Open-And-Shut: Senate Impeachment Deliberations Must Be Public, Marjorie Cohn Jan 2000

Open-And-Shut: Senate Impeachment Deliberations Must Be Public, Marjorie Cohn

UC Law Journal

During President William Clinton's impeachment trial, Chief Justice William Rehnquist denied a request to open the deliberations to the public, relying on Senate tradition and ambiguous rules of procedure. This article examines the current Senate impeachment rules in the context of an historical tradition of Senate secrecy, and argues for rule changes to create a clear rule of openness at all stages of an impeachment trial, including deliberations.

Professor Cohn argues the rules adopted in the 19th century need to be modified to conform to 21st century America. Differences discussed include popularly elected senators, increased accountability of government stemming largely …

The Public Health Case For The Safe Storage Of Firearms: Adolescent Suicides Add One More Smoking Gun, Andrew J. Mcclurg Jan 2000

The Public Health Case For The Safe Storage Of Firearms: Adolescent Suicides Add One More Smoking Gun, Andrew J. Mcclurg

UC Law Journal

In this article, Professor McClurg makes the case for mandatory safe gun storage laws as a means of reducing adolescent suicides. He has argued in other articles in favor of safe storage as a means of reducing accidental shootings and criminal misuse of stolen guns. The article begins by analyzing firearms suicides in the U.S., which McClurg calls "the forgotten statistic in the gun control debate." He reviews numerous studies establishing a nexus between guns and suicide, particularly between guns in the home and adolescent suicide. He then examines ten different studies showing that large percentages of American gun owners …

Now & Then: The Appalachian Magazine, Volume 17, Issue 02, published in 2000. The theme of this issue is Appalachian Accents. Cloth In Contemporary West Africa: A Symbiosis Of Factory-Made And Hand-Made Cloth, Heather Marie Akou Jan 2000

Cloth In Contemporary West Africa: A Symbiosis Of Factory-Made And Hand-Made Cloth, Heather Marie Akou

Textile Society of America: Symposium Proceedings

The concepts of "tradition" and "fashion" both center on the idea of change. Fashion implies change, while tradition implies a lack of change. Many scholars have attempted to draw a line between the two, often with contradictory results. In a 1981 article titled, "Awareness: Requisite to Fashion," Mary Ellen Roach-Higgins argued that,

If people in a society are generally not aware of change in form of dress during their lifetimes, fashion does not exist in that society. Awareness of change is a necessary condition for fashion to exist; the retrospective view of the historian does not produce fashion.1

Although …

Conversing With The Cosmos, Linda L. Beeman Jan 2000

Conversing With The Cosmos, Linda L. Beeman

Textile Society of America: Symposium Proceedings

This paper focuses on the silk tapestry headcloths woven by Tausug peoples from the Philippine Sulu Archipelago. Called pis siyabet, they captured my attention because they diverge so wildly from the cotton or abaca warp ikat weaving one associates with indigenous peoples from the Philippines and Indonesia. Their material, structure, motif and color fly in the face of local tradition. The dense complexity created by their interlocking square, triangle and diamond motifs suggests cosmic mazes - treasure maps to the unconscious. Pis puzzle us and compel our imaginations.

Some history is in order. The Philippine Archipelago was first peopled …

Policarpio Valencia's Embroidered Poetry, Annin Barrett Jan 2000

Policarpio Valencia's Embroidered Poetry, Annin Barrett

Textile Society of America: Symposium Proceedings

Policarpio Valencia was an artist, a poet, a salt merchant, farmer, water ditch boss, miller, town philosopher, and justice of the peace in the town of Santa Cruz, New Mexico, 25 miles north of Santa Fe. He lived in a section of Santa Cruz named El Santo Nino his whole life, from 1854 until 1931, where he married and had two children. Residents there were known as "Canaderos" because they lived close to the old Santa Cruz Mission (built in the 1730s) which was called Santa Cruz de la Canada. To get an idea of how geographically isolated …

The Eclectic Model Of Censorship, Kenji Yoshino Jan 2000

The Eclectic Model Of Censorship, Kenji Yoshino

Faculty Articles

In Part I of this review, I elaborate on the parallel stories that can be told about changing conceptions of subjects and speech: stories of error (the classical model's sentimental conception), overcorrection (the Foucaultian model's skeptical conception), and equilibration (the contemporary model's comprehensive conception). I argue that despite postmodern encouragement to view all censorship as arising from norms, the contemporary model has retained a partially sentimental conception (which could also be called a partially skeptical conception) of both subjects and speech as discrete agents of censorship. I call the contemporary model the "eclectic" model of censorship, drawing on the historical …

Lex Satis Iusta, Jeremy Waldron Jan 2000

Lex Satis Iusta, Jeremy Waldron

Faculty Articles

"Lex iniusta non est lex." John Finnis reminds us, at the end of Natural Law and Natural Rights, that the central tradition of natural law theory did not formulate its thesis about the relation between law and justice by saying things like "an unjust edict cannot be law" or "a morally iniquitous command cannot be law." Instead, says Finnis, "the tradition... has affirmed that unjust LAWS are not law." He offers several elaborate explanations-and, I should say at once, they are helpful and convincing explanations-of why this paradox is not a contradiction. His explanations appeal to the distinction between normative, …

Self-Defense: Agent-Neutral And Agent-Relative Accounts, Jeremy Waldron

Faculty Articles

One of the innumerable debts I owe Sandy Kadish is in respect of his warm and consistent encouragement to invest some portion of my philosophical energies in the problems of the criminal law. When I replied that what I knew most about was the history of political philosophy, Sandy was undeterred. "Kant wrote about criminal law," he would say. "So did Hobbes and Locke. Those guys talked about capital punishment, individual responsibility and self-defense, just as much as they dealt with topics in political theory like the nature of law and the obligation to obey." He was right. There is …

Vicarious Liability Of Health Plans For Medical Injuries, Richard A. Epstein Jan 2000

Vicarious Liability Of Health Plans For Medical Injuries, Richard A. Epstein

Faculty Articles

This English influence will prove itself again in this brief article on the role of vicarious liability and managed care organizations (MCOs) which has been in the news so much today. As usual, I think that the best way to cut into this problem is by indirection. The novelty of liability for MCOs is best placed in perspective by comparing the claims for liability here with those which could be made, both in England and the United States, by employees against their employers for work-related accidents.

Tribal/State Title Iv-E Intergovernmental Agreements, Facilitating Tribal Access To Federal Resources, Eddie Brown, Leslie Scheuler-Whitaker, Chey Clifford, Gordon Limb, Ric Munoz

Buder Center for American Indian Studies Research

Although Title IV-E of the Social Security Act is an important funding stream for foster care and adoption services in American Indian communities, limited research has been conducted on the facilitation of tribal access to federal IV-E resources. Historically, direct IV-E funding has not been available to tribal communities, therefore, tribes have worked with their respective states to develop agreements that allow them to access these important funds. The purpose of this study was to provide a comprehensive overview of current IV-E intergovernmental provisions in order to assist tribes and states in strengthening both new and existing IV-E agreements. The …
