Now that we have lived through one of the most unusual events in American history-the impeachment and trial of the President of the United States-it is appropriate, indeed essential, that we assess how the process worked and learn what we can from it. Abortions Of The Parental Prerogatives Of Unwed Natural Fathers: Deterring Lost Paternity, Jeffrey A. Parness

A natural father's biological relationship with his child is often insufficient by itself to trigger the father's parental rights recognized within the "substantial protection" of the Due Process Clause of the Fourteenth Amendment or within comparable protections afforded by other federal or state laws. Rather, there is often required "an actual relationship" involving the assumption of parental responsibility, at least where there is no legal presumption of paternity or a certain affirmative act by an alleged natural father, like acknowledging paternity voluntarily. Cellular Release Of And Response To Atp As Key Determinants Of The Set-Point Of Signal Transduction Pathways, Rennolds S. Ostrom, Caroline Gregorian, Paul A. Insel

The determinants of “basal” activity of signaling pathways regulating cellular responses are poorly defined. One possibility is that cells release factors to establish the set-point of such pathways. Here we show that treatment of Madin-Darby canine kidney cells with the nucleotidase apyrase decreases basal arachidonic acid release and cAMP production 30–40% and that inhibitors of P2Y receptor action also affect basal and forskolin-stimulated cAMP accumulation. Changing medium prominently increases extracellular levels of ATP in Madin-Darby canine kidney, COS-7, and HEK-293 cells. Mechanical stimulation of ATP release likely occurs in virtually every experimental protocol with cultured cells, implicating such release and …

The present study was designed to investigate the effect of actinomycin D, a transcription inhibitor, and cycloheximide, a translation inhibitor, on the delayed cardioprotective effect of ischemic preconditioning. Left thoracotomy was performed in anaesthetized rats at 4th/5th intercostal space and polypropylene suture (5-0) was employed to occlude left common coronary artery. Ischemic preconditioning was produced by four episodes of 5 min of coronary artery occlusion followed by 5 min of reperfusion and thoracic cavity was sutured. Novel Approaches For Designing 5'-O-Ester Prodrugs Of 3'-Azido-2'3'-Dideoxythymidine (Azt), Keykavous Parang, Leonard I. Wiebe, Edward E. Knaus

3'-Azido-2'3'-dideoxythymidine (AZT, 1, zidovudine, RetrovirTM) is used to treat patients with human immunodeficiency virus (HIV) infection. AZT, after conversion to AZT-5'-triphosphate (AZT-TP) by cellular enzymes, inhibits HIV-reverse transcriptase (HIV-RT). The major clinical limitations of AZT are due to clinical toxicities that include bone marrow suppression, hepatic abnormalities and myopathy, absolute dependence on host cell kinase-mediated activation which leads to low activity, limited brain uptake, a sort half-life of about one hour in plasma that dictates frequent administration to maintain therapeutic drug levels, low potential for metabolic activation and/or high susceptibility to catabolism, and the rapid development of resistance by HIV-1. …

The Continuing Tobacco War: State And Local Tobacco Control In Washington, Alan E. Scott

This Article examines Washington's exemplary tobacco control efforts in the context of the larger, historical struggle to regulate tobacco. The Article begins in Part II with a brief description of the history of tobacco regulation in the United States. Part III examines the Master Settlement Agreement and its weaknesses. Part IV discusses the preference for local government regulation and the obstacles encountered. Part V examines the scope of legal authority of Washington's local governments to enact tobacco control measures, and Part VI describes Washington's tobacco control measures and the interplay between local, state, and federal laws.

This Article will first discuss the legal importance of challenging sodomy laws, even though those laws are rarely enforced. It will then discuss the importance of incorporating international and comparative law in formulating these challenges. In Section II, Professor Charlene Smith will discuss past and future strategies, focusing on the topics of equal protection, morality, and the difference (or lack thereof) between acts and status. In Section III, Professor Jim Wilets will explore incorporating international and comparative law into domestic challenges to U.S. sodomy laws. This article discusses the first two social rights cases to go to the Constitutional Court under the 1996 Constitution. Soobramoney v Minister of Health, KwaZulu-Natal 1998 (I) SA 765 (CC) involved a claim ofa breach of the right to health care brought by one person pursuant to s 27 of the Bill of Rights. Grootboom v Oostenburg Municipality 2000 (3) BCLR 277 (C) involves a claim of breaches of rights to housing or shelter brought by some 900 persons under ss 26 and 28. Distance Perception: A Comparison Of In-Class And Distance-Learning Psychology Of Perception Classes, Greg C. Elvers, Donald J. Polzella

Fifty students were randomly assigned to take a perception class either in a traditional lecture or in a distance-learning format in which the students attended class only to take tests. The results failed to suggest that the students in the distance-learning condition performed differently in the course than the lecture students. There were differences in what the distance-learning and the lecture students found useful and what they disliked about the course. These findings could be used to help design better distance-learning courses.

Does Activity Choice Matter? The Relation Between Activity Choice And Adolescent Emotional Wll-Being, A. M. Schubbe

While involvement in activities generally enhances academic achievement and psychological health in adolescents, it can also have negative affects on certain groups of students. This study examines the relations between adolescents' activity choices (math, English, sports, and music) and emotional well-being indicators (happiness, anxiety, depression, resilience, and self-esteem). Specifically, the different activities adolescents believe they are best at are explored in relation to self-reported well being. In addition, the self-concept of ability in all four activities was assessed at the beginning and end of a four-year period. High self-concept of ability in any of these domains appears to be a …

This article outlines the development of the tort of bad faith as it applies to insurance in Montana ending with particular attention to the issue of the existence now of bad faith tort outside the Unfair Claim Settlement Practices Act. The article concludes that the tort of insurance bad faith and the attendant potential for punitive damages are potent weapons in the fight to make insurance companies honor their promises and duties to claimants and insureds.

This article explores some of the law that will control issues encountered in pursuing payment of medical expenses under insurance policies and programs. The article concludes that attorneys must analyze the situation in light of statutes and case law and utilize useful techniques for avoiding the insurer's subrogation, offsets and limitations when making claims to secure payment of medical expenses.

Over one billion tons of animal waste is produced each year in the United States by animal feedlot operations (AFOs). In 1995 alone, 63.5 million gallons of manure spilled from AFOs. Manure spills poison rivers, lakes, and ponds, seep into groundwater, causing fishkills, human disease, and death. The United States Environmental Protection Agency, reports that AFOs are a primary factor in the impairment of forty percent of the nation's waterways. Despite these conditions, there are no federal standards for the storage, application, or management of animal waste. An Insider's Perspective: The Dropout Challenge For Canada's First Nations, Patricia Ann Makokis Edd

This modified case study honors the voices of 21 Cree participants, including nine students, six parents, four community leaders and two Elders. This study, written from an insider's perspective, identified more than 50 reasons why First Nations students dropped out of three provincial high schools located in northern Alberta, Canada. The results were collapsed into several categories that can best be generalized as resulting from the effects of colonization. Canada's First Nations have a long history of oppression, colonization, and the resultant soul wounds. The Effect Of Leadership Behaviors On Employee Commitment, Satisfaction, And Strength Of Culture, Robert I. Bonar

This study examines the link between leadership behaviors and employee commitment, satisfaction and strength of culture in hospitals. The subjects were five executives in not-for-profit hospitals that had measured the culture of their hospitals with the same instrument twice over a longitudinal period of time. During the intervening period the leadership of the hospital had undertaken particular interventions in an effort to improve employee commitment, satisfaction, and strength of the culture. The assessment scores were collected for each of the hospitals, and the leaders were then interviewed using a semi-structured interviewing technique with an interview guideline to determine exactly what …

Ceramic studies can establish a cultures values, beliefs, way of life, artistic development, level of technology, trade, extent of influence, diet and health, dates, and religious doctrine. The examination of eight ceramic styles and their cultures helps to illustrate the importance of ceramics in the field of archaeology. The recreation of these eight styles aids in linking the modern ceramic artist with his or her global artistic predecessors and aids in examining the significance of ceramics in archaeology.
