Everyone Benefits, Everyone Pays: Does The Fifth Amendment Mandate Compensation When Property Is Damaged During The Course Of Police Activities?, C. Wayne Owen Jr.
William & Mary Bill of Rights Journal
The Fifth Amendment of the United States Constitution, along with similar provisions in state constitutions, forbids the taking of private property by the government for a public use without just compensation. Despite this protection, many courts have denied takings claims made by innocent third party landowners when police officers caused damage to their property during the course of executing their official duties. These courts held that the damage was not for a "public use" in the narrow sense, and have refused to analyze the claims under takings jurisprudence. An analysis of the distribution of 104 Greater Prairie-chicken leks in Pawnee and Johnson counties indicates that the birds favor using those mile-square sections having no more than two dwellings per section, ones that are located at least two miles from the nearest town, and at least a half-mile from the nearest lek. Relationships with the nearest water were not clear, but most leks were located at least a half-mile from it, perhaps reflecting a general avoidance of heavy cover during the display season.

Observations On The Biology Of The Antlion Genus Glenurus Hagen (Neuroptera: Myrmeleontidae), Lionel A. Stange

This New World genus contains nine described species classified in the Nemoleontini. Larvae have been found for five species (Miller and Stange, unpublished data). The larvae have only two mandibular teeth and the labial palpus has only 2 segments. These characters are unknown in other genera of the Nemoleontini. Larvae live in dry tree holes (Miller, R. and L. At the start of Pagan Spain (1957), Richard Wright recalled a 1946 conversation with Gertrude Stein; she encouraged him to visit Spain: “ ‘You'll see what the Western world is made of. Spain is primitive, but lovely. ’ ” Wright meditated on his fascination with that country, an obsession rooted in the Civil War's political upheaval: “The fate of Spain hurt me, haunted me; I was never able to stifle a hunger to understand what had happened there and why” (PS, 10). Gadamer, Heidegger, And The Social Dimensions Of Language: Reflections On The Critical Potential Of Hermeneutical Philosophy, Ingrid Scheibler

Beginning with an account of recent efforts, like Georgia Warnke's, to demonstrate Hans-Georg Gadamer's relevance to legal theory, this Article looks at Gadamer's conception of language and tradition, claiming that, while he shares important features of Heidegger's thought, Gadamer productively grounds his view of language and tradition in such a way that the everyday realm of public discourse, characterized by a healthy injunction to foster reasoned debate amongst divergent perspectives and interpretations, has a vital and integral role to play. While Gadamer criticizes the Enlightenment's hostility to tradition, paradoxically, his concept of linguistically mediated tradition has far more in common …

Many opponents of critical legal thought assert that it is easy to be critical but hard to be constructive. From this perspective, critical legal activity is simple, while traditional theory is difficult. Feldman argues otherwise. Hans-Georg Gadamer's emphasis on the role and power of tradition in the hermeneutic process suggests how tradition forcefully constrains us. Our prejudices, derived from our communal traditions, limit what we can understand and perceive. Thus, to perform critical activity proves often to be a formidable challenge. Identification And Characterization Of Zinc-Responsive Genes In Pseudomonas Fluorescens, Thomas L. Wilson

Genes responsive to elevated concentrations of zinc were identified via transposon mutagenesis in the common soil bacterium, Pseudomonas fluorescens ATCC13525. Some of these genes were essential to maintain metal homeostasis in the bacterial cell. DNA sequences of the transposon-tagged genes were determined by DNA sequencing of arbitrary PCR products. DNA sequence analysis indicated that one gene was similar to P-type ATPases responsible for transporting metal ions out of the cell. The corresponding mutant was sensitive to zinc, cadmium, and lead indicating that this gene may be responsible for defending Pseudomonas fluorescens against these metal ions. Biofilms are complex communities of microorganisms attached to surfaces or associated with interfaces. Despite the focus of modern microbiology research on pure culture, planktonic (free-swimming) bacteria, it is now widely recognized that most bacteria found in natural, clinical, and industrial settings persist in association with surfaces. Furthermore, these microbial communities are often composed of multiple species that interact with each other and their environment. The determination of biofilm architecture, particularly the spatial arrangement of microcolonies (clusters of cells) relative to one another, has profound implications for the function of these complex communities. Attention deficit hyperactivity disorder (ADHD) is the most commonly diagnosed childhood psychiatric disorder in the United States. Approximately 90% of children receiving pharmacological treatment for ADHD receive the stimulant methylphenidate (MPH). MPH is associated with positive effects across many behavioral domains, yet the mechanisms through which it exerts clinical effects have not been conclusively determined. MPH produces reinforcing and subjective effects, however it is not understood how these functions relate to clinical effects. The town of Korazim is of special interest to Christendom, and thus was frequently mentioned by scholars and travelers to the Holy Land. The identification of Korazim with Khirbat Karazeh is now almost universally accepted. The site was extensively surveyed and excavated in 1962–1964, under the direction of Ze’ev Yeivin on behalf of the Department of Antiquities. Based on these excavations, the layout of the town and the setting of the synagogue within it could be elucidated. In 1980–1987, excavations at the site were resumed, during which some 30 probes were carried out in the synagogue and its vicinity.

Time dependent parameters are frequently encountered in many real processes which need to be monitored for process modeling, control and supervision purposes. Modulating functions methods are especially suitable for this task because they use the original continuous-time differential equations and avoid differentiation of noisy signals. Among the many versions of the method available, Pearson–Lee method offers a computationally efficient alternative. In this paper, Pearson–Lee method is generalized for non-stationary continuous-time systems and the on-line version is developed. In recent years several linguists have developed quantitative methods for analyzing and describing how speakers of languages refer to activated participants in narrative discourse. One of the first of these was Talmy Givon, whose method (referred to by some as the Recency/Distance method) measured three factors in participant reference: referential distance, potential interference, and persistence. A few years later, Russell Tomlin proposed an alternative model, which he labeled the Episode/Paragraph method. He felt that Givon's method fails to account for the fact that the thematic paragraphs or "episodes" found in narrative texts largely determine the amount of coding material used. …

The genetic transmission of a pattern of impairments associated with alcoholism has been supported by research literature (Dawson, Harford, & Grant, 1992; Schuckit, 1986). No single factor appears to cause the development of a substance abuse problem, but a family history of alcoholism may be one predictive factor (Goodwin, 1985). The offspring of alcoholics are more likely to display disinhibited behavior and impulsivity (Pihl, Peterson, & Finn, 1990) and are more likely to develop drinking problems than the general population (Goodwin, 1971). Researchers have found patterns of cognitive deficits (Tartar, Jacob, Bremer, 1989) and neuropsychological differences (Gabriella & Mednick, 1983) …

In yeast and animals, cyclins have been demonstrated to be important regulators of cell cycle progression. In recent years, a large number of A-, B-, and D-class cyclins have been isolated from a variety of plant species. One class of cyclins, the D-class cyclins, is important for progression through G1 phase of the cell cycle. In Arabidopsis, four D-class cyclins have been isolated and characterized (CYCLIN-D1;1, CYCLIN-D2;1,CYCLIN-D3;1, and CYCLIN-D4;1).
