Combating Copyright Infringement In Russia: A Comprehensive Approach For Western Plaintiffs, David E. Miller

Vanderbilt Journal of Transnational Law

This Article addresses several measures that U.S. and European firms can undertake to combat copyright infringing activities in Russia. First, the Article attempts to dispel the notion that Russian law and the Russian government are inadequate to deal with copyright and piracy problems. In fact, recent surveys suggest that foreign plaintffs have achieved some success in arbitrazh courts. Furthermore, Russian authorities have begun to take steps to ensure that these decisions will be enforced.

Second, the Author suggests that the United States and European nations can apply pressure on the Russian Federation to ensure compliance with copyright laws in the …

1. Adult tiger beetles of the genus Cicindela often co-occur within a habitat but larvae do not. Larvae are sedentary and form usually permanent burrows at the site of oviposition where they require 1-3 years for development.

2. To test niche partitioning based on ovipositional preference, the behavior of two sympatric salt marsh tiger beetles, Cicindela circumpicta and C. togata (Coleoptera: Cicindelidae), were examined.

3. In laboratory studies, female C. circumpicta and C. togata distinguished between experimental salinities, with the former preferring 4 parts per thousand (ppt) and the latter preferring 12 ppt. In the field, C. circumpicta larvae were …

Social scientists have come to understand that society is a set of integrated values, beliefs, institutions, technology, and ecological systems as explicitly laid out in Figure 1 (Hayden 1988, 1997). Societal integration and organization takes place through the on—going processing of overlapping institutions and their organizations. Geochemical And Mineralogical Evidence From Eolian Sediments For Northwesterly Mid-Holocene Paleowinds, Central Kansas, Usa, Alan F. Arbogast, Daniel R. Muhs

A prominent (4500 km2) dune field in the Great Plains is the Great Bend Sand Prairie of south-central Kansas. Dunes here overlie late Quaternary alluvium and were reactivated extensively in the late Holocene. Geomorphic and soil evidence suggests that the most likely eolian sand source is the Arkansas River valley to the northwest. Nevertheless, orientations of stabilized dunes indicate that the most recent dune-forming winds came from the south or southwest, in agreement with modern wind data.

Ascaridoid nematodes parasitize the gastrointestinal tract of vertebrate definitive hosts and are represented by more than 50 described genera. We used 582 nucleotides (83% of the coding sequence) of the mitochondrial gene cytochrome oxidase subunit 2, in combination with published small- and large-subunit nuclear rDNA sequences (2,557 characters) and morphological data (20 characters), to produce a phylogenetic hypothesis for representatives of this superfamily. This combined evidence phylogeny strongly supported clades that, with 1 exception, were consistent with Fagerholm’s 1991 classification. A widening variety of applications is diversifying geomorphometry (digital terrain modelling), the quantitative study of topography. An amalgam of earth science, mathematics, engineering and computer science, the discipline has been revolutionized by the computer manipulation of gridded terrain heights, or digital elevation models (DEMs). Its rapid expansion continues. This article reviews the remarkable diversity of recent morphometric work in 15 selected topics and discusses their significance and prospects. Margaret Goldblatt, who died on June 15, 2000, in Cape Town, South Africa, after a year-long battle with cancer, was a rare combination of librarian and entrepreneur. She had both a sense of humor and a sense of professionalism that endeared her to those who knew her. Many of her colleagues knew her only through telephone and e-mail communications, for she worked the last several years from the office of Ward and Associates, located in the home she shared with her husband Peter Ward and her two children, Clea Goldblatt, age 21, and Zachary Ward, age 11.

The thesis addresses the post-glacial development of the Niagara Cuesta between Hamilton and Collingwood. Conventional thinking on the escarpment during the Holocene suggests that the present morphology developed rapidly following deglaciation due to periglacial processes (Straw, 1966/Tovell 1992). The disruption of the preglacial drainage pattern by drift has meant the escarpment has not been subject to extensive fluvial action along its base, resulting in an extremely slow rate of retreat (Bird, 1980). The concept that the escarpment is a relict feature therefore pervades the modem literature. The apparent motion of the blocks at the face of the escarpment (Hintz, I997) …

Wine tourism is an expanding form of rural tourism which has recently become popular in several wine regions of the world One such area, the Niagara Region in southern Ontario, Canada, is used as a case study for this research. This study examines the role that wine tourism plays in sustainable rural tourism, and determines if wine tourism can be used as a tool for economic development. Agricultural practices may result in nitrate losses, diminished surface water quality and widespread groundwater aquifer contamination. Many works have identified preferential flow through macropores as an important feature that may increase nitrate losses. Subsurface drainage collectors may intercept preferential flow and indicate changing unsaturated/saturated processes. Antecedent conditions are important in determining runoff response. It is unclear how tile drains modify the antecedent soil moisture regime and water tables in near stream areas. Vegetated riparian buffer zones found beetween agricultural fields and watercourses may attenuate nitrate in shallow groundwater pathways. A significant change occurred in the spatial pattern of Ontario’s distilling industry during the second half of the nineteenth century. Around 1850 there were approximately 150 distilleries and, by 1871, there were only 19. The industry went from numerous small, local distilleries to a few large industrial enterprizes. This thesis examines the Las Vegas - Clark County Library District over the five year period from 1991 to 1995. Based on interviews, local media coverage and budgetary data, the work traces the development of the library district during its most turbulent times. As a case study of special districts or "functional feudalities", the Las Vegas - Clark County Library District provides an excellent microcosm for understanding competing elites, interest group politics, budgetary problems, and public perception as determinants of policy made by a non-elected governing board.

Applying the Christian principles of depraved human nature, expectation of detrimental behavior from irrational actors, and rational attempts to limit the destructiveness of war, Augustine would conclude that the declared nuclear weapons states have a moral obligation to prevent proliferation of nuclear weapons. Laws suitable to the needs of the times are the appropriate method for accomplishing this. The pending Comprehensive Test Ban Treaty (CTBT) is one such law. The Chumash plank canoe or tomol, was an important part of the maritime subsistence pattern of the Chumash as well as an important element in the maintenance of a complex heirarchical socio-political structure. The placement in time of the origin of the tomol is critical to many models of culture change and cultural ecology in the Santa Barbara Channel area. The assemblage of artifacts and features at CA-SBa-52 on the Goleta Slough adds to the body of data regarding the development of the tomol and indicates that it may have had a longer history in the area than previously suspected.

A model for ground settlement and swelling occurring in Las Vegas Spring Preserve due to groundwater level changes has been developed. A FORTRAN code that uses the finite element method has been prepared. The computer code calculates the hydraulic head in the aquifer resulting from pumping and recharging of the Wells The settlement or swelling of the ground level at each node point is calculated based on hydraulic conditions. The purpose of this descriptive correlational study was to investigate health-promoting lifestyle practices and correlate these to self identified factors that may limit health promotion activity of frontier rural elders living in Nevada. Pender's Health Promotion Model provided the theoretical framework for this study. The sample included 114 participants that were aged 65 and older from locations in Nevada counties that qualify as frontier (population less than 6/square mile). Participants completed a two part self-administered questionnaire, the Health-Promotion Lifestyle Profile II (HPLP II) and the revised Elderly Health Care Needs Questionnaire (EHCNQ). This study investigates the biological and economic consequences of modifying the species selectivity properties of fishing gears in a multispecies context. The objective is to examine whether modifying the species selectivity properties can contribute to rebuild overexploited stocks. To meet this objective, conceptual and empirical bioeconomic models were constructed. The conceptual model was used to investigate the qualitative impacts and the empirical model was used to derive the quantitative impacts of modifying the species selectivity properties of the gear.

Ice -Core Pollen Studies From The Dunde And Guliya Ice Caps, Qinghai -Tibetan Plateau, China., Zuju Yao

This research provides the first systematic and high-resolution ice-core pollen records from two ice caps in the northern Qinghai-Tibetan Plateau. To facilitate the climatic interpretation of the pollen data from the ice cores, a 30-year pollen record from the Dunde ice core is used to establish the quantitative relationship between pollen and modern climatic parameters. A 2000-year pollen record from the Dunde ice core reveals decadal and century time scale climatic changes. Three dry periods (i.e. A.D. 280--640, 1200--1370, and 1926--1986) and three wet periods are identifiable at Dunde. These results are compatible with other proxy data such as historical …
