Preserving The Oneida Nation Culture, Brian Patterson Jan 2000

Preserving The Oneida Nation Culture, Brian Patterson

St. Thomas Law Review

The topic of this symposium - "Sacred Sites and Modem Lives" - is very timely. We often hear news about some building project that has unearthed an ancient village or burial ground. For every building project that is unearthed you also hear great debate about what to do about the building project, or what to do with the artifacts and the human remains. There exists a big struggle - on the one hand, the needs of society and science, and on the other hand, respect for places and things and people that came long before.

The Miami Circle: Teacher Of Respect For Nature, People, History, And Place, Dennis Wiedman Jan 2000

The Miami Circle: Teacher Of Respect For Nature, People, History, And Place, Dennis Wiedman

St. Thomas Law Review

Cut into the limestone bedrock shore of the Miami River where it enters Biscayne Bay, the Miami Circle has captured local, state, national and international attention since its discovery in September 1998. This paper captures the information, insight, and cultural values expressed by the various contributors to the conference on "Sacred Sites and Modem Lives: The Miami Circle and Beyond." It highlights the lessons that enable us to better understand the significance of the Miami Circle's past, its present implications for the South Florida community, and visions of its future.

Will The Circle Be Unbroken--The Miami Circle Discovery And It's Significance For Urban Evolution And Protection Of Indigenous Culture, Pamela G. Levinson

St. Thomas Law Review

A mysterious, ancient stone circle carved into limestone bedrock discovered on a downtown Miami bayfront lot has set a legal precedent for the world. The unique formation known as the Miami Circle has been saved by the exercise of the ultimate power of government - eminent domain. Thus its relevance stretches beyond the local struggle to save one ancient archaeological curiosity. Rather, it stands as a model for the preservation of similar archaeological structures and artifacts found on private lands, which up to now have been vulnerable to destruction. It also stands as a model of hope for other sites …

A General Chemistry Course For Prospective Elementary School Teachers, M. S. Lazarus Jan 2000

A General Chemistry Course For Prospective Elementary School Teachers, M. S. Lazarus

Journal of Mathematics and Science: Collaborative Explorations

The paper describes a general chemistry course designed for students who are planning to become elementary school teachers. The course has been structured so as to transmit the fun and excitement of experiencing chemistry and uncovering its basic principles by centering on laboratory and other discovery experiences. In addition, the course uses peer led workshops in which the students discuss these experiences. The course is thus a product of a particularly strong collaboration between public schools and college faculties. It is going to become a part of a new four-course sequence that will be required of all students intending to …

Active Learning In Sophomore Mathematics: A Cautionary Tale, M. Eisenberg Jan 2000

Active Learning In Sophomore Mathematics: A Cautionary Tale, M. Eisenberg

Journal of Mathematics and Science: Collaborative Explorations

Math 245: Multivariate Calculus, Linear Algebra, and Differential Equations with Computer I is the first half of a year-long sophomore sequence that emphasizes the subjects' interconnections and grounding in real-world applications. The sequence is aimed primarily at students from physical and mathematical sciences and engineering. In Fall, 1998, as a result of my affiliation with the Science, Technology, Engineering, and Mathematics Teacher Education Collaborative (STEMTEC), I continued and extended previously-introduced reforms in Math 245, including: motivating mathematical ideas with real-world phenomena; student use of computer technology; and, learning by discovery and experimentation. I also introduced additional pedagogical strategies for more …

[Review Of] John M. Coward. The Newspaper Indian: Native American Identity In The Press, 1820-90, Cynthia R. Kasee Jan 2000

[Review Of] John M. Coward. The Newspaper Indian: Native American Identity In The Press, 1820-90, Cynthia R. Kasee

Ethnic Studies Review

It will not come as news to people familiar with Native American history the role the print medium has played in costructing [constructing] public images of indigenous Americans. What is refreshing is the way in which Coward offers his insights on the matter. He has chosen the period of the United States' most feverish expansion into "the West," a time when newspapers and related print sources were most active in defining now-common stereotypes of both sides in the ensuing conflicts.

The Criminalization Of Child Welfare In New York City: Sparing The Child Or Spoiling The Family?, Alison B. Vreeland Jan 2000

The Criminalization Of Child Welfare In New York City: Sparing The Child Or Spoiling The Family?, Alison B. Vreeland

Fordham Urban Law Journal

The trend in child welfare has been to err on the side of protection, often considered erring on the side of the child. While this approach may have been appropriate to overcome a long history of State abstinence from involvement in the family domain, it has been under-inclusive in protecting the child's fundamental right to a parent-child relationship. A delicate balance must be struck between family autonomy and State intervention. This balance is best achieved in the family court when the child's best interest is represented and the family is addressed as a whole. Under traditional criminal procedure, which focuses …

Fordham International Law Journal

This Essay will seek to explain EU regulatory practice in relation to new technologies, principally GMOs, and to show that the EU should be able to find an approach that meets public concerns while remaining consistent with Article XX, paragraphs (b) and (g). This Essay will also identify those areas where Article XX, in its present form, it likely to be a source of justified public concern.

Reproductive Experience And Stress Responsiveness, Jennifer Elizabeth Wartella Jan 2000

Reproductive Experience And Stress Responsiveness, Jennifer Elizabeth Wartella

Master's Theses

Hormonal fluctuations and maternal behavior associated with pregnancy and postpartum care of pups induce many changes in the female rat. Circulating hormonal surges during pregnancy modify the female brain in preparation for motherhood. Past studies identify the medial preoptic area, the hypothalamus and the basal forebrain as structures dense in hormonal receptors involved in controlling reproductive behavior. The hippocampus and amygdala possess many hormonal receptors. Neurons exposed to pregnancy hormones develop new synapses and increased spine density, changes reflected in behavioral preparations, such as nest building and increased foraging, for the new pups. Following the experience of birth, pup stimulation …

Attention, Memory, And Self-Efficacy Differences Between Adhd And Aging Individuals, Douglas Lee Welsh Jan 2000

Attention, Memory, And Self-Efficacy Differences Between Adhd And Aging Individuals, Douglas Lee Welsh

Master's Theses

Attention and memory abilities decline with age. Although a similar pattern of attentional and memory decrement has been observed in individuals with Attention Deficit Hyperactivity Disorder (ADHD), these two populations have never been directly compared. The present study examined performance on attention, self-efficacy (SE), and memory tasks by ADHD young adults and non-ADHD younger and older adults. ADHD adults displayed lower attentional SE than both non-ADHD younger and older adults, but performed comparably to older adults on an attention task on which non-ADHD younger adults outperformed both groups. ADHD adults and older adults had lower memory SE than non-AD HD …

Corrective Justice And The Revival Of Judicial Virtue, Mark C. Modak-Truran Jan 2000

Corrective Justice And The Revival Of Judicial Virtue, Mark C. Modak-Truran

Journal Articles

Judges must be wise. Sound judicial reasoning requires moral virtue. These sentiments about judging have been lost. They apparently belong to a bygone era. While many advocate self-restraint or prudence as judicial virtues, moral virtue has been conspicuously absent from the list. Except for avoiding obvious vices such as bribery, favoritism, prejudice, sloth, and arbitrariness, conventional wisdom maintains that being a good judge does not require being a good person. Even theorists sympathetic to a relationship between law and morality balk at making moral virtue a prerequisite of judicial decision making. Rather, many contend that judicial decision making is a …

The Death Of Privacy, Darren W. Bax Jan 2000

The Death Of Privacy, Darren W. Bax

Theses

This thesis will focus on the issue of personal privacy and the growing threat to its existence in a technological society.

The areas most associated with privacy loss include increased government intrusions, legislation, workplace, healthcare industry, Internet, and identity theft. Chapter one provides a historical perspective beginning with primitive culture and their struggle to maintain privacy in the lives. Interesting enough, privacy protection was not mentioned by the judicial system until 1880 when privacy was defined as the "right to be left alone." To address concerns about privacy reform the Supreme Court cited this right of privacy as having " …

The Old American, Ernest Hebert Jan 2000

The Old American, Ernest Hebert

Dartmouth Scholarship

In 1746, Nathan Blake, the first frame house builder in Keene, New Hampshire, was abducted by Algonkians and held in Canada as a slave. Inspired by this dramatic slice of history, novelist Ernest Hebert has written a masterful new novel recreating those years of captivity. Set in New England and Canada during the French and Indian Wars, The Old American is driven by its complex, vividly imagined title character, Caucus-Meteor. By turns shrewd and embittered, ambitious and despairing, inspired and tormented, he is the self-styled "king" of the remnants of the first native tribes that encountered the English. Displaced and …

The Effects Of Incorporating A Word Processor Into A Writing Program: Seven Individual Case Studies, Natalie Beck Jan 2000

The Effects Of Incorporating A Word Processor Into A Writing Program: Seven Individual Case Studies, Natalie Beck

Theses : Honours

Writing is a "complex interplay of social, physical, and cognitive factors" (Daiute, 1985a, p.1) and an essential part of every young child's school life. However, "every school has at least a few children who can be classified as non-writers" (Aumack, 1985, p.46). Some children are often inhibited and "frustrated when they attempt to express themselves with pencil and paper'' (Aumack, 1985, p.46) and are put off by the thought of writing, erasing and rewriting, thus producing "children who do not want to write" (Aumack, 1985. p.46). In response to these statements, this qualitative study examined the effects of incorporating a …

Implementing A Virtual Reality Paradigm In Human Anatomy/Physiology College Curricula, Helen St. Aubin Jan 2000

Implementing A Virtual Reality Paradigm In Human Anatomy/Physiology College Curricula, Helen St. Aubin

CCAC Theses and Dissertations

Modes of instruction in the college course called Human Anatomy/Physiology are changing. Due to ethical concerns and the ever-increasing source of new physiological data, there is a need for enhancements to assist the instructor and student. The computer science of virtual reality (VR) provides a method to electronically educate, train, prototype, and test and evaluate new enhancements to the college curricula. This study detailed the modeling and simulation of a skeletal human hand with degrees of freedom of movement, which provided the students with a physiological representation of some of the movements of the hand. The primary objectives of the …
