Justice Murphy And The Fifth Amendment Equal Protection Doctrine: A Contribution Unrecognized, Matthew J. Perry Jan 2000

Justice Murphy And The Fifth Amendment Equal Protection Doctrine: A Contribution Unrecognized, Matthew J. Perry

UC Law Constitutional Quarterly

As the title indicates, this article calls attention to Justice Frank Murphy's jurisprudence which, it claims, helped develop an Equal Protection component of the Fifth Amendment's Due Process Clause as applied to actions of the federal government. This doctrine was eventually adopted by the Supreme Court in Boiling v. Sharpe, a companion case to Brown v. Topeka Board of Education. To present its argument, this article focuses on Justice Murphy's opinions in three infamous WW II cases involving war-time measures curtailing Japanese-Americans' civil rights and liberties, and a lesser-known labor case involving discrimination against African-American railroad workers. After examining the …

The Evolving Police Power: Some Observations For A New Century, Glenn H. Reynolds, David B. Kopel Jan 2000

The Evolving Police Power: Some Observations For A New Century, Glenn H. Reynolds, David B. Kopel

UC Law Constitutional Quarterly

The conventional wisdom about the scope of state police powers goes like this: in the early days of the Republic, legitimate regulation existed only to prevent concrete harm to specified interests. Sometime around the previous turn of the century, the scope of state police powers expanded; states could regulate as they chose so long as they claimed to be working to promote the public safety, welfare, or morality. This article examines a number of recent state constitutional decisions having to do with sodomy, parenting, marriage, and procreation and argues that in deciding these cases the courts are returning to the …

The Education Crisis For Children In The California Juvenile Court System, Kathleen Kelly Jan 2000

The Education Crisis For Children In The California Juvenile Court System, Kathleen Kelly

UC Law Constitutional Quarterly

In all the debate about the burgeoning number of youth incarcerated in California juvenile justice systems or living in foster care because of abuse and neglect, few have recognized the growth of an immense and insidious crisis affecting the children supervised by the juvenile court. The crisis lies in the overwhelming number of children - court dependents and delinquents alike - who suffer from educational deficiencies and disabilities. This Article addresses the educational needs of both juvenile delinquents and dependents (victims of child abuse and neglect). Next, it explores numerous legal avenues to tackle this crisis, which includes relying on …

Constitutionality Of State And Local Selective Purchasing Legislation: A 9-0 Supreme Court Decision In Favor Of And In Defeat Of Plaintiff, Rebecca S. Hartley Jan 2000

Constitutionality Of State And Local Selective Purchasing Legislation: A 9-0 Supreme Court Decision In Favor Of And In Defeat Of Plaintiff, Rebecca S. Hartley

UC Law Constitutional Quarterly

In a 9-0 decision handed down in 2000, the Supreme Court struck down a Massachusetts selective purchasing law that restricted state agencies from trading with companies doing business in Burma. The Court based its decision on the narrow grounds that the law violated the Supremacy Clause of the U.S. Constitution. In the wake of so limited a decision, a number of constitutional questions remain unanswered regarding the rights of states to enact laws intruding upon federal foreign affairs.

This article examines three of the main areas of constitutional challenges to state actions in the foreign affairs arena from current orthodox …

Chinese Law, Trade And The New Century, Robert C. Berring Jan 2000

Chinese Law, Trade And The New Century, Robert C. Berring

Northwestern Journal of International Law & Business

China crammed a great deal of political activity into the 20th Century. In the year 1900 the Q'ing Dynasty still ruled the remnants of an ancient empire. The Q'ing conspired with rebels in the Boxer Rebellion in the hopes of expelling all foreigners from Chinese soil and returning to splendid isolation. In the year 2000 China is a superpower balancing communist theory and a capitalist market that is about to join the World Trade Organization. The intervening years saw warlords, democrats, fascists, Marxists and all stripes of communists leading the world's largest nation. As China enters the new millennium of …

Blending Hf Radar And Model Velocities In Monterey Bay Through Normal Mode Analysis, B. L. Lipphardt Jr., A. D. Kirwan Jr., C. E. Grosch, J. K. Lewis, J. D. Paduan Jan 2000

Blending Hf Radar And Model Velocities In Monterey Bay Through Normal Mode Analysis, B. L. Lipphardt Jr., A. D. Kirwan Jr., C. E. Grosch, J. K. Lewis, J. D. Paduan

CCPO Publications

Nowcasts of the surface velocity field in Monterey Bay are made for the period August 1-9, 1994, using HF radar observations blended with results from a primitive equation model. A spectral method called normal mode analysis was used. Objective spatial and temporal filtering were performed, and stream function, velocity potential, relative vorticity, and horizontal divergence were calculated over the domain. This type of nowcasting permits global spectral analysis of mode amplitudes, calculation of enstrophy, and additional analyses using tools like empirical orthogonal functions. The nowcasts reported here include open boundary flow information from the numerical model. Nowcasts using no open …

Proceedings Of The 2nd Conference Of Doctoral Education In Design (2000): Foundations For The Future, David Durling, Ken Friedman

DRS Conference Volumes

The La Clusaz conference focused on four central themes:

1 philosophies and theories of design

2 foundations and methods of design research

3 form and structure for the doctorate in design

4 the relationship between practice and research in design

Participants presented findings, debated ideas, proposed benchmarks for the future development of the doctorate in design, and entered into dialogue on how to develop programs. The conference encouraged participants to interact, using each session as a genuine opportunity to confer. One important goal of the conference was establishing significant working relationships, research alliances, and partnerships among universities.

Change Is Needed: The Taxation Of Alimony And Child Support, Laura Bigler Jan 2000

Change Is Needed: The Taxation Of Alimony And Child Support, Laura Bigler

Cleveland State Law Review

When a marriage dissolves there are tax consequences for everything from distribution of property to custody of the couple's children. The current tax system for alimony and child support strengthens the possibility of financial devastation. Under the present system, alimony and child support have opposite tax treatment. Many complicated rules have been added to distinguish between alimony and child support, which will be discussed later in this paper. There must be a simplification of the present law so that the average divorced taxpayer will be able to understand and implement the rules with or without sophisticated tax counsel or an …

How Federal Transfer Taxes Affect The Development Of Property Law , Ira Mark Bloom Jan 2000

How Federal Transfer Taxes Affect The Development Of Property Law , Ira Mark Bloom

Cleveland State Law Review

This topic, How Federal Transfer Taxes Affect the Development of Property Law, makes the basic assumption that, to some extent, property law exists because of the federal wealth transfer tax system. As will be seen, this assumption is correct. In some instances, however, property laws exist because of the federal transfer tax system. I classify such property laws into three categories: the necessary, the appropriate and the unfortunate. In the remainder of this article, I will give examples of federal transfer tax-based property laws in these three categories. By way of illustration, I will primarily rely on statutory laws of …

Targets For Transformation: A Strategic Plan For The Syracuse University Library, 2000-2005, Roberta B. Gwilt, Martha J. Hanson, Kelley Lasher, Pamela Whiteley Mclaughlin, Lisa Moeckel, Suzanne Preate

Librarian Publications

A strategic plan is a tool that enables an organization to revitalize itself and focus on a set of mission-critical goals over a period of time. A well-crafted plan intentionally implemented and consistently monitored promotes success in strategic areas and provides a foundation for transforming services, technology, collections, and infrastructure to meet the constantly evolving needs and demands of teaching, research, and scholarly communication. A strategic plan:

  • articulates commonly held values and a shared sense of purpose and mission
  • proposes goals and assesses progress to those goals
  • informs decision-making
  • enables action within a larger context that is known and understood …

The Krobo And Bodom, Kirk Stanfield Jan 2000

The Krobo And Bodom, Kirk Stanfield

BEADS: Journal of the Society of Bead Researchers

Certain relatively large beads, almost always found in Ghana, have come to be called "bodom" by bead traders, collectors, and researchers. Most students of this bead believe it is the product of the Krobo powder-glass industry proliferating today in southeastern Ghana. Upon closer inspection, however, there appear to be two distinct groups of bodom that we may, for convenience, call "old" and "new." While the new bodom are definitely made in Ghana today, using techniques that have been observed and documented, the old bodom are substantially different in enough ways to suggest that they were made elsewhere by other methods. …
