Women In Legal Education: What The Statistics Show, Richard K. Neumann Jr. Sep 2000

Women In Legal Education: What The Statistics Show, Richard K. Neumann Jr.

Hofstra Law Faculty Scholarship

What can statistics derived from publicly available data establish about how women are being treated in legal education? This study is an attempt to find out. Its goal is to collate into one coherent picture the most significant data presently available. Among other things, this study reports a census of all faculty jobs at law schools approved by the American Bar Association, largely but not entirely based on faculty listings published in the AALS Directory of Law Teachers covering a three-year period, 1996-97 through 1998-99.

Part I examines the published data on the gender composition of students and applicants for …

A Study Of The Effects Of Strain On Niti Shape Memory Alloy, Bret Oltmans Sep 2000

A Study Of The Effects Of Strain On Niti Shape Memory Alloy, Bret Oltmans

Theses

Shape memory alloys are materials that are capable of returning to an original shape after large deformations in response to a stimulus. Shape memory alloys can be metals, ceramics, polymers and gels. This thesis studies the changes of various properties of NiTi metal as samples are prestrained various amounts. After conducting various characterization techniques, relationships were developed for the changes in transformation temperatures, Knoop hardness number, and crystal lattice parameters. Through the use of differential scanning calorimetry and dynamic mechanical analysis the transformation temperatures were determined. It was observed in both experiments that the initial austenite start temperature(As) increased parabolically …

Population-Specific Vital Rate Contributions Influence Management Of An Endangered Ungulate, Heather E. Johnson, L. Scott Mills, Thomas R. Stephenson, John D. Wehausen Sep 2000

Population-Specific Vital Rate Contributions Influence Management Of An Endangered Ungulate, Heather E. Johnson, L. Scott Mills, Thomas R. Stephenson, John D. Wehausen

Wildlife Biology Faculty Publications

To develop effective management strategies for the recovery of threatened and endangered species, it is critical to identify those vital rates (survival and reproductive parameters) responsible for poor population performance and those whose increase will most efficiently change a population's trajectory. In actual application, however, approaches identifying key vital rates are often limited by inadequate demographic data, by unrealistic assumptions of asymptotic population dynamics, and of equal, infinitesimal changes in mean vital rates. We evaluated the consequences of these limitations in an analysis of vital rates most important in the dynamics of federally endangered Sierra Nevada bighorn sheep (Ovis canadensis …

A Multilevel Model Of Client Participation In Intensive Family Preservation Services, Julia H. Littell, E. A. Tajima Sep 2000

A Multilevel Model Of Client Participation In Intensive Family Preservation Services, Julia H. Littell, E. A. Tajima

Graduate School of Social Work and Social Research Faculty Research and Scholarship

We identify two distinct components of parent participation in intensive family preservation services: collaboration in treatment planning and compliance with program expectations. Using hierarchical linear models, we explore influences on collaboration and compliance at the case, worker, and program levels. Effects of cross-level interactions are also examined. Parental substance abuse, mental health problems, minority status, and lack of extended family support predict lower levels of participation. Workers' perceptions of their clients and of their own working conditions appear to influence client participation. Program factors matter as well, although some operate in tandem with case characteristics and worker perceptions.

Rights And Rules: An Overview, Matthew D. Adler, Michael C. Dorf Sep 2000

Rights And Rules: An Overview, Matthew D. Adler, Michael C. Dorf

Cornell Law Faculty Publications

Prior to recent decades, the United States Supreme Court often invoked the political question doctrine to avoid deciding controversial questions of individual rights. By the 1970s and 1980s, standing limits traced to Article III’s case-or-controversy language had replaced the political question doctrine as the favored justiciability device. Although both political question and standing doctrines remain tools in the Court’s arsenal of threshold decision making,3 in the last decade the Court has turned with increasing frequency to the distinction between facial and as-applied challenges to perform the gatekeeping function. However, although there is a considerable body of scholarship concerning the conventional …

The Heterogeneity Of Rights, Michael C. Dorf Sep 2000

The Heterogeneity Of Rights, Michael C. Dorf

Cornell Law Faculty Publications

What is the implication for the validity of governmental rules of the conclusion that the rule interferes with a constitutional right? This question has implications for two important doctrinal puzzles. The first is the question when, if ever, a litigant has a constitutional right to an exemption from a generally valid rule of law. Many constitutional rights are rule-dependent in the sense that they protect actors against certain kinds of governmental rules rather than shielding acts against governmental interference. This Article denies the claim by scholars and judges that this rule-dependence reflects a deep truth about the nature of constitutional …

Rules And Judicial Review, Emily Sherwin Sep 2000

Rules And Judicial Review, Emily Sherwin

Cornell Law Faculty Publications

Judicial review of statutes on constitutional grounds is affected by a cluster of doctrinal practices that are generally accepted, but not very well explained, by the courts and not entirely consistent with each other. Courts usually judge statutes “as applied” rather than as written; they favor “severance” of valid applications of statutes from invalid or possibly invalid applications when possible; and they interpret statutes in ways that avoid constitutional difficulty. These overlapping practices presumably are intended to preserve legislation, and hence are associated with a modest conception of the role of courts in government. Yet they are not always modest …
