Homosexuality As Contagion: From The Well Of Loneliness To The Boy Scouts, Nancy J. Knauer

In the political arena, there are currently two central and competing views of homosexuality. Pro-family organizations, working from a contagion model of homosexuality, contend that homosexuality is an immoral, unhealthy, and freely chosen vice. Many pro-gay organizations espouse an identity model of homosexuality under which sexual orientation is an immutable, unchosen, and benign characteristic. Both pro-family and pro-gay organizations believe that to define homosexuality is to control its legal and political status.

Aspects Of Growth For The Northern Quahog, Mercenaria Mercenaria, Craig Lawrence Appleyard

The growth of the northern quahog, Mercenaria mercenaria, has been mathematically modeled over both the nursery stage and the complete life so as to develop expectations of growth as a function of environmental suitability. Then, the growth of northern quahogs in an experimental nursery upweller was evaluated as a function of system operating parameters (flow rate and stocking density) and other environmental parameters to determine the limiting factors in this critical phase of shellfish aquaculture.

Increasingly, consumers are turning to herbal remedies to help heal what ails them. This note explores the past and present regulation of herbal remedies. The Dietary Supplement Health and Education Act (DSHEA) of 1994 provided a convenient regulatory vehicle-"dietary supplements"-for herbal remedies to enter the market with labeling that claims a positive effect on the structure or function of the body or on one's general sense of well-being. This note argues that DSHEA fails as a regulatory system for herbal remedies. While it safeguards access to herbal remedies, DSHEA only allows vague labeling information suggesting the therapeutic potential of the …

Law And The Biology Of Rape: Reflections On Transitions, Owen D. Jones

The effectiveness of the legal system in preventing rape depends, in part, on the accuracy of the model of rape behavior on which it relies. To date, most models of rape reflect the disciplinary isolation of their proponents. In this article, Professor Jones argues that integrating life science and social science perspectives on sexual aggression can improve law's model of rape behavior and further our efforts to reduce the .incidence of rape. This Comment will examine the law governing unsolicited commercial electronic mail in California. Part II details the growth of the Internet and unsolicited commercial electronic mail. Part III examines the law of trespass to chattel as applied to unsolicited commercial electronic mail in California. Part IV examines recent legislative efforts to regulate spam in California. Part V analyzes the implications of the new unsolicited electronic mail legislation in California. Mitogen Activated Protein Kinase (MAPK) pathways e ubiquitous ongst eukaryotes, involved in the signal transduction of various external stimuli to the nucleus. In plants, only MAPK pathways related to pathogen- and stress-related responses have been identified. It has been proposed that another MAPK pathway exists in plants, one that is similar to animal MAPK pathways and postulated to connect the regulation of cell growth and the actions of hormones auxin, cytokinin, and gibberellin. Drawing on socio- analytical, ethical-theological, and leadership studies perspectives, this thesis sheds light on the disparity between the theological principles of equality and the ecclesiastical practices of inequality that create an unhealthy moral environment in churches.

And yet, that age-old wisdom comes readily to mind when one considers the unrelated business income tax (UBIT) as it relates to charities that, for consideration paid, participate in a profit-seeker's web-based marketing communications. In this Comment, I argue that the use of cost-benefit analysis to evaluate life-saving regulatory programs has, in a society that eschews reliance on cost-benefit analysis in other life-saving situations, been justified by the creation of a new kind of entity-the statistical person. A primary feature of the statistical person, as I will explain, is that she is unidentified; she is no one's sister, or daughter, or mother. The thesis of this Article is that the Court of Federal Claims and the Court of Appeals for the Federal Circuit have become exposed to this classic critique of constitutional decision-making through the recent expansions of the regulatory takings doctrine. Though the chief agent for this expansion has been the Supreme Court, these lower courts have made their own prominent contributions to broadening regulatory takings, and they are far more vulnerable to political reprisals. Prudence, Benevolence, And Negligence: Virtue Ethics And Tort Law, Heidi Li Feldman

Tort law assesses negligence according to the conduct of a reasonable person of ordinary prudence who acts with due care for the safety of others. This standard assigns three traits to the person whose conduct sets the bar for measuring negligence: reasonableness, ordinary prudence, and due care for the safety of others. Yet contemporary tort scholars have almost exclusively examined only one of these attributes, reasonableness, and have wholly neglected to carefully examine the other elements key to the negligence standard: prudence and due care for the safety of others.
