Meaning And Motive In The Law Of Homicide (Reviewing Samuel H. Pillsbury, Judging Evil: Rethinking The Law Of Murder And Manslaughter), Guyora Binder Jan 2000

Meaning And Motive In The Law Of Homicide (Reviewing Samuel H. Pillsbury, Judging Evil: Rethinking The Law Of Murder And Manslaughter), Guyora Binder

Book Reviews

Many criminal law scholars have criticized the Model Penal Code’s restrictive conception of culpability as awareness of risk, and have sought to incorporate motives and desires into culpoability analysis. In his excellent book Judging Evil, Samuel Pillsbury has applied this richer conception of culpability to homicide law. The result is a comprehensive theory of homicide liability, unified by an effort to predicate liability on deficient moral reasoning rather than merely awareness of risk. This review essay explicates and commends Pillsbury’s theory but also criticizes one crucial deficiency. Pillsbury shrinks from one of the most obvious but potentially most controversial implications …

Asian American Coping Attitudes, Sources, And Practices: Implications For Indigenous Counseling Strategies, Christine J. Yeh, Yu-Wei Wang

School of Education Faculty Research

Coping attitudes, sources, and practices were assessed within and across a sample of Asian American college and graduate students from four ethnic groups: Chinese, Korean, Filipino, and Indian (N = 470). We found that Asian Americans tended to endorse coping sources and practices that emphasized talking with familial and social relations rather than professionals such as counselors and doctors. Korean Americans were significantly more likely to cope with problems by engaging in religious activities. Counseling implications are discussed.

Nuclear Testing Rocks The Sub-Continent: Can International Law Halt The Impending Nuclear Conflict Between India And Pakistan, Grant Guthrie

UC Law SF International Law Review

The nuclear tests conducted by India and Pakistan in 1998 have given rise to a concern that the historic conflict over Kashmir might suddenly erupt into a war involving nuclear weapons.

This Note evaluates the relationship between the testing and the development of nuclear weapons under international law. It analyzes two aspects of international law that prohibit the future testing and development of nuclear weapons: (1) customary international law and (2) traditional and new customary international environmental law. This Note concludes by pointing out that the nations that will acquire nuclear capabilities in the near future may not have the …

Breaking The Federal/State Impasse Over Medical Marijuana: A Proposal, Marsha N. Cohen

UC Law SF Journal on Gender and Justice

California's Proposition 215 legalizes the medical use of marijuana. Since its passage, the State of California and the federal government have been engaged in legal skirmishing over its implementation. In this policy commentary, Professor Cohen describes the current legal status of medical marijuana and the current scientific views about its efficacy for various medical purposes. She appeals to California's Governor Gray Davis to break the costly legal impasse between federal and state governments over medical marijuana. She proposes that the Governor support the scientific efforts needed to determine whether, and for what, marijuana is good medicine. Further, the Governor should …

The Necessary Application Of The Contract Clause To Cases Involving Restrictive Covenants And Group Famiy Day Care Homes, Heidi Marie Flinn

Fordham Urban Law Journal

This Note argues that courts should apply the Contract Clause analysis that is set for by the Supreme Court in Energy Reserves to all home based day care cases regardless of whether it is state legislative or judicial action that prevents enforcement of a restrictive covenant. It begins by explaining the background of restrictive covenants as they apply to group homes and outlines Contract Clause analysis in relation to restrictive covenants. Additionally, this Note explores the Fair Housing Act and how it is becoming the best tool to litigate cases involving covenants and group homes for the mentally ill, but …
