Limitation Of Liability, Craig Allen Jan 2000

Limitation Of Liability, Craig Allen

Articles

From the list of "problems" with the Limitation Act in the U.S. that are within the federal courts' power to resolve, I have elected to discuss three. Necessarily, the coverage of each problem will be brief. After a short summary of the Limitation Act's principal features, the essay examines the recurring confusion over the relevance of unseaworthiness in limitation actions. Second, it highlights the need to update the courts' choice of law doctrine for limitation issues. Finally, it turns to an issue that is only beginning to emerge, and one which the federal courts may yet save from idiosyncratic precedents …

Electronic Records And Signatures Under The Federal E-Sign Legislation And The Ueta, Robert A. Wittie, Jane K. Winn Jan 2000

Electronic Records And Signatures Under The Federal E-Sign Legislation And The Ueta, Robert A. Wittie, Jane K. Winn

Articles

Federal legislation establishing legal parity between electronic records and signatures and their paper and ink counterparts was signed into law June 30, 2000, and became effective, at least for most purposes, on October 1. The Electronic Signatures in Global and National Commerce Act (E-SIGN or the Act) effectively sweeps away a myriad of anachronistic and inconsistent state and federal requirements for paper and ink documents and signatures. In so doing, E-SIGN eliminates many of the legal uncertainties that have surrounded the use of electronic media in commerce and should enable businesses and consumers alike to more fully realize the cost …

Making Xml Pay: Revising Existing Electronic Payments Law To Accommodate Innovation, Jane K. Winn Jan 2000

Making Xml Pay: Revising Existing Electronic Payments Law To Accommodate Innovation, Jane K. Winn

Articles

Many businesses today are rushing to embrace "e-Business" technologies in a mad scramble to remain competitive. Only a few years ago, simply using email instead of faxes or phone calls, converting a purchasing system to EDI technology, or building a corporate Web site might have seemed like important advances in the use of new information technologies.

Businesses are now moving beyond such "electronic commerce" technologies and trying to integrate their disparate information systems and business processes into a comprehensive new "e-Business" structure. At the heart of this new model for business organization is the idea that information and resources should …

The Myth Of The Win-Win: Misdiagnosis In The Business Of Reassembling Nature, William H. Rodgers, Jr. Jan 2000

The Myth Of The Win-Win: Misdiagnosis In The Business Of Reassembling Nature, William H. Rodgers, Jr.

Articles

This Article starts with a closer than customary look at the most serious obstacle to the ambitious campaign of environmental restoration that is the focus of this Symposium. That obstacle is the human brain.

The Article contends that human cognitive processes are marvelous designers of serviceable self-deceptions. In the war on nature that we witnessed in the twentieth century the most functional of these is the firm belief in a non-zero sum world. This is the conviction that gains from economic development could be enjoyed without sacrifice of the natural world.

This is a convenient, powerful, and serviceable myth although …

Who Exactly Is Living La Vida Loca: The Legal And Political Consequences Of Latino-Latina Ethnic And Racial Stereotypes In Film And Other Media, Ediberto Román Jan 2000

Who Exactly Is Living La Vida Loca: The Legal And Political Consequences Of Latino-Latina Ethnic And Racial Stereotypes In Film And Other Media, Ediberto Román

Faculty Publications

This piece, however, will not simply expose the insidious stereotypes of Latinas and Latinos. It will undertake the more involved task of drawing a nexus between the societal prejudice which leads to the stereotyping and the legal and political consequences that result from it. Specifically, I argue that these media images, myths, metaphors, and stereotypes play a critical role in establishing society's vision of Latinas and Latinos. In other words, these stereotypes serve to reinforce both the characterizations of Latinas and Latinos from the perspectives of both the dominant and the dominated. These stereotypes, in turn, foster and perpetuate two …

Private Order Under Dysfunctional Public Order, John Mcmillan, Christopher Woodruff Jan 2000

Private Order Under Dysfunctional Public Order, John Mcmillan, Christopher Woodruff

Michigan Law Review

Businesspeople need contractual assurance. Most transactions are less straightforward than a cash sale of an easily identifiable item. Buyers need assurance of the quality of what they are purchasing, and sellers need assurance that bills will be paid. The legal system may not always be available to provide contractual assurance - and when the law is dysfunctional, private order might arise in its place. Many developing and transition economies have dysfunctional legal systems, either because the laws do not exist or because the machinery for enforcing them is inadequate. In such countries, bilateral relationships, communal norms, trade associations, or market …

Letters Of Credit As Signals: Comments On Ronald Mann's 'The Role Of Letters Of Credit In Payment Transactions', Clayton P. Gillette Jan 2000

Letters Of Credit As Signals: Comments On Ronald Mann's 'The Role Of Letters Of Credit In Payment Transactions', Clayton P. Gillette

Michigan Law Review

Why would buyers and sellers transact with each other through a third party that charges a significant fee for its services and that typically is authorized to make payment notwithstanding noncompliance with the very prerequisites that it has been engaged to monitor? This is the puzzle that Ronald Mann's provocative and nuanced article purports to explain. Under the traditional story about the esoteric world of letters of credit, these transactions allow distant buyers and sellers to circumvent obstacles that would otherwise frustrate long-distance transactions. The traditional story explains that these credits induce buyers to approve payment prior to receiving conforming …

On The Use Of Practitioner Surveys In Commercial Law Research: Comments On Daniel Keating's 'Exploring The Battle Of The Forms In Action', Avery Wiener Katz Jan 2000

On The Use Of Practitioner Surveys In Commercial Law Research: Comments On Daniel Keating's 'Exploring The Battle Of The Forms In Action', Avery Wiener Katz

Michigan Law Review

As Daniel Keating's principal article attests, the literature on U.C.C. section 2-207 and the "battle of the forms" is both vast and intricate. 1 That fact, together with the distinguished array of commentators assembled here, makes it unlikely that I will be able to say anything substantially original on that subject. Accordingly, in the spirit of this overall symposium, I will focus the bulk of my remarks not on the substantive issues raised by Keating's article, but on his methodology. In particular, I will suggest that Keating's empirical method - the free-form, oral interview conducted personally by the principal researcher …

Interactive Televised Instruction: Factors That Influence Student Evaluations Of Business Courses., Lorraine P. Anderson Jan 2000

Interactive Televised Instruction: Factors That Influence Student Evaluations Of Business Courses., Lorraine P. Anderson

Graduate Theses, Dissertations, and Problem Reports (ETD)

This study examined levels of student satisfaction in business courses offered at Marshall University through an interactive television delivery system to determine whether the delivery method influenced student satisfaction. Based on Clow's (1999) contention that remote-site students might bias their answers to specialized survey instruments that assess student attitudes in ITV classes, standardized student course evaluations completed at the end of the semester at traditional classroom based sites, host ITV sites and remote sites were used to measure student satisfaction. Responses to the instrument were analyzed for 3,282 students who enrolled in business courses during the Fall 1997 semester through …

The Identification Of Listening Styles Of Agricultural Curricula Majors Through The Administration Of The "Listening Styles Profile"., Jennifer L. Thomas

Graduate Theses, Dissertations, and Problem Reports (ETD)

This study was designed to determine listening preferences of undergraduate agricultural curricula majors attending West Virginia University during the1998 spring semester according to the Listening Styles Profile. The Listening Styles Profile defines listening preferences in four main categories: People-Oriented, Action-Oriented, Content-Oriented, and TimeOriented. The objectives of this study were to define listening preferences of undergraduate agricultural curricula majors and determine if listening styles are influenced by demographics. The demographic variables included: home location, rank, gender, grade point average, and major. It was concluded that agricultural curricula majors are predominantly People-Oriented listeners. Listener preferences of agriculture majors are not influenced by …

Middle School Reading Clubs: A First Step Toward Increasing Pleasure-Reading Time, James Fazzone Jan 2000

Middle School Reading Clubs: A First Step Toward Increasing Pleasure-Reading Time, James Fazzone

Theses and Dissertations

This report describes the plans for, implementation of, and results of a reading club program conducted at a middle school. This program was a modification of an unsuccessful one that was criticized by the staff and students for lack of structure and meaning. The literature supported the need for students taking time out of the school day for pleasure reading. Krashen (1993), Atwell (1998), and Irvin (1998) all have recommended that students should be permitted to read appropriate reading materials of their choice and that they should be provided with a wide range of materials from which to choose. Therefore, …

Kosovo And The Great Air Power Debate, Daniel L. Byman, Matthew C. Waxman Jan 2000

Kosovo And The Great Air Power Debate, Daniel L. Byman, Matthew C. Waxman

Faculty Scholarship

The following section provides an overview of how to think about air power and coercion, addressing several key limits of the current literature. We next examine NATO goals in Kosovo and the mixed success eventually achieved. Using that baseline, we explore various explanations for Belgrade's eventual capitulation and clarify how air power's role in each of them should be understood; we leave aside the issue of whether coercion was a proper strategy for addressing the Balkan crisis and focus instead on how to assess air power as a tool of that strategy. We conclude with recommendations for recasting the air …

A Burkean Analysis Of Aung San Suu Kyi's Leadership Role In The Political Development Of Burma, Jayshri H. Patel Jan 2000

A Burkean Analysis Of Aung San Suu Kyi's Leadership Role In The Political Development Of Burma, Jayshri H. Patel

There has not been any rhetorical analysis of Aung San Suu Kyi as of yet. Chapter 1 covers the political history of Burma in detail; it will cover the monarchy period, the British colonization, and the struggle for independence. Chapter 2 will concentrate on …

Detoxification Of 4-Nitroquinoline 1-Oxide And Benzo(A)Pyrene-4,5-Oxide By Myristicin Induced Glutathione S-Transferase In A/J Mouse Livers, Eduardo Saldivar Jan 2000

Detoxification Of 4-Nitroquinoline 1-Oxide And Benzo(A)Pyrene-4,5-Oxide By Myristicin Induced Glutathione S-Transferase In A/J Mouse Livers, Eduardo Saldivar

Theses and Dissertations - UTB/UTPA

The activities of mouse liver glutathione S-transferases (GSTs) induced by myristicin, the active compound in parsley leaf oil, against the carcinogens 4-nitroquinoline 1-oxide (4NQO) and benzo(a)pyrene-4,5-oxide (BP-4,5-oxide) were studied. A/J mice were treated with three 20 mg doses (one dose every other day) by gavage. Affinity purified liver GST samples from treated animals showed a 7.2-fold increase in activity toward 4NQO when compared with equal amounts of liver samples prepared from the control group. Activity against BP-4,5-oxide was increased 1.8-fold in the experimental group. Experimental samples also showed a significant increase in activity toward the substrates 1-chloro-2,4-dinitrobenzene (CDNB), 2,4-dichloronitrobenzene (DCNB), …

Elements Of Writers Workshops In A Third Grade Classroom, Gale L. Nagunst Jan 2000

Elements Of Writers Workshops In A Third Grade Classroom, Gale L. Nagunst

Graduate Research Papers

The act of writing is a natural process and should be treated as such. For children seven years and older, writing usually is not a linear act that follows a prescribed set of steps in a particular order, but a recursive process in which writers move forward and back through the different components of writing to make meaning. A classroom that includes writers workshops, or groups of children working together to interact about writing, must incorporate several important elements to allow this recursive, natural process to happen. These elements include classroom organization, ample writing time, models of writing, teacher instruction …
