Evidence Issues In Domestic Violence Civil Cases, Jane C. Murphy, Jane H. Aiken Jan 2000

Evidence Issues In Domestic Violence Civil Cases, Jane C. Murphy, Jane H. Aiken

All Faculty Scholarship

New laws and policies aimed at protecting victims of domestic violence have been adopted across the country over the last twenty years. The legal approaches taken to protect battered women and control family violence have resulted in significant changes in family law. New laws include statutes permitting civil protection or restraining orders, and laws requiring that domestic violence be considered in custody and/or visitation decisions. Both of these types of statutory reforms can provide protection to adult victims of domestic violence and their children. Evaluating a parent's fitness by considering past acts of violence to other family members results in decisions …

Collecting Child Support: A History Of Federal And State Initiatives, Jane C. Murphy, Naomi R. Cahn Jan 2000

Collecting Child Support: A History Of Federal And State Initiatives, Jane C. Murphy, Naomi R. Cahn

All Faculty Scholarship

In this article we sketch an overview of the increasing federal involvement in the child-support area. Because the federal role has grown so dramatically over the past 25 years, family law practitioners need to understand the different federal programs and requirements that affect state management of child-support programs. While for many low-income parents state agencies handle child-support establishment and collection, the federalization of child support has practical implications when it comes to both establishing and enforcing child support. For example, as the time limits of the Personal Responsibility and Work Opportunity Reconciliation Act begin to have their effects, child support …

Race, Space And Place: The Internal Critique Of The Empowerment Zones Program, Audrey Mcfarlane Jan 2000

Race, Space And Place: The Internal Critique Of The Empowerment Zones Program, Audrey Mcfarlane

All Faculty Scholarship

This Article examines the extent to which the Empowerment Zones Program is properly viewed as a neutral, rational, and beneficial program for poor, inner-city communities and their residents by exploring the limits and potential of its chief mechanism, economic development, as a tool to achieve social justice for the inner cities. This Article grounds its exploration within the contested terrain of the city, not simply as a legal or juridical concept, but in terms of its reality as a lived place on the eve of the 21st century.

Analysis Of Infragravity Frequency Sediment Transport On Macrotidal Beaches, Andrew Nicholas Saulter Jan 2000

Analysis Of Infragravity Frequency Sediment Transport On Macrotidal Beaches, Andrew Nicholas Saulter

Other Faculty of Science and Engineering Theses

Many cross-shore sediment transport models use simple treatments of infragravity frequency (0.005- 0.05Hz) processes. For example, infragravity waves have been assumed to provide solely a 'drift velocity' for transport of sediment mobilised by incident frequency waves (0.05-0.5Hz) and be 100% reflected at the shoreline. Furthermore, numerous models calculate broken incident wave heights on the basis of water depth only. This work investigates both the processes underlying infragravity frequency variations in the crossshore velocity field, and the resulting effect of such variations on sediment suspension and transport. Data were selected from three beach experiments in order to compare observations from a …

Emission, Dispersion And Local Deposition Of Ammonia Volatilised From Farm Buildings And Following The Application Of Cattle Slurry To Grassland, Richard Alexander Hill Jan 2000

Emission, Dispersion And Local Deposition Of Ammonia Volatilised From Farm Buildings And Following The Application Of Cattle Slurry To Grassland, Richard Alexander Hill

Other Faculty of Science and Engineering Theses

Emissions of ammonia (NH3) into the atmosphere, principally from agricultural sources, have been implicated in the pollution of forests, moorlands and grasslands, through the subsequent deposition of reduced nitrogen (NHx -N). Consequently, legislation has been implemented to control both the transboundary transport and local environmental impacts of NHx. This thesis investigates the emission, dispersion and local deposition of NH3 from two sources that are major components of national NH3 emissions inventories, slurry applied to grassland and naturally ventilated cattle buildings. A N balance method was identified for determining the time-average deposition of NH3 downwind of a farm building, whilst an …

The Thermal Properties Of Cob Buildings Of Devon, Steve Goodhew Jan 2000

The Thermal Properties Of Cob Buildings Of Devon, Steve Goodhew

Other Faculty of Science and Engineering Theses

Little has been published concerning the thermal properties of existing unbaked earth walls. In order to model the thermal behaviour of a building constructed using traditional cob walls, the thermal conductivity and thermal diffusivity need to be established. The Centre for Earthen Architecture (CEA), based at the University of Plymouth's School of Architecture has carried out research into various aspects of cob architecture typical to the Devon area. This study supplements other work concerning the moisture content, structure and pathology of cob as a building material. This research concentrates upon the development of a time dependent probe technique for the …

The Architectural Expression Of Anglican Rituals As Disseminated Through A Photographic Enquiry Of Six Devon Churches, Simon Standing Jan 2000

The Architectural Expression Of Anglican Rituals As Disseminated Through A Photographic Enquiry Of Six Devon Churches, Simon Standing

Other Faculty of Arts, Humanities and Business Theses

There have been a number of publications that have set out to clarify the relationship between architectural, liturgical and ritual developments within the nineteenth century Anglican church; especially that part of the Victorian Gothic Revival where fundamental developments in architectural design and doctrinal change occurred - 1840 to 1900. A variety of graphic illustrations have supported these texts and as a photographer who has had a long standing interest in visual forms of religious expression, it has raised the question as to whether new meanings of the architectural/ecclesiastical relationship could be established through a photographic-based research investigation. During the MPhil …

The Relationship Between Teachers' Understanding Of The Nature Of Science And Their Science Practice : Four Case Studies From An Urban Primary School., Stephen Laurence Waters-Adams Jan 2000

The Relationship Between Teachers' Understanding Of The Nature Of Science And Their Science Practice : Four Case Studies From An Urban Primary School., Stephen Laurence Waters-Adams

Plymouth Institute of Education Theses

This thesis explores the relationship between a teacher's understanding of the nature of science and her practice. The idea that teachers' understanding of the nature of science is a powerful determinant of their actions in the classroom has a strong intuitive appeal. Research over the last forty years has provided inconclusive results; however, there is a clear implication within recent central policy on teacher education that such knowledge should translated directly into practice. This has led to the identification within teacher training, materials of specific expectations regarding understanding of the nature of science (DfEE 1998a). This thesis presents four case …

Discussion To Promote Inference Making, Leah J. Muxfeldt Jan 2000

Discussion To Promote Inference Making, Leah J. Muxfeldt

Graduate Research Papers

Using discussion as an integral part of the reading program is a natural outgrowth of real literature in the classroom. Children need opportunities to engage in conversations about their literature experiences in order to enrich and refine their understanding of them. Teachers can facilitate discussions that promote in-depth understandings of reading experiences by providing children with opportunities to make inferences. As a result, children become accustomed to bringing their prior knowledge to reading experiences to discover inferred meanings, thus extending their thinking-language abilities.

Impact Of Insecure Attachment On Children's Social Skill Development, Kimberly A. Conrad Jan 2000

Impact Of Insecure Attachment On Children's Social Skill Development, Kimberly A. Conrad

Graduate Research Papers

This paper focuses primarily on the importance of secure parent/child attachment to healthy development of children. Attachment theory is utilized to explain possible causes of pathological and anti-social behavior. In particular, it describes how insecure (both anxious and avoidant) attachments between parent (caretaker) and child may lead to angry, coercive, immature, withdrawn, or even suicidal behaviors in children. Parent/child attachment problems are linked to social skill deficits and problems in peer relationships. Implications for school psychologists and for future research are offered.

Literacy In The Multiage Classroom : A Review Of The Research, Barbara Avaux Messer Jan 2000

Literacy In The Multiage Classroom : A Review Of The Research, Barbara Avaux Messer

Graduate Research Papers

Multi-age grouping has a long history and is once again being studied as a viable alternative to the age-graded education model. Research indicates that multi-age programs are academically effective as well as being beneficial in promoting feelings of self-efficacy in students. Our society has changed since the inception of the age-graded model and teachers today are looking at multi-age education as a way to meet the diverse needs of their students. Successful multi-age programs have similar characteristics, but each program needs to be designed to meet the needs of the community it serves. Specific teaching strategies, materials, and assessment methods, …

Middle School Intramural/Co-Curricular Programs, Andrew W. Strottman Jan 2000

Middle School Intramural/Co-Curricular Programs, Andrew W. Strottman

Graduate Research Papers

Schools that have used an intramural program find students benefit socially, academically, and physically from these activities. Some schools have even seen a drop in teens getting into trouble in their communities with the implementation of an intramural program. The first portion of this project was to review the literature to find out: (1) what the benefits of an intramural program are at the middle school level, (2) what grade level or levels would benefit most from a program that involves many students in activities, and (3) what students are interested in doing after school as opposed to being unsupervised …

Rethinking Intervention In Environmental Litigation, Carl W. Tobias

Law Faculty Publications

Intervention in Public Law Litigation: The Environmental Paradigm (Environmental Paradigm) substantially enhances understanding of intervention in federal environmental disputes. These controversies are a critical type of modern civil lawsuit and perhaps constitute the quintessential form of public law litigation. Professor Peter Appel comprehensively reviews the lengthy history of the intervention mechanism, scrutinizes the substantial 1966 revision of Federal Rule of Civil Procedure 24, and closely examines the phenomenon of public law litigation and intervention in it.

Professor Appel finds that federal district court judges liberally grant requests to intervene in these cases, although he asserts that some legal scholars have …

Natural Resources And The White Commission Report, Carl W. Tobias Jan 2000

Natural Resources And The White Commission Report, Carl W. Tobias

Law Faculty Publications

Individuals and entities with concerns regarding environmental issues as well as those concerned about the federal judicial system have carefully followed the debate over the possible division of the United States Court of Appeals for the Ninth Circuit that has been raging since 1995. During the first session of the 105th Congress, the Senate approved an appropriations rider, which would have established a new Twelfth Circuit including Alaska, Arizona, Hawaii, Idaho, Montana, Oregon, Washington, Guam, and the Northern Mariana Islands, and would have left California and Nevada in the Ninth Circuit. That action was very important because neither house of …
