The Legal Regulation Of Adult Personal Relationships: Evaluating Policy Objectives And Legal Options In Federal Legislation, Brenda Cossman, Bruce Ryder Jan 2000

The Legal Regulation Of Adult Personal Relationships: Evaluating Policy Objectives And Legal Options In Federal Legislation, Brenda Cossman, Bruce Ryder

Commissioned Reports, Studies and Public Policy Documents

Few would dispute that adult personal relationships characterized by caring and commitment ought to be recognized and supported by the state because of their fundamental importance to the well-being of individuals and communities. The law has long sought to identify these relationships by reference to ties of blood, marriage or adoption. Contemporary norms, however, value adult personal relationships by reference to their qualitative attributes rather than their formal legal status. This shift in normative assumptions has accompanied profound shifts in Canadians’ living arrangements over the course of the last thirty years. We have witnessed a decline in the marriage rate, …

Biological Science In Conservation, David Johns Jan 2000

Biological Science In Conservation, David Johns

Political Science Faculty Publications and Presentations

Large-scale wildlands reserve systems offer one of the best hopes for slowing, if not reversing, the loss of biodiversity and wilderness. Establishing such reserves requires both sound biology and effective advocacy. Attempts by The Wildlands Project and its cooperators to meld science and advocacy in the service of conservation is working, but is not without some problems. Scientists and advocates have differences in methods of work, different understandings of the origins and place of values in conservation, and differing expectations about the efficacy of biological information in achieving protection. Despite these differences, successful relationships can be forged where these differences …

Pesticide Toxicity, Human Subjects, And The Environmental Protection Agency's Dilemma, Heidi Gorovitz Robertson, Samuel Gorovitz Jan 2000

Pesticide Toxicity, Human Subjects, And The Environmental Protection Agency's Dilemma, Heidi Gorovitz Robertson, Samuel Gorovitz

Law Faculty Articles and Essays

Should humans be used as subjects in research designed to determine the toxicity of pesticides? If so, under what conditions should they be used? If not, why not, given that human subject testing is common in research studies designed to determine the safety and efficacy of drugs? Should the EPA seek, or even accept, the results of such research in formulating the evidentiary base it uses in making decisions about pesticide registration? This article does not propose to answer these questions, but to illuminate the process by which they are addressed and offer some suggestions about how other such questions …

Conflicts In Regulating Religious Institutions, Alan C. Weinstein Jan 2000

Conflicts In Regulating Religious Institutions, Alan C. Weinstein

Law Faculty Articles and Essays

Over the past 25 years, religious institutions have greatly increased their claims of violation of religious freedom when they are denied zoning approval or subjected to historic preservation regulations. While no one can definitively explain the causes of this increase in First Amendment challenges, it can partially be traced to recent changes in both our society and the way our political/legal system conceptualizes religious freedom.

Throwing Caution To The Wind: The Global Bear Parts Trade, Adam M. Roberts, Nancy V. Perry Jan 2000

Throwing Caution To The Wind: The Global Bear Parts Trade, Adam M. Roberts, Nancy V. Perry

Animal Law Review

The exploitation of bears occurs in a myriad of forms. Bear baiting, abuse of bears in entertainment, habitat destruction, and the legal and illegal trade of bear parts all contribute to the decline of the bear. The market demand for bear gallbladders and bile is on the rise and is negatively impacting bear populations worldwide. Mounting evidence points to a systematic pattern of killing bears in the United States and Canada in order to satisfy the demand for bear parts in consuming nations, primarily Asian markets. The bear parts trade is international in scope and difficult to regulate and contain. …

Cloning: A Jewish Law Perspective With A Comparative Study Of Other Abrahamic Traditions, Stephen J. Werber Jan 2000

Cloning: A Jewish Law Perspective With A Comparative Study Of Other Abrahamic Traditions, Stephen J. Werber

Law Faculty Articles and Essays

This Article does not provide answers to the religious, ethical, and moral issues posed by advanced reproductive techniques in human cloning. Rather, the preceding analysis and discussion seeks to make a contribution, however modest, to the continuation of the societal discussion that will ultimately yield the answers. This Article presents the common concerns of the religious traditions of Judaism, Islam, and Christianity with their mutual emphasis on preserving the dignity of all beings. This and other common values must form the foundation upon which all questions related to the cloning debate must be predicated.

The Virtue Of Ordered Conflict: A Defense Of The Adversary System, David R. Barnhizer Jan 2000

The Virtue Of Ordered Conflict: A Defense Of The Adversary System, David R. Barnhizer

Law Faculty Articles and Essays

My underlying thesis is that American society is in increasing danger of falling victim to the tendencies against which Hobbes warned, and that we need to understand and deal with the ultimate implications this holds for our political community. Otherwise, we risk ending up with a severe case of ideological balkanization that will undermine and weaken our social system. My concern is that we are well on the way to a state of ideological civil war. If we succumb further it will mean a political culture in which there is little real communication, but only destructive vilification, jockeying for political …

The Legacy Of Geographical Morality And Colonialism: A Historical Assessment Of The Current Crusade Against Corruption, Padideh Ala'i Jan 2000

The Legacy Of Geographical Morality And Colonialism: A Historical Assessment Of The Current Crusade Against Corruption, Padideh Ala'i

Scholarly Articles in Law Reviews & Journals

This Article examines the legacy of the rule of geographical morality - that is the norm by which a citizen of the country in the North may engage in acts of corruption in any country in the South, including bribery and extortion, without the attachment of any moral condemnation to those acts. Part I of the Article begins by reviewing the impeachment trial of Warren Hastings, who served as Governor General of the Bengal from 1772-1785, on charges of bribery and corruption. It was during that impeachment proceeding when the words "principles of geographical morality" were used by, the prosectuor, …

Detection Of Dna Of Nocturnally Periodic Brugia Malayi In Night And Day Blood Samples By A Polymerase Chain Reaction-Elisa-Based Method Using An Internal Control Dna, Peter U. Fischer, Tanianwati Supali, Heri Wibowo, Insa Bonow, Steven A. Williams

Biological Sciences: Faculty Publications

An internal control was used in a polymerase chain reaction (PCR)–ELISA–based technique to detect the Hha I repeat of the filarial parasite Brugia malayi. A single microfilaria added to 200 l of blood was reliably detected. The assay was evaluated on field samples from persons living in an area endemic for Anopheles-transmitted, nocturnally periodic B. malayi in central Sulawesi, Indonesia. Examination of night blood of 138 individuals for the presence of microfilariae by filtration revealed 44 microfilaria carriers. All microfilaria carriers were also positive in the PCR-ELISA and, in addition, 14 more samples were proven to contain parasite DNA. The …

A Non-Lethal Method For Identification Of The Cotton Mouse, Peromyscus Gossypinus (Leconte,1853), Valerie A. Barko, Brian L. Sloss, George A. Feldhamer

Publications

The cotton mouse (Peromyscus gossypinus) is on the northern periphery of its range in southwestern Kentucky, southeastern Missouri, and southern Illinois. Little information is available on the life history of cotton mice in Illinois, in part because of difficulty in differentiating them from white-footed mice (P. leucopus). Current identification is often based on lethal sampling, including collection of internal tissues for allozyme electrophoresis or measurement of skull characters. Here we describe a reliable, non-lethal method for distinguishing between cotton mice and white-footed mice using a diagnostic allozyme locus, glucose-6-phosphate isomerase (GPI-1) from toe-clips. This technique will …

Sclerosis: Retributive Justice And The Rwandan Genocide, Mark A. Drumbl Jan 2000

Sclerosis: Retributive Justice And The Rwandan Genocide, Mark A. Drumbl

Scholarly Articles

In the 1994 Rwandan genocide 800,000 people were massacred. The victims were overwhelmingly of the minority Tutsi ethnic group and the aggressors of the majority Hutu group. At present, 125,000 Hutu prisoners remain incarcerated while awaiting trial on genocide-related charges. This article argues that these trials, and the extensive incapacitation that necessarily precedes them, may do little to promote justice, regime legitimacy, or national reconciliation in Rwanda. This, in turn, raises broader questions about the role of criminal punishment and sentencing in situations of mass violence. Criminality usually attaches to deviant conduct. Mass political violence -- from Nazi Germany to …
