The Rights Of Common Carriers And The Decision Whether To Be A Common Carrier Or A Non-Regulated Communications Provider, James H. Lister Dec 2000

The Rights Of Common Carriers And The Decision Whether To Be A Common Carrier Or A Non-Regulated Communications Provider, James H. Lister

Federal Communications Law Journal

The decision whether to be a regulated common carrier or a non-regulated communications provider carries with it numerous benefits and burdens that must be weighed. Although one may automatically assume that non-regulation is preferable, that may not always be the case. This Article directly addresses the decision of whether to be a lightly-regulated non-dominant common carrier or a non-regulated private carrier. The Article argues that certain statutory and regulatory rights enjoyed by common carriers are more important than the minimal regulatory burdens associated with non-dominant common carrier regulation.

Universal Service High-Cost Subsidy Reform: Hindering Cable-Telephony And Other Technological Advancements In Rural And Insular Regions, Emily L. Dawson Dec 2000

Universal Service High-Cost Subsidy Reform: Hindering Cable-Telephony And Other Technological Advancements In Rural And Insular Regions, Emily L. Dawson

Federal Communications Law Journal

Universal service is a public policy initiative designed to ensure that all United States citizens receive widespread access to affordable telecommunications services. Customers in high-cost service regions such as rural and insular areas are typically excluded from the latest telecommunications technology. Most large carriers serving these regions prefer to implement technological updates in urban areas where profit margins are higher while allowing the rural infrastructure to deteriorate. The Federal Universal Service Fund currently offers subsidies to telecommunications providers serving high-cost regions, but the FCC has announced efforts to reform the subsidy allocation system that could potentially impede technological advancement in …

Communications Media And The First Amendment: A Viewpoint-Neutral Fcc Is Not Too Much To Ask For, Helgi Walker Dec 2000

Communications Media And The First Amendment: A Viewpoint-Neutral Fcc Is Not Too Much To Ask For, Helgi Walker

Federal Communications Law Journal

In the "new economy" driven by the telecommunications industry, the FCC is a busy agency. Given the myriad legal issues faced daily by agency decisionmakers and the lack of perfect clarity in major communications legislation, a few legal missteps here and there by the FCC might be expected. In one area, however, the public can and should demand a first-rate agency record: regulation of communications media without regard to the viewpoint expressed via that media, as the First Amendment requires. This Article offers two case studies in which the FCC arguably took viewpoint-discriminatory actions with regard to regulated broadcasters, and …

The Fcc And Section 312(A)(7) Of The Communications Act Of 1934: The Development Of The “Unreasonable Access” Clause, Philip J. Gutwein Ii

Federal Communications Law Journal

Section 312(a)(7) of the Communications Act of 1934 requires that broadcast stations provide legally qualified candidates for federal elective office with reasonable access to advertising time on behalf of their candidacies. The FCC has long struggled with defining "reasonable access." On September 7, 1999, the FCC issued a Memorandum Opinion and Order in which it ruled that broadcast stations may not refuse a request for political advertising time solely because the station does not sell or program such lengths of time. This ruling came in response to a petition for reconsideration of an October 3, 1994 Declaratory Ruling, filed by …

Too Much Power, Too Little Restraint: How The Fcc Expands Its Reach Through Unenforceable And Unwieldy “Voluntary” Agreements, Bryan N. Tramont Dec 2000

Too Much Power, Too Little Restraint: How The Fcc Expands Its Reach Through Unenforceable And Unwieldy “Voluntary” Agreements, Bryan N. Tramont

Federal Communications Law Journal

The character of a regulatory agency is most severely tested at the zenith of its power. When the Federal Communications Commission ("FCC" or "Commission") breaks free of the limitations imposed by the law, the Commission’s leadership sets its own course. It is at these times, when legal oversight is at a minimum, that it becomes most important for the agency to "pay more attention to justice." Unfortunately, as outlined in this Article, the FCC has often failed this test of institutional character. In at least three contexts, the Commission has proven to be something less than a benevolent master. In …

Participant Reference In Narrative Discourse: A Comparison Of Three Methodologies, Stephen A. Clark Dec 2000

Participant Reference In Narrative Discourse: A Comparison Of Three Methodologies, Stephen A. Clark

Theses and Dissertations

In recent years several linguists have developed quantitative methods for analyzing and describing how speakers of languages refer to activated participants in narrative discourse. One of the first of these was Talmy Givon, whose method (referred to by some as the Recency/Distance method) measured three factors in participant reference: referential distance, potential interference, and persistence. A few years later, Russell Tomlin proposed an alternative model, which he labeled the Episode/Paragraph method. He felt that Givon's method fails to account for the fact that the thematic paragraphs or "episodes" found in narrative texts largely determine the amount of coding material used. …

The Academic Achievement And Psychological Functioning Of College Students With A Family History Of Alcoholism, Rachel M. Dodd Dec 2000

The Academic Achievement And Psychological Functioning Of College Students With A Family History Of Alcoholism, Rachel M. Dodd

Theses and Dissertations

Fifty adult children of alcoholics (ACAs) and 50 non-ACAs in an undergraduate college student sample were compared on standardized measures of emotional functioning, alcohol consumption, academic achievement, and cognitive ability. A 2 (parental alcoholism status) X 2 (gender) multivariate analysis of variance (MANOVA) was performed on each of the four categories of dependent variables. The MANOVAs were followed by univariate analyses of variance (ANOVAs) to determine which variables contributed to the multivariate effect.

With respect to emotional functioning, differences between ACAs and non-ACAs were found for males but not females. Male ACAs reported significantly more current anxiety and long-standing anxiety …

Evolution Of Philippine Businesses: Response To Internal And External Turbulence: Review Of Literature And A Framework For A Research Program, Ma. Andrea L. Santiago

Angelo King Institute for Economic and Business Studies (AKI)

The Philippine business environment undoubtedly is characterized as having a boom and bust cycle. It has not been able to take off as compared to its neighboring countries (Lim, 1999). Now more than ever, the political and economic environment has become a big challenge for many local businesses.

In spite, or because, of the current environment there are businesses that continue to prosper. On the one extreme are the large conglomerates that have the muscle to withstand major shocks and the on other are the smaller entrepreneurial ventures that are flexible and able to seize upon opportunities quickly.

In trying …

Causality And Subjectivity In The Religious Quest, Ursula Goodenough

Biology Faculty Research

The dynamics of seeking causation and the dynamics of subjectivity are presented and then brought together in a consideration of the three core components of the religious quest: the search for and experience of ultimate explanations, the interiority of religious experience (“spirituality”), and the empathic experience of religious fellowship.

Optimization Of A Helicon Plasma Source For Maximum Density With Minimal Ion Heating, Matthew M. Balkey

Graduate Theses, Dissertations, and Problem Reports (ETD)

Measurements of electron density and perpendicular ion temperatures in an argon helicon plasma are presented for five different antennas: A Nagoya type III antenna, a double-saddle antenna, a 19 cm long m = +1 helical antenna, a 30 cm long m = +1 helical antenna and a 19 cm m = +1 helical antenna with wide straps. Electromagnetic wave measurements in the range from 100 kHz to 50 MHz are also presented for a wide range of plasma parameters. The data show a clear transition between RF power coupling to the plasma to create density and coupling to heat ions. …

Increasing Telephone Penetration Rates And Promoting Economic Development On Tribal Lands: A Proposal To Solve The Tribal And State Jurisdictional Problems, Jennifer L. King Dec 2000

Increasing Telephone Penetration Rates And Promoting Economic Development On Tribal Lands: A Proposal To Solve The Tribal And State Jurisdictional Problems, Jennifer L. King

Federal Communications Law Journal

Under the Telecommunications Act of 1996, Congress instructed the FCC to ensure that all Americans have access to affordable telecommunications services. Consistent with that mandate, the FCC implemented a series of public hearings to discuss with tribes the issues they face concerning low telephone penetration rates. The FCC recommended investigation of universal service in unserved and underserved areas because telephone penetration rates among low-income consumers on tribal lands lagged behind rates in the rest of the country. From these hearings, the FCC proposed a jurisdictional framework to determine which eligible carriers would be under tribal, state, or federal jurisdiction. This …

Evidence, Marc T. Treadwell Dec 2000

Evidence, Marc T. Treadwell

Mercer Law Review

Hard cases, it is said, make bad law. Criminal prosecutions for child molestation and abuse are likely the hardest cases of all. Apart from their horrific facts, they present tremendous evidentiary challenges to prosecutors, primarily because of the victims' youth. Consequently, Georgia's appellate courts have repeatedly fashioned new evidentiary rules to assist prosecutors in such cases. Whether these hard cases make bad law no doubt depends on one's perspective. Without question, however, appeals involving child molestation and abuse continue to make new law, and the current survey period was no exception.
