Like most of the luminaries of the Harlem Renaissance, its leading visual artist, Aaron Douglas, was not himself a product of Harlem.1 Although Winold Reiss and Alain Locke were to guide Douglas in the development of his artistic vision once he arrived in Harlem, his early years in Kansas, Missouri, and Nebraska gave rise to both the communal values and the artistic sense of isolation that were to lead him to Harlem. It was in the black church and in Topeka's "cohesive and politically active" African-American community that Douglas first experienced black solidarity and embraced "the values of education …

Review Of The Contested Homeland: A Chicano History Of New Mexico Edited By Erlinda Gonzales-Berry And David R. Maciel, Armando C. Alonzo
Great Plains Research: A Journal of Natural and Social Sciences (through 2013)
The goal of this anthology, consisting of ten essays on the history of the Nuevomexicano experience from the short Mexican period to the post-Chicano movement era of the 1960s and 1970s, is to present a Chicano perspective on the Nuevomexicano historical experience. Divided into two parts, the nineteenth and twentieth centuries, the collection's essays deal primarily with twentieth-century themes, a reasonable approach given the brevity of the Mexican era and the much longer period after the Treaty of Guadalupe Hidalgo, which initiated the era of United States rule. The dominant theme affirms that Nuevomexicanos have always contested their rights to …
Has Wright Line Gone Wrong? Why Pretext Can Be Sufficient To Prove Discrimination Under The National Labor Relations Act,, Michael Hayes
Has Wright Line Gone Wrong? Why Pretext Can Be Sufficient To Prove Discrimination Under The National Labor Relations Act,, Michael Hayes
All Faculty Scholarship
Every year in the United States, thousands of employees are illegally fired for joining or supporting unions. These employees must bring their claims to the National Labor Relations Board (the “Board”), which applies its famous Wright Line standard to decide thousands of discrimination cases each year.
Probably the most common issue in labor discrimination cases is “pretext.” In virtually every case, an employer claims that it fired an employee not for an illegal anti-union motive, but for a legitimate business reason. The pretext issue arises when the evidence shows that the legitimate reason asserted by the employer was most likely …
Modifications To An Existing Glycol Retention Pond And Alternative Technologies Review For Aircraft Deicing Operations And Glycol Recovery And Treatment: Dane County Regional Airport, Steven J. Sletten
Master's Theses - Daytona Beach
The purpose of this study was to review new aircraft deicing technologies and developments and surmise which approach may be the most appropriate for the Dane County Regional Airport’s (KMSN) expansion plans, size, available funds, and environmental impact reduction efforts. This paper focuses on the emerging glycol source reduction issues that may be most suitable for this particular airport. A new deicing technology at KMSN would reduce the amount of aircraft deicing fluid used, allow for effacing flight operations, limit environmental impact, and lessen the costs of maintaining and operating the current glycol fluid recovery and treatment system.

An Ameliorated Prediction Of The Empennage In-Flight Gust Loads For A General Aviation Aircraft, Philippe Marchand
An Ameliorated Prediction Of The Empennage In-Flight Gust Loads For A General Aviation Aircraft, Philippe Marchand
Master's Theses - Daytona Beach
Airplanes often operate beyond their original design load profiles. Aviation opens so many new possibilities and wide variety of possible activities that it is hard for designers to foresee all loading spectra that the airplane structure will experience throughout its life. Nevertheless, the aircraft structures are required to be designed to failsafe or safe-life criteria to be certified by the FAA. AFS-120 provides a database of normal accelerations that can be used to derive airplane wing loads. ACE-100 describes an acceptable method for determining the fatigue life of an empennage based on the same normal acceleration data provided in AFS-120. …

Lyman-Α Imaging Of A Very Luminous Z = 2.3 Starburst Galaxy With Wfpc2, Nathan Roche, James D. Lowenthal, Bruce Woodgate
Astronomy: Faculty Publications
We investigate the Lyα and UV continuum morphology of one of the most luminous known Lymana emitting galaxies (the 'Coup Fourré Galaxy'), associated with a z = 2.3 damped Lyα absorption system in the spectrum of the QSO PHL 957. The galaxy is observed with the Hubble Space Telescope Wide-Field Planetary Camera 2 (HST WFPC2), through a narrow filter (F410M) corresponding to rest-frame Lyα for a total exposure time of 41.2 ks, plus shorter exposures in F555W and F814W. In all three passbands, the galaxy is resolved into a close (∼0.35 arcsec) pair of two components, CFgA and CFgB, both …

Lost And Found: Researching The Second Amendment, Robert J. Spitzer
Lost And Found: Researching The Second Amendment, Robert J. Spitzer
Chicago-Kent Law Review
The recent proliferation of writings on the Second Amendment makes numerous claims including: (1) there has been little or no legal scholarship on the Second Amendment until recent times; (2) the "individualist" view of the Second Amendment is the dominant or mainstream paradigm; (3) the courts have committed a "dereliction of duty" insofar as they have been silent on, or indifferent to, interpretation of the Second Amendment; and (4) since three of the four Supreme Court cases concerning the Second Amendment were decided in the nineteenth century, the court doctrine is somehow defective, irrelevant, outdated, unclear, or "embarrassing." In this …

If It Ain't Broke Don't Fix It: An Argument For The Codification Of The Quill Standard For Taxing Internet Commerce, Sidney S. Silhan
Chicago-Kent Law Review
The Internet Tax Freedom Act neither changed the status of the law nor did it create a new standard for taxability; it simply stopped any new taxes from being imposed while the economy adjusted to the explosion of Internet commerce. This Note will argue that the economy is adjusting, and indeed not all that much has changed in the sales tax collection arena. Furthermore, Quill continues to be the standard by which out-of-state sellers are taxed, and Congress should settle the issue by codifying the Quill requirement of substantial nexus before taxation can occur.

Electron beam and optical depth profiling of thick (5.5–64 μm) quasibulk n-type GaN samples, grown by hydride vapor-phase epitaxy, were carried out using electron beam induced current (EBIC), microphotoluminescence (PL), and transmission electron microscopy (TEM). The minority carrier diffusion length, L, was found to increase linearly from 0.25 μm, at a distance of about 5 μm from the GaN/sapphire interface, to 0.63 μm at the GaN surface, for a 36-μm-thick sample. The increase in L was accompanied by a corresponding increase in PL band-to-band radiative transition intensity as a function of distance from the GaN/sapphire interface. We attribute …

The Γ5 and Γ6 free excitons have been identified in GaN from emission measurements. Another emission peak is also observed which we believe to be the longitudinal free exciton. These measurements along with electrical measurements, which show the sample to have very high peak mobility, attest to the high quality of the sample.

Exploring The Creative Voice In An Academic Context, Laura Brearley
The Qualitative Report
Who we are changes what we write about and how we write. Simply stated, if the academy is to change, if our views of reality are to be more inclusive, then we need to take a broader view of authorial voices… Tierney and Lincoln, 1997 This paper challenges the traditional paradigm of densely referenced text and the use of a passive, 'neutral' researcher's voice. It draws on current doctoral research that is using creative modes of data representation to examine managers' experiences of transition in organisational life. Within this research, ten managers from an educational institution are being tracked through …
The Federalism Cases, Leon Friedman
The Federalism Cases, Leon Friedman
Hofstra Law Faculty Scholarship
The Constitution is an anachronism, 200 years out of date. Although the Bill of Rights is adequate, much of the Constitution relates to a world we no longer face. Certainly it is true that the whole fight in adopting and ratifying the Constitution was between the federalists and the anti-federalists. The anti-federalists did not want a central government because a central government with a standing army could march on the States and use their weapons to impose all kinds of tyranny and deprive the States of their liberty. The whole push and pull of the Philadelphia Convention, the Constitution, and …

Bouncing The Tightrope: The S.E.C. Attacks Selective Disclosure, But Provides Little Stability For Analysts, J. Scott Colesanti
Hofstra Law Faculty Scholarship
Part I of this article summarizes Regulation FD. Part II summarizes the "traditional" treatment accorded analysts by the S.E.C., private 1Ob-5 plaintiffs, and the courts, and describes two efforts in the 1990s by the Supreme Court and the Congress to remove analysts and similar ancillary players from the ever-burgeoning 1Ob-5 caseload. Part III provides a background for an evaluation of the analyst's role by discussing his duties in corporate disclosure settings and the accolades consistently received therefor. Part IV discusses the possible flaws in Regulation FD while encouraging the S.E.C. to complete the more arduous, but surely more direct, approach …
Assessing The New Judicial Minimalism, Christopher J. Peters
Assessing The New Judicial Minimalism, Christopher J. Peters
All Faculty Scholarship
In this article, which has been published in slightly revised form at 100 Colum. L. Rev. 1454 (2000), I critique some recently prominent arguments for "judicial minimalism" in constitutional decisionmaking. Current minimalist arguments, I contend, are primarily "policentric," that is, focused on the role the judiciary can play in bolstering the accountability and deliberativeness of the political branches. Drawing in part on a previous article, I offer an alternative approach to minimalism that is "juricentric" - focused on the inherent democratic legitimacy of the adjudicative process and the unique competence of that process to produce decisions about individual rights. I …

"A Well Regulated Militia": The Second Amendment In Historical Perspective, Paul Finkelman
"A Well Regulated Militia": The Second Amendment In Historical Perspective, Paul Finkelman
Chicago-Kent Law Review
In this Article, Finkelman argues that the purpose of the Second Amendment was to protect the right of the states to maintain militias and arm them if the national government refused to do so. This Article, based on the debates over ratification and over the Bill of Rights, shows that some extreme Antifederalists wanted the national government to guarantee a personal right to own weapons. But, as the evolution of the Amendment and the final text of the Amendment make clear, Madison and the other Federalists who totally dominated Congress at the time thoroughly rejected these demands for the protection …
Fundamental Protection Of A Fundamental Right: Full Recovery Of Child-Rearing Damages For Wrongful Pregnancy, Patricia Baugher
Fundamental Protection Of A Fundamental Right: Full Recovery Of Child-Rearing Damages For Wrongful Pregnancy, Patricia Baugher
Washington Law Review
The U. S. Constitution and Washington statutes protect the right to choose not to have a child as a fundamental right. When a healthy child is born after contraceptive methods fail due to physician negligence, parents can sue on a "wrongful pregnancy" cause of action. In all jurisdictions recognizing wrongful pregnancy, parents may recover damages for medical expenses associated with pregnancy and childbirth. A controversy exists, however, concerning whether parents may recover the ordinary expenses of child rearing. While some states allow full recovery of these expenses, and other states allow recovery of the economic expense offset by the emotional …
