[Introduction To] Ethics And Remembrance In The Poetry Of Nelly Sachs And Rose Auslander, Kathrin M. Bower Jan 2000

[Introduction To] Ethics And Remembrance In The Poetry Of Nelly Sachs And Rose Auslander, Kathrin M. Bower

Bookshelf

This is the first comparative study in English of two German-Jewish women poets who survived the Nazi genocide but did not escape its effects. The study begins with a reading of Sachs's and Ausländer's poetry in the context of the wider scope of 'Holocaust literature.' Focusing on the poet as witness bearing the double burden of survival and remembrance, the work argues that 'work of memory'achieved by Ausländer and Sachs exemplifies the complexity of poetic reflection on trauma and history.

In addition to aesthetic considerations, the book concentrates on the implications of Sachs's and Ausländer's poetic engagement for an 'ethics …

Amatory Jurisprudence And The Querelle Des Lois, Peter Goodrich Jan 2000

Amatory Jurisprudence And The Querelle Des Lois, Peter Goodrich

Articles

It is my view, and here, no doubt, I am pre-empting my conclusion, that what literary and feminist historicism recognizes as the querelle des femmes, the debate as to the status and political role of women, is in fact underpinned and motivated by a much less explicit, yet nonetheless portentous, querelle des lois. The querelle des femmes, in other words, was always a polemic as to the legal status of women, as to their definition and role in theology and jurisprudence, canon and civil law. More than that, however, what the recovery of amatory jurisprudence can help to show is …

A Research Study To Determine Customer Service At Universities In The Dominican Republic, Thelma Roman Jan 2000

A Research Study To Determine Customer Service At Universities In The Dominican Republic, Thelma Roman

Theses

This study was conducted at Pontificia Universidad Catolica Madre y Maestra (PUCMM), to determine customer service at universities in the Dominican Republic. The sample population consisted of 250 undergraduate students and 16 academic and administrative head of departments. As results indicate, there is lack of evaluating mechanisms to determine customer satisfaction in all departments at PUCMM. The only evaluation in place is a survey done by students every semester to evaluate faculty' s performance and academic quality; nevertheless, such evaluation does not determine customer satisfaction. Furthermore, there are few evaluations to determine students' needs . On the other hand, according …

University of Kentucky Master's Theses

The amount of information available on the web is growing constantly. As a result, theproblem of retrieving any desired information is getting more difficult by the day. Toalleviate this problem, several techniques are currently being used, both for locatingpages of interest and for extracting meaningful information from the retrieved pages.Information extraction (IE) is one such technology that is used for summarizingunrestricted natural language text into a structured set of facts. IE is already being appliedwithin several domains such as news transcripts, insurance information, and weatherreports. Convergence And Its Critics: What Are The Preconditions To The Separation Of Ownership And Control?, John C. Coffee Jr. Jan 2000

Convergence And Its Critics: What Are The Preconditions To The Separation Of Ownership And Control?, John C. Coffee Jr.

Faculty Scholarship

Recent commentary has argued that deep and liquid securities markets and a dispersed shareholder base are unlikely to develop in civil law countries and transitional economies for a variety of reasons, including (1) the absence of adequate legal protections for minority shareholder, (2) the inability of dispersed shareholders to hold control or pay an equivalent control premium to that which a prospective controlling shareholder will pay and (3) the political vulnerability of dispersed shareholder ownership in left-leaning "social democracies." Nonetheless, this article finds that significant movement in the direction of dispersed ownership has occurred and is accelerating across Europe. To …

Class Action Accountability: Reconciling Exit, Voice, And Loyalty In Representative Litigation, John C. Coffee Jr. Jan 2000

Class Action Accountability: Reconciling Exit, Voice, And Loyalty In Representative Litigation, John C. Coffee Jr.

Faculty Scholarship

In two recent and highly technical decisions – Amchem Products v. Windsor and Ortiz v. Fibreboard Corp. – the Supreme Court has recognized that a serious potential for collusion exists in class actions and has outlined a concept of "class cohesion" as the rationale that legitimizes representative litigation. Although agreeing that a legitimacy principle is needed, Professor Coffee doubts that "class cohesion" can bear that weight, either as a normative theory of representation or as an economic solution for the agency cost and collective action problems that arise in representative litigation. He warns that an expansive interpretation of "class cohesion" …

Herbert Wechsler And The Criminal Law: A Brief Tribute, Harold Edgar Jan 2000

Herbert Wechsler And The Criminal Law: A Brief Tribute, Harold Edgar

Faculty Scholarship

The great English architect Christopher Wren is buried in his most famous church, St. Paul's London. The inscription on his memorial stone concludes with the words: Lector, si monumentum requiris, circumspice. Reader, if you seek his monument, look around you.

That instruction serves well those who would appraise and honor Herbert Wechsler's contributions to American criminal law. When he joined the Columbia Law School faculty in 1933, this school did not teach criminal law and much of the profession thought the topic was not worth studying.' What fabulous good fortune it was that Herb thought otherwise. Throughout a long and …

The Christian View Of Vocation For Librarians, John Allen Delivuk Jan 2000

The Christian View Of Vocation For Librarians, John Allen Delivuk

The Christian Librarian

Like two brothers, western civilization and Christianity grew up together. Christianity gave the civilization its virtues, its view of work, and its view of service. With the decline of Christian influence, there is an increasing separation between virtue, service and work. This has led to vocational crisis in professions which have described themselves as vocations. Nurses, doctors and teachers have noticed the problem. This paper will make some observations concerning the crisis, give historical and biblical insights into our view of vocation, discuss some errors with the viewpoints, give some proposals for improving the situation and conclude with a summary.

Variations On Some Themes Of A Disporting Gazelle And His Friend: Statutory Interpretation As Seen By Jerome Frank And Felix Frankfurter, Kent Greenawalt Jan 2000

Variations On Some Themes Of A Disporting Gazelle And His Friend: Statutory Interpretation As Seen By Jerome Frank And Felix Frankfurter, Kent Greenawalt

Faculty Scholarship

In 1947, this Review published two lectures on statutory interpretation by Jerome Frank and Felix Frankfurter. Both jurists were concerned with a basic question: How constrained are judges when they interpret legislation? The answers each gives, while similar in some respects, differ strikingly. In arguing that interpretation necessarily involves a creative element, Frank analogizes the role of a judge in interpreting legislation to that of a performer in interpreting a musical composition. Although he argues that judicial creativity is constrained, Frank views statutory interpretation as "a kind of legislation." For Frankfurter, by contrast, in construing a statute, a judge is …

Optimal Standardization In The Law Of Property: The Numerus Clausus Principle, Thomas W. Merrill, Henry E. Smith Jan 2000

Optimal Standardization In The Law Of Property: The Numerus Clausus Principle, Thomas W. Merrill, Henry E. Smith

Faculty Scholarship

A central difference between contract and property concerns the freedom to "customize" legally enforceable interests. The law of contract recognizes no inherent limitations on the nature or the duration of the interests that can be the subject of a legally binding contract. Certain types of promises – such as promises to commit a crime – are declared unenforceable as a matter of public policy. But outside these relatively narrow areas of proscription and requirements such as definiteness and (maybe) consideration, there is a potentially infinite range of promises that the law will honor. The parties to a contract are free …

The President And Choices Not To Enforce, Peter L. Strauss Jan 2000

The President And Choices Not To Enforce, Peter L. Strauss

Faculty Scholarship

The executive branch is often called upon to assess how a particular statute it is charged to administer fits within the larger framework of the law. Professor Dawn Johnsen's thoughtful analysis addresses an important subset of these challenges: situations in which the President believes a particular statute is inconsistent with one or another provision of the Constitution and, therefore, should not be enforced. My purpose here is to explore the context of executive non-enforcement more broadly, in a way that may help in understanding the particular problem she addresses.

Issues of constitutional structure and function are among the most daunting …

Liberality, Philip A. Hamburger Jan 2000

Liberality, Philip A. Hamburger

Faculty Scholarship

Did late eighteenth-century Americans ever consider themselves liberal? To many historians, this will seem a strange question. The concept of liberalism is widely held to be a nineteenth-century innovation, and therefore to inquire whether Americans in the previous century thought of themselves as liberal seems anachronistic.

Yet precisely because so many scholars take for granted the late evolution of liberal ideas, it may be all the more valuable to reexamine this assumption. Is there really no evidence that eighteenth-century Americans considered themselves liberal? Although they may not have embraced later concepts of liberalism, is it not at least possible that …

Pilot Education: The Beginnings, Tim Brady Jan 2000

Pilot Education: The Beginnings, Tim Brady

Journal of Aviation/Aerospace Education & Research

For those of us involved with flight education, it is easy to take for granted some of the concepts that we practice daily, concepts such as a standardized flight curriculum, periodic flight checks, clearly defined flight instruction procedures, and progression from the simple to the more complex aircraft. These concepts did not simply appear full-blown, they were born, shaped, and modified via the crucible of world conflict. To find the roots of these flight education concepts, we have to look to Europe, to the early days of flight, to 1914, to what we now call World War I.

With Thor Across The Heavens, Ben Larson Jan 2000

With Thor Across The Heavens, Ben Larson

Journal of Aviation/Aerospace Education & Research

Consumers are generally affected by packaging and naming of particular products. Take, for example, a product like shampoo. A few years ago, the brand Halsa was launched. While most people probably saw the label showing the girl with the beautiful hair, they were very likely also influenced by the name Halsa. Had they understood its meaning [Swedish = health], they would probably have had even more faith in the shampoo, but the enigmatic and unusual-sounding name created a favorable impression in them.

[Introduction To] Crossing The Color Line: Readings In Black And White, Suzanne W. Jones Jan 2000

[Introduction To] Crossing The Color Line: Readings In Black And White, Suzanne W. Jones

Bookshelf

The complex truth about the color line -- its destructive effects, painful legacy, clandestine crossings, possible erasure -- is revealed more often in private than in public and has sometimes been visited more easily by novelists than historians. In this tradition, Crossing the Color Line, a powerful collection of nineteen contemporary stories, speaks the unspoken, explores the hidden, and voices both fear and hope about relationships between blacks and whites. The volume opens with stories by Alice Adams, Toni Cade Bambara, Ellen Douglas, Reynolds Price, Ekwueme Michael Thelwell, and John A. Williams that focus on misunderstandings created by racial stereotypes …
