All Together Now: Legal Responses To The Introduction Of Aquatic Nuisance Species In Washington Through Ballast Water, Jason R. Hamilton Jan 2000

All Together Now: Legal Responses To The Introduction Of Aquatic Nuisance Species In Washington Through Ballast Water, Jason R. Hamilton

Washington Law Review

Aquatic nuisance species (ANS) are a substantial threat to the global environment, causing harm to ecosystems and costing U.S. industry billions of dollars per year. To combat ANS, legal regimes are being established on the international, federal, and state levels. In some western states, advocates have proposed legislation that is more stringent than the international and federal legal regimes' voluntary ballast-water-exchange regulations. This Comment argues that Washington and the United States should remain in conformity with the international legal regime and should not enact regulations calling for mandatory ballast water-exchange at this time. Instead, the U.S. Coast Guard should strengthen …

Rico Rights For Erisa Wrongs: Can Plaintiffs Find Relief Despite Erisa Preemption Of State-Law Claims?, Alan R. Ross

Washington Law Review

The Employee Retirement Income Security Act of 1974 (ERISA) preempts state laws that relate to employee benefit plans and allows only equitable relief for those who are injured by decisions of ERISA plan administrators. Even though the interpretation of ERISA's preemptive power has changed since 1974, ERISA still poses a significant challenge to plaintiffs in actions for damages against plan administrators. This Comment suggests that another federal law, the Racketeer Influenced and Corrupt Organizations Act (RICO), which is explicitly not preempted by ERISA, may provide relief. The challenges that a plaintiff bringing an action against plan administrators may face include …

An Intelligent Data Mining System To Detect Health Care Fraud, Guisseppi A. Forgionne, Aryya Gangopadhyay, Monica Adya

Management Faculty Research and Publications

The chapter begins with an overview of the types of healthcare fraud. Next, there is a brief discussion of issues with the current fraud detection approaches. The chapter then develops information technology based approaches and illustrates how these technologies can improve current practice. Finally, there is a summary of the major findings and the implications for healthcare practice.

Kinetics And Mechanisms Of Macromolecular Disposition In The Rat Lung, Masahiro Sakagami Jan 2000

Kinetics And Mechanisms Of Macromolecular Disposition In The Rat Lung, Masahiro Sakagami

Theses and Dissertations

The kinetics and mechanisms of macromclecular absorption from the airways of the rat lung were studied in vivo and in vitro, following identical solute administration methods. The isolated perfused rat lung (IPRL) was used as an in vitro model, and the disposition of 7.4 and 4.3 kDa fluorophore-labeled polyhydroxyethylaspartamide (F-PHEA) and other small and macromolecular reference solutes was investigated across doses and in the presence of a variety of biochemical inhibitors.

Absorption profiles of F-PHEA, and the solute's lung distribution at different times after administration, were statistically identical in vivo and in vitro, showing that the IPRL possessed a viable …

The Effect Of Two States Of Hydration On Muscular Endurance In Men, Melissa L. Petrucci Jan 2000

The Effect Of Two States Of Hydration On Muscular Endurance In Men, Melissa L. Petrucci

Masters Theses

The purpose of this study was to investigate the effects of two states of hydration has an effect on muscular endurance in men. Two groups of four men randomly assigned to each group participated in both states of hydration. Both groups were tested at baseline for height, weight, intra- and extra-cellular water, total body water, and a one-repetition maximum strength test. Subjects were then tested after a 24 hour period of water deprivation, and after a 24 hour period of normal water intake (8 ten oz glasses of water). A urine specific gravity test, intra- and extra-cellular water, total body …

A Component Analysis Of Nondirective Play Therapy, Jane E. Wilson Jan 2000

A Component Analysis Of Nondirective Play Therapy, Jane E. Wilson

Masters Theses

We evaluated the effects of nondirective play therapy on the inappropriate play of three developmentally normal children with conduct problems . Specifically, we examined the effects of attention (contingent vs noncontingent) and the play environment (enriched vs impoverished) using a reversal design. Our goal was to isolate one of these two variables as the primary effective component of nondirective play therapy for a particular child. For two subjects, attention remained contingent upon inappropriate play across conditions and the play environment was manipulated. Inappropriate play increased for one of these participants in an impoverished environment. For the third participant, an actual …

Studies On The Role Creb As A Mediator Of Neurotrophin-3 Actions In Oligodendrocytes, Jamie Richard Johnson Jan 2000

Studies On The Role Creb As A Mediator Of Neurotrophin-3 Actions In Oligodendrocytes, Jamie Richard Johnson

Theses and Dissertations

In the central nervous system (CNS), oligodendrocytes (OLGs) are the cells responsible for producing the myelin membrane which allows for the saltatory conduction of neuronal impulses. We have previously shown that CREB (cAMP response element binding protein), a transcription factor that belongs to a large family bZip (basic leucine zipper) proteins, could be a mediator of neuronal signals that, coupled to different signal transduction pathways, may play different regulatory roles at specific stages of oligodendrocyte development. We have found before that, in committed OLGs, CREB activation by phosphorylation can be triggered by β-adrenergic stimulation and appears to play a role …

Rethinking The Place Of The Practicum In Teacher Education., Ralph Blunden Jan 2000

Rethinking The Place Of The Practicum In Teacher Education., Ralph Blunden

Australian Journal of Teacher Education

This paper draws on the author’s 25 years of experience in teacher education and on a number of course evaluation questionnaires administered over the last three years to students in the one-year full time Graduate Diploma of Vocational Education and Training (and its predecessors) at the University of Melbourne. It is argued that the bifurcation between practice and theory (and theory and practice), between teaching and training experience and thinking about such experience within theoretical frameworks is a division that should be sequentially organised rather than concurrent as in most initial teacher education programs. It is claimed that data from …
