds that the meaning of the various provisions of the Constitution was fixed at the moment of their adoption, and that the goal of interpretation is to recover that historical meaning and apply it to current disputes. No subject of current constitutional controversy is more closely tied to originalist theories of interpretation than the debate over the meaning of the Second Amendment. Why Should Gang Membership Be A Status Symbol? Status Crimes And City Of Chicago V. Youkhana, Mark D. Brookstein

In City of Chicago v. Morales, the Supreme Court struck down Chicago's anti-gang loitering ordinance on void-for-vagueness grounds. As a result, the Court did not answer the question left open by the Illinois Court of Appeals in City of Chicago v. Youkhana of whether the ordinance criminalized the status of being a gang member in violation of the Eighth Amendment's prohibition against cruel and unusual punishment. This Comment considers the question by examining the historical backdrop of status offenses as it relates to both constitutional and common law precedent. Telling Stories About Cases And Clients: The Ethics Of Narrative, Binny Miller

In recent years, narrative has achieved great prominence in legal scholarship and in much other academic work, although the concept is not new. The legal realists always have emphasized the importance of stories; as long ago as 1941, Karl Llewellyn published case studies of the Cheyenne and their dispute settlement practices. In step with the popularity of narrative in legal scholarship, stories about the individuals behind the legal doctrine are increasingly common. While the terms "narrative" and "story" are sometimes used interchangeably, they are not quite the same thing.

Outcomes, Reasons, And Equality, Christopher J. Peters

In this article, Christopher Peters responds to arguments made by Kenneth Simons in The Logic of Egalitarian Norms, 80 B.U. L. REV. 693 (2000), in which Professor Simons defends the normative value of equal treatment against Peters’s earlier critiques. Peters first explains and justifies his attack on deontological rather than consequentialist motivations for equal treatment. He then articulates a difference between two distinct conceptions of “treatment”: an outcome-focused and an holistic conception. Peters argues that the holistic conception must be accepted by anyone who defends a deontological theory of equality. Peters then explains how certain of Simons’s arguments in defense …

Independence And The Director Of Public Prosecutions: The Marshall Inquiry And Beyond, Philip C. Stenning

Dalhousie Law Journal

The author describes the reforms to the prosecution system in Nova Scotia which were recommended by the Marshall Inquiry in its 1989 report, and reviews the extent to which they have been effectively implemented during the ensuing decade. He concludes that many of the objectives originally identified by the Marshall Inquiry in this respect have been substantially met, but that in some areas there is still room for improvement. Finally, he notes the absence of systematic evaluations of prosecutorial institutions and practices in Canadian jurisdictions, and that because of this, it is difficult to say whether the Marshall Inquiry's objectives …

Individuals with disabilities are one of the fastest-growing segments of United States society. In 1970, 11.7% of the United States population was limited in activity, a major factor in measuring and identifying people with disabilities. In 1990, because of the aging of America, 13.7 % of the population could be so identified. By 1994, 15% of the population fell into this group. During this latter period, the older population stayed fairly stable but children and younger adults with disabilities increased greatly. This study compares and contrasts InfoTrac and ProQuest primarily as full-text resources to supplement retrieval of references contained in the CINAHL database. These databases are analyzed by examining their scope in terms of the number and types of serials covered within specific areas using Ulrich's subject headings. Another important aspect of this study relates to the effectiveness of the two search engines for end-user retrieval and collection development.

This paper has three objectives designed to support the work of practice systems, scholars, and policy makers. First, it provides a conceptual model that supports a multidisciplinary, multicultural, collaborative university-community research, service, and teaching group that is consistent with the philosophy, mission, and objectives of land grant institutions and community systems. Second, it describes how the Latino Research Initiative implemented this collaborative model to support the goals of the university and the community to enhance the lives of Latinos in Lincoln, Nebraska. The purpose of this attractively produced book, a 125th anniversary project of the Winnipeg Chamber of Commerce, is to celebrate the city at the threshold of the new millennium. Its author, a business writer for a local newspaper, is supported by a collaborative team that includes two writer-reporters and two photographers.
