Arbitration And Judicial Review, Theodore J. St. Antoine Jan 2000

Arbitration And Judicial Review, Theodore J. St. Antoine

Other Publications

A quarter century ago, in a presentation at the Academy's annual meeting, I used the phrase "contract reader" to characterize the role an arbitrator plays in construing a collective bargaining agreement. That two-word phrase may be the only thing I ever said before this body that has been remembered. Unfortunately, it is almost invariably misunderstood. Time and again members have reproached me: "What's the big deal about contract reading, anyway? Isn't it just the same as contract interpretation?" Or, more substantively scathing: "Do you really think, Ted, that all you have to do to interpret a labor agreement is to …

Sentenced To Purgatory: The Indefinite Detention Of Mariel Cubans, Yvette M. Mastin Jan 2000

Sentenced To Purgatory: The Indefinite Detention Of Mariel Cubans, Yvette M. Mastin

The Scholar: St. Mary's Law Review on Race and Social Justice

Indefinite detention of Cuban immigrants is unconstitutional. Immigrants detained in American jails are being treated the same as individuals serving criminal sentences or awaiting disposition of their cases. Congress should, therefore, create a mandatory and uniform system of procedural due process. The system should be modeled after the procedural due process system established by the Kansas Legislature in the Kansas Sexually Violent Predator Act of 1994.  Although the U.S. Supreme Court has yet to rule on the indefinite detention of the Mariel Cubans, lower courts have held that the indefinite detention of Mariel Cubans does not violate the Constitution. Nonetheless, …

There Is A Lot To Be Repaired Before We Get To Reparations: A Critique Of The Underlying Issues Of Race That Impact The Fate Of African American Reparations, Art Alcausin Hall Jan 2000

There Is A Lot To Be Repaired Before We Get To Reparations: A Critique Of The Underlying Issues Of Race That Impact The Fate Of African American Reparations, Art Alcausin Hall

The Scholar: St. Mary's Law Review on Race and Social Justice

Reparations are vital to enfranchise a group historically denied access to the opportunities required to enjoy the civil and political rights every United States citizen possesses. However, before African Americans will receive reparations, underlying issues of race must be resolved. The United States has provided reparations for some domestic groups, as well as support for at least one international group. Unfortunately, neither the Supreme Court, nor Congress seems willing to grant the same relief to African Americans. Because of this, outside of small settings and academic arenas, little debate has occurred. The resulting stalemate reveals underlying problems that stem from …

Political Questions, Judicial Questions, And The Problem Of Washington V. Glucksberg, Carl E. Schneider Jan 2000

Political Questions, Judicial Questions, And The Problem Of Washington V. Glucksberg, Carl E. Schneider

Other Publications

Over a century and a half ago, Alexis de Tocqueville famously said, "Scarcely any political question arises in the United States that is not resolved, sooner or later, into a judicial question." Physician-assisted suicide superbly illustrates Tocqueville's acute observation. For a number of years, assisted suicide was the prototype of a (nonpartisan) political question. Interest groups brought it to public attention. Public discussion of it flourished. Legislatures debated it. Citizens in several states decided in referenda whether to make it legal. Almost suddenly, however, this classic political process was transformed into a judicial one by the startling and strongly stated …

Chemical Vapor Deposition Of Copper Metal Using Copper(Hexafluoroacetylacetonate)(2) Alcohol Adducts., Hui Fan

LSU Historical Dissertations and Theses

A series of alcohol adducts of Cu(hfac)2 (Cu(hfac)2·ROH, where hfac- = hexafluoroacetylacetonate and ROH = C1, C2, C3, C4 alcohols) were synthesized as precursors for CVD of Cu metal. The low melting points of some Cu(hfac)2·ROH adducts allowed them to be used as liquid precursors at the common precursor evaporation temperature (ca. 80°C). Metallic Cu films were obtained using most of these compounds as precursors under either H2 or N2 mixed with the corresponding alcohol vapor. The details of each CVD reaction were studied by IR analysis of byproducts and electrical and thickness measurements on the resulting films. A reaction …

Theoretical And Experimental Studies Of Flame -Generated Agglomerates Using Light Scattering., Guocai Shu Jan 2000

Theoretical And Experimental Studies Of Flame -Generated Agglomerates Using Light Scattering., Guocai Shu

LSU Historical Dissertations and Theses

Knowledge of optical properties and morphological characteristics of aggregated aerosols is important for pollution control, material synthesis through the aerosol route, oxidation of particulate matters, as well as understanding the mechanism of particulate formation and growth. However, the limitations of current light scattering theories as well as the lack of robust data inversion schemes render the complete characterization of the agglomerated structures difficult and time consuming. The objective of present work is to develop robust experimental and theoretical methods to characterize the aggregated aerosols from in-situ classical light scattering (CLS) as well as dynamic light scattering (DLS) measurements. In the …

Insecticide Resistance And Resistance Mechanisms In The Southern House Mosquito, Culex Quinquefasciatus., Jeffrey Dwayne Stancil Jan 2000

Insecticide Resistance And Resistance Mechanisms In The Southern House Mosquito, Culex Quinquefasciatus., Jeffrey Dwayne Stancil

LSU Historical Dissertations and Theses

Significant resistance to malathion and resmethrin was found in insecticide-treated field populations of adult Culex quinquefasciatus , Say, compared with a laboratory and non-treated field strain. Resistance to both insecticides varied during the active control season and was associated with the frequency of insecticide application. Geographic variations in resistance levels were noted, and significant differences occurred between separate populations within the same mosquito control districts. Four model substrates were assessed for their suitability in detecting elevated esterase activity associated with malathion resistance. Esterase activities towards all substrates were significantly higher in field stains than a laboratory strain. Esterase activities toward …

LSU Historical Dissertations and Theses

This exploratory study examined three instructional strategies used with female high school biology students. The relative contributions of the strategies to student understanding of microbiology and motivation in science were analyzed. The science education community targeted underachievement in science by implementing changes in content and practices (NRC, 1996). Research suggested that teachers facilitate learnirig environments based on human constructivism (Mintzes, Wandersee, & Novak, 1997) that is rooted in meaningful learning theory (Ausubel, Novak & Hanesian, 1978). Teachers were advised to use both visual and verbal instructional strategies (Paivio, 1983) and encourage students to construct understandings by connecting new experiences to …

Evaluation Of Insecticide Resistance In Louisiana Adult Mosquitoes And The Efficacies Of Selected Larvicides., Stacy Lee Bearden Jan 2000

Evaluation Of Insecticide Resistance In Louisiana Adult Mosquitoes And The Efficacies Of Selected Larvicides., Stacy Lee Bearden

LSU Historical Dissertations and Theses

Pesticide resistance in Louisiana mosquitoes has never been examined on a state-wide basis. In 1996, first component of this monitoring program examined selected pesticide efficacies and documented current pesticide resistance. Ground ULV-applied FyfanonRTM (96.8% malathion and Pyrocide RTM (96.8% + 1% natural pyrethrum) were applied to caged Culex quinquefasciatus adults (Denham Springs [Livingston Parish] and Lake Charles [Calcasieu Parish]) and Aedes sollicitans (Vermilion Parish). FyfanonRTM caused significantly different (p < 0.05) mortalities among each species and strain within 24hrs (95% Aedes, 48% Denham Springs, and 14% Lake Charles). Pyrocide RTM also produced significantly different mortalities (99%, 70%, and 38%, respectively). Malathion and permethrin were topically applied to 3--5 day old adult mosquitoes from 14 parishes. St. Martin parish Cx. quinquefasciatus was most susceptible to malathion (2.58 mug/mul), and the Vermilion strain was most resistant (417.05 mug/mul). Resistance is based on a ≥5-fold resistance ratio. Calcasieu parish strain was least resistant to permethrin (1.93 mug/mul), and the St. Tammany parish strain was most resistant (40.86 mug/mul). Detecting pesticide resistance by bottle bioassay technique was compared to topical bioassay. Both techniques were effective in detecting resistance for selected Aedes, Anopheles, and Culex species in Louisiana. Ground ULV 97% malathion was applied to caged Cx. quinquefasciatus adults from a mosquito abatement district, agrichemical farmland, and a susceptible colony. No significance (p > 0.05) existed in mosquito mortality between the agrichemical area and the abatement district. Bacillus thuringiensis var. israeliensis (VectoBacRTM WDG and VectoBacRTM 12AS) and Bacillus sphaericus (VectoLexRTM WDG and VectoLexRTM CG) were …

Simulations And Algorithms On Reconfigurable Meshes With Pipelined Optical Buses., Anu Goel Bourgeois Jan 2000

Simulations And Algorithms On Reconfigurable Meshes With Pipelined Optical Buses., Anu Goel Bourgeois

LSU Historical Dissertations and Theses

Recently, many models using reconfigurable optically pipelined buses have been proposed in the literature. A system with an optically pipelined bus uses optical waveguides, with unidirectional propagation and predictable delays, instead of electrical buses to transfer information among processors. These two properties enable synchronized concurrent access to an optical bus in a pipelined fashion. Combined with the abilities of the bus structure to broadcast and multicast, this architecture suits many communication-intensive applications. We establish the equivalence of three such one-dimensional optical models, namely the LARPBS, LPB, and POB. This implies an automatic translation of algorithms (without loss of speed or …

Systematics Of The Polymorphic North American Rat Snake (Elaphe Obsoleta)., Frank Thomas Burbrink

LSU Historical Dissertations and Theses

The North American rat snake (Elaphe obsoleta) complex is composed of seven uniquely colored subspecies of E. obsoleta and the sister species E. bairdi. Maximum parsimony (MP) and maximum likelihood (ML) analysis of two mitochondrial DNA genes from 73 E. obsoleta and E. bairdi, produced well-supported trees that do not conform to the currently accepted subspecies. Both ML and MP trees were significantly shorter than the trees in which each subspecies was constrained to be monophyletic. The subspecies of E. obsoleta do not represent genetic lineages. Instead, molecular evidence revealed the existence of four well-supported mtDNA clades confined to particular …
