Towards A Defensible Free Exercise Doctrine, Frederick Mark Gedicks Jan 2000

Towards A Defensible Free Exercise Doctrine, Frederick Mark Gedicks

Faculty Scholarship

Almost from the moment that the Supreme Court abandoned the religious exemption doctrine in Employment Division v. Smith, its defenders have worked to bring it back. More than a decade later, however, Smith remains well-entrenched; not only has the Court confirmed Smith's basic holding, but it also struck the Religious Freedom Restoration Act, Congress's first effort to restore the exemption doctrine, at least as it applied to the states.

Proponents of religious exemptions cannot ignore the hard truth that they can no longer be defended. During the nineteenth and early twentieth centuries, American society viewed the practice of religion-mostly Christian …

Articles

We clinically assessed and performed polymerase chain reaction analysis for the GAA trinucleotide repeat expansion in 103 patients from 73 families in Ireland, with a prior clinical diagnosis of Friedreich’s ataxia (FA) or an unclassified progressive ataxic syndrome. The patients were classified as “typical” or “atypical” FA according to Harding’s mandatory clinical diagnostic criteria. All patients underwent blood glucose analysis, and electrocardiography and echocardiography was performed in 99 and 101 patients, respectively. Mutation screening for expanded CAG trinucleotide repeats, associated with spinocerebellar ataxia (SCA) 1, 2, 3 and 6 was performed in 86 patients overall, including all GAA negative patients. …

Consortia Vs Reform: Creating Congruence, Margaret Landesman, Johann Van Reenen Jan 2000

Consortia Vs Reform: Creating Congruence, Margaret Landesman, Johann Van Reenen

University Libraries & Learning Sciences Faculty and Staff Publications

The inability of research libraries to offer the collections their users desire has become more pronounced each year. In response, libraries have moved in two directions: the rapidly growing consortial movement and the movement to advocate and support reforms in scholarly communication. However, if libraries do not pay careful attention, these two directions may, at least partially, cancel one another out.

Through The Eye Of The Beholder: Multiple Perspectives On Quality In Women's Health Care, Jaynelle F. Stichler, Marianne E. Weiss Jan 2000

Through The Eye Of The Beholder: Multiple Perspectives On Quality In Women's Health Care, Jaynelle F. Stichler, Marianne E. Weiss

College of Nursing Faculty Research and Publications

Quality is an illusive concept with different meanings to different people. Providers often define quality in terms of patient outcomes, professional standards of practice, predetermined criteria used to measure quality, and even subjective opinion. Patients describe quality in terms of the interpersonal aspects of care, how well they were treated, and the responsiveness of the provider to their needs. This qualitative study using a semi-structured interview defined quality from the perspectives of patients, physicians, nurses, and payers associated with a hospital-based women's service line, and how the attributes of quality varied among the multiple groups. The study also described how …

Thickness Variation Of Self-Processing Acrylamide-Based Photopolymer And Reflection Holography, F. O'Neill, Justin Lawrence, J. Sheridan Jan 2000

Thickness Variation Of Self-Processing Acrylamide-Based Photopolymer And Reflection Holography, F. O'Neill, Justin Lawrence, J. Sheridan

Articles

There are many types of holographic recording material. The acrylamide-based recording material examined here has one significant advantage: it is self-processing. This simplifies the recording process and enables holographic interferometry to be carried out without the need for complex realignment procedures. However, the effect that the polymerization process has on the grating thickness must be examined. This question is fundamental to the material's use in holographic optical elements, as thickness variations affect the replay conditions of the produced elements. This paper presents a study of this thickness variation and reports for the first time the production of reflection holographic gratings …

Production Of A Signal By Irradiated Cells Which Leads To A Response In Unirradiated Cells Characteristic Of Initiation Of Apoptosis, Fiona Lyng, C. Seymour, C. Mothersill Jan 2000

Production Of A Signal By Irradiated Cells Which Leads To A Response In Unirradiated Cells Characteristic Of Initiation Of Apoptosis, Fiona Lyng, C. Seymour, C. Mothersill

Articles

This study investigated the ability of medium from irradiated cells to induce early events in the apoptotic cascade, such as mobilization of intracellular calcium, loss of mitochondrial membrane potential and increase in reactive oxygen species, in cells which were never exposed to radiation. Medium from irradiated human keratinocytes was harvested and transferred to unirradiated keratinocytes. Endpoints characteristic of the initiation of apoptosis were monitored for a period of 24 h following medium transfer. Clonogenic survival was also measured. Rapid calcium fluxes (within 30 s), loss of mitochondrial membrane potential, increases in reactive oxygen species (from 6 h after medium transfer), …

Proclamation-Based Principles Of Parenting And Supportive Scholarship, Craig H. Hart, Lloyd D. Newell, Lisa L. Sine Jan 2000

Proclamation-Based Principles Of Parenting And Supportive Scholarship, Craig H. Hart, Lloyd D. Newell, Lisa L. Sine

Faculty Publications

How parents view the nature of a child and their own role as parents has great influence over the life of that child. Many perspectives about the nature of children have arisen in the course of Western Civilization that have shaped childrearing practices for centuries, including the increasingly accepted scholarly view that parents matter relatively little in children’s lives. (2) This chapter emphasizes inspired, eternal principles that are supported by empirical and conceptual scholarship, which suggests that optimal parenting does indeed matter in children’s lives.

The Impact Of Decision Making On Tourism And The Environment In St. Kitts, William Rodney Gerdsen Jan 2000

The Impact Of Decision Making On Tourism And The Environment In St. Kitts, William Rodney Gerdsen

Open Access Master's Theses

The wider Caribbean region is at a critical juncture in its development as a tourism dependent regional economy. After more than twenty years of outstanding growth in tourist arrivals and foreign currency earning, the prospects for continued growth depends on maintaining the pristine environment on which tourism has come to rely. However, with more tourists comes increased pressure on the finite natural resources. It is ironic that the tourism industry has become one of the biggest causes of environmental decay and stands to be one of its first victims.

In planning to develop an island economy based on tourism, it …

The Colors And Shadows Of My Word(S), Lydia A. Saravia Jan 2000

The Colors And Shadows Of My Word(S), Lydia A. Saravia

Open Access Master's Theses

If I find my voice, I will find my identity. Voice gives identity meaning. The acquisition of language (voice) means an acquisition of subjectivity (identity). A search for an identity is a search for voice. But formation of identity is difficult when multiple layers of subjectivity are to be considered: the layer of dual culture, in this case Guatemala and the United States, the layer of an urban environment, the layer of a working-class status, the layer of being female, which are all major players in the development of voice. To make sense of, and find a voice for, a …

An Analysis Of The Rhetoric Of Wilme Mankiller, Lynda D. Peters Jan 2000

An Analysis Of The Rhetoric Of Wilme Mankiller, Lynda D. Peters

Open Access Master's Theses

This thesis examines the rhetoric of Wilma Mankiller, first woman elected Principal Chief of the Cherokee Nation. Although some research has addressed Native American oratory, this study is the first to this writer’s knowledge, that critically evaluates the public discourse of Mankiller. This analysis reveals a distinct relationship in the characteristics of the rhetoric of Wilma Mankiller that are inherent in the unique cultural heritage of Native American oratory.

A study of Native American oratory in general, a study of Cherokee oratory, and a study of the rhetoric of Wilma Mankiller were conducted. This analysis employed the neo-Aristotelian approach in …

Gendered Communication Among Second Generation Danish Americans In The "Blair Church:" A Study In Progress, John Mark Nielsen Jan 2000

Gendered Communication Among Second Generation Danish Americans In The "Blair Church:" A Study In Progress, John Mark Nielsen

The Bridge

I am not nor do I pretend to be an expert on gendered communication or feminist criticism. I have, however, used Carol Gilligan's In A Different Voice and Deborah Tannen's You Just Don't Understand in classes with good results.1 While students differ in their responses, these works are accessible to many and have inspired good discussion about how gender may affect decision-making and impact the way messages are sent and received. Additionally, I have found writings by Peggy McIntosh, Carol Smith-Rosenberg, and Barbara Welter helpful in exploring and thinking about the writings of American women writers of the pre-Civil War …

Soul For Sale: An Empirical Study Of Associate Satisfaction, Law Firm Culture, And The Effects Of Billable Hour Requirements, Susan Saab Fortney Jan 2000

Soul For Sale: An Empirical Study Of Associate Satisfaction, Law Firm Culture, And The Effects Of Billable Hour Requirements, Susan Saab Fortney

Hofstra Law Faculty Scholarship

Although billable hour pressure has taken a toll on partners as well as associates, associates appear to be the most disenchanted casualties of the billable hour derby. In discussing attorney dissatisfaction, some authors have relied on the results of studies of law students and attorneys, noting that there is a limited amount of empirical data on the state of the profession. In an attempt to help fill the gap, I conducted an empirical study to gauge the effects of billable hour pressure and practices on the current crop of associates.

The information obtained in my study provides guidance in both …

Intervention Selection For Students With Asperger's Disorder, Tracy Lynn Gappa Jan 2000

Intervention Selection For Students With Asperger's Disorder, Tracy Lynn Gappa

Dissertations and Theses @ UNI

The diagnosis of Asperger's Disorder (AsD) is a relatively recent possibility. Although first described in 1944, AsD was not recognized until its inclusion in the Fourth Edition of the Diagnostic and Statistical Manual of Mental Disorders in 1994. Due to the newness of the disorder and because of a lack of a consensual definition, there is considerable confusion among researchers in this field. For those children with characteristics of AsD, the confusion has resulted in misdiagnosis and, more importantly, inappropriate interventions. Individuals with AsD have deficits in several areas that impair their ability to function normally in the educational environment, …

Use Of The Client Oriented Scale Of Improvement As A Clinical Outcome Measure In The Veterans Affairs National Hearing Aid Program, Robert F. Zelski Jan 2000

Use Of The Client Oriented Scale Of Improvement As A Clinical Outcome Measure In The Veterans Affairs National Hearing Aid Program, Robert F. Zelski

USF Tampa Graduate Theses and Dissertations

In the present health care environment, there is an increased demand for audiologists to measure the outcomes of hearing aid intervention. In addition to the more traditional objective outcome measures, many subjective outcome measures have been developed in the last 20 years. Two such subjective outcome measures are the Abbreviated Profile of Hearing Aid Benefit (APHAB) and the Hearing Handicap Inventory for the Elderly (HHIE). These instruments consist of a series of pre-selected questions that may or may not be applicable to an individual. An alternative to the pre-selected question format is an open format design that allows the person …

Free Speech On The Internet: Regulating Web Authorship By Students, Rhoda J. Yen Jan 2000

Free Speech On The Internet: Regulating Web Authorship By Students, Rhoda J. Yen

Computer Law Review and Technology Journal

As Internet use increases, more websites authored by students will populate the World Wide Web (WWW). Indeed, about one-third of all personal websites now belong to students, who are mostly minors.' Students' increasing use of the web raises new questions about free speech. This article addresses one of them: May schools censor student-created websites? If so, under what circumstances may they delete pages, edit pages, or discipline students for website speech?

In answering this question, this article looks for guidance to the history of free speech in the classroom. And examining the problem from a free-speech perspective is appropriate. If …

Qualitative Analysis Of Indigo Precursors From Woad By Hplc And Hplc‐Ms, Kg Gilbert (Nee Stoker), Dj Hill, C Crespo, A Mas, Et Al

Peninsula Medical School

A qualitative method has been devised to analyse the indigo precursors in leaf extracts of woad (Isatis spp.) using HPLC coupled to an evaporative light scattering detector and confirmed using HPLC coupled, on line, to a particle beam mass spectrometer. Using this technique, indican has been positively identified in shoot extracts of European (I. tinctoria) and Chinese (I. indigotica) woad. Greater amounts of indican were found in the Chinese compared with the European woad. Copyright © 2000 John Wiley & Sons, Ltd.

The European Union: Cross-National Variation In Public Support, 1993, Jarrett Ruffino '00

Res Publica - Journal of Undergraduate Research

With the adoption of the Single European Act in 1985 and the Maastricht Treaty in 1991, the EU began dealing forcefully with issues pertaining to monetary union, social policy, foreign policy, and constitutional reform. Public opinion became increasingly important as national governments began formulating policies based on decisions in Brussels, Strasbourg, and Luxembourg that affected domestic policies.

Benefits By Gender: Determinants Of Welfare Accessibility For Migrant Women In Western Euope, Kathryn Vojack '00 Jan 2000

Benefits By Gender: Determinants Of Welfare Accessibility For Migrant Women In Western Euope, Kathryn Vojack '00

Res Publica - Journal of Undergraduate Research

European countries accommodate, on average, 1,000 to 2,000 immigrants per year . Since immigration is a continuous occurrence within Europe, regulations regarding immigrant rights and privileges have been introduced. The European Union (EU) has developed legislation such as Council Regulation 1612/68 on Free Movement of Workers and the Maastrict Treaty to ensure equal access, establishment, and employment for incoming persons regardless of their natural place of origin, and equalize available benefits for migrants between member states. Why are some countries more generous to migrant women than others? Specifically what are the determinants of accessibility to social welfare benefits to migrant …

Loneliness And Self-Esteem At Different Levels Of The Self, Kiley L. Bednar '00 Jan 2000

Loneliness And Self-Esteem At Different Levels Of The Self, Kiley L. Bednar '00

Honors Projects

Loneliness is proposed to have three dimensions: isolation, connectedness, and belongingness (Hawkley, et aI., 1999). In an extension of the work by Hawkley and colleagues (1999), these levels are hypothesized to be a function of three unique aspects of self: personal, relational, and collective. Brewer (1996) proposed that self-esteem is experienced differently at each level of self. Personal self-esteem is how a person feels about himself or herself based on his or her individual traits and characteristics. Relational self-esteem is based on whether a person believes that he or she exhibits appropriate behavior in a one-on-one relationship. Collective self-esteem is …

User-Centred Methods In The Analysis And Design Of Software Tools To Support Management Consultants, Mark Dixon Jan 2000

User-Centred Methods In The Analysis And Design Of Software Tools To Support Management Consultants, Mark Dixon

School of Engineering, Computing and Mathematics Theses

The aim of the present work was to investigate the development of improved software tools for management consultants, and to investigate the effectiveness of augmented user-centred methods in this development, and thereby consider the more general use of augmented user-centred methods to develop software tools that support creative human activity systems. The research method used draws from and integrates aspects of user-centred design, soft systems methods, structured systems analysis and design, and software engineering. This includes using user literature, 'thinking aloud' role play observations, and interviews to develop a user model of the management consultancy process; using literature of related …
