Life After Adarand: What Happened To The Metro Broadcasting Diversity Rationale For Affirmative Action In Telecommunications Ownership?, Leonard M. Baynes Dec 1999

Life After Adarand: What Happened To The Metro Broadcasting Diversity Rationale For Affirmative Action In Telecommunications Ownership?, Leonard M. Baynes

University of Michigan Journal of Law Reform

The United States Supreme Court severely restricted affirmative action policies in Adarand Constructors, Inc. v. Pena. In this opinion, a majority of the Court held that all state or federally mandated affirmative action programs are to be analyzed under strict scrutiny. This test requires affirmative action programs to meet a compelling governmental interest and be narrowly tailored.

Adarand raised issues concerning the validity of the Federal Communications Commission's affirmative action ownership policies. Previously, the Court in Metro Broadcasting, Inc. v. FCC found the FCC minority ownership policies constitutional under a lower (intermediate) standard of review. In Adarand, the Court …

Increasing Consumer Power In The Grievance And Appeal Process For Medicare Hmo Enrollees, Kenneth J. Pippin Dec 1999

Increasing Consumer Power In The Grievance And Appeal Process For Medicare Hmo Enrollees, Kenneth J. Pippin

University of Michigan Journal of Law Reform

Federal law requires that Health Maintenance Organizations (HMOs) and Managed Care Organizations (MCOs) provide Medicare beneficiaries with specific grievance and appeal rights for challenging adverse decisions of these organizations. The Health Care Financing Administration (HCFA) is charged with enforcing these regulations. Currently, however, HCFA contracts with HMOs, allowing them to enroll Medicare beneficiaries despite the fact that many of the statutory and regulatory requirements are ignored by the Medicare HMOs. This is problematic because the elderly Medicare population may not be able to independently and adequately challenge the HMO's denial of care or reimbursement. Because HCFA has been reluctant and …

What Money Cannot Buy: A Legislative Response To C.Rac.K., Adam B. Wolf Dec 1999

What Money Cannot Buy: A Legislative Response To C.Rac.K., Adam B. Wolf

University of Michigan Journal of Law Reform

Children Requiring a Caring Kommunity (C.R.A.C.K.) is an organization that pays current or former drug addicts $200 to be sterilized. While generating great public controversy, C.R.A.C.K. is expanding rapidly throughout the country. Its clients are disproportionately poor women of color, who are coerced by the offer of money into permanently relinquishing their reproductive rights. This Note argues that C.R.A.C.K. is a program of eugenical sterilization that cannot be tolerated. Moreover, C.R.A.C.K. further violates settled national public policy by offensively commodifying the ill-commodifiable, by demeaning women, and by starting down a slippery slope with devastating consequences. This Note proposes legislation that …

A Qualitative Study Of A Parental Involvement Program In A K-8 Catholic Elementary School, Janet Ann Donovan Dec 1999

A Qualitative Study Of A Parental Involvement Program In A K-8 Catholic Elementary School, Janet Ann Donovan

Journal of Catholic Education

This article demonstrates that there is virtual unanimity among America’s educational leaders in the belief that when parents become involved in their children’s education, the children do better in school. Moreover, the study also reveals that in educational circles serious disagreements exist among leaders as to the degree to which parents should be involved in their children’s education. Central to the study is a small Catholic elementary school whose parental involvement program is not only diametrically opposed to contemporary educational thinking but could be interpreted as a refutation of it.

Spinal Cord Stimulation For Treatment Of Failed Back Surgery Syndrome--Two Case Reports, R. Vijayan, Tunku Sara Ahmad Dec 1999

Spinal Cord Stimulation For Treatment Of Failed Back Surgery Syndrome--Two Case Reports, R. Vijayan, Tunku Sara Ahmad

Pre-2000

Severe, persistent back pain following back surgery is often referred to as Failed Back Surgery Syndrome (FBSS). Conservative measures such as physiotherapy, back strengthening exercises, transcutaneous electrical nerve stimulation and epidural steroids may be inadequate to alleviate pain. Spinal Cord Stimulators were implanted into two patients suffering from FBSS. Both patients responded successfully to spinal cord stimulation with reduction of pain and disability.

An Analysis Of Teacher And Student Leadership And Gender Differentiation Within Academic Divisions At Three Virginia And Tennessee Liberal Arts Colleges, Mary L. Cole

Electronic Theses and Dissertations

This quantitative study investigated a range of leadership behaviors by teachers (teacher characteristics) and students (student characteristics) inside their higher education classrooms and various aspects of those environments (classroom characteristics). The behaviors and environmental aspects examined are those determined by research findings to foster and enhance participant growth and development. Cluster sampling was used for this study of 25 classes representing 5 divisions of the curriculum at 3 institutions. The instruments were administered to 277 students and 25 teachers during the spring of 1999. The null hypotheses for main effects of teacher, student, and classroom characteristics were tested on the …

Popular And Highbrow Literature: A Comparative View, Peter Swirski Dec 1999

Popular And Highbrow Literature: A Comparative View, Peter Swirski

CLCWeb: Comparative Literature and Culture

In his article, "Popular and Highbrow Literature: A Comparative View," Peter Swirski discusses the role and status of popular fiction in contemporary culture. Starting with the basic question, "Who needs popular fiction?," he surveys select sociological evidence and prevailing aesthetic arguments in order to take stock of the ways in which highbrow literature and popular fiction relate to each other. He begins with statistical and socio-economic data which casts a different lights on many myths prevailing in scholarship as well as in general social and cultural discourse, such as the death of the novel, the alleged decline of the reading …

Théophile Gautier And The Orient, F. Elizabeth Dahab Dec 1999

Théophile Gautier And The Orient, F. Elizabeth Dahab

CLCWeb: Comparative Literature and Culture

In her article, "Théophile Gautier and the Orient," F. Elizabeth Dahab discusses the function of the Orient in general, and in particular, the function of Ancient Egypt in some of Gautier's contes fantastiques written between 1835 and 1857. Gautier and many of his contemporaries including Baudelaire wanted to escape from a society dominated by the idea of progress. They expressed deep doubt in many of their texts and strived to find solace in the notion of permanence in art characteristic of Ancient Egyptian architecture and mortuary customs. They also believed that Ancient Egypt may provide an answer to humanity's quest …

Clash Of The Titans: Regulating The Competition Between Established And Emerging Electronic Payment Systems, Jane Kaufman Winn Dec 1999

Clash Of The Titans: Regulating The Competition Between Established And Emerging Electronic Payment Systems, Jane Kaufman Winn

Articles

This article equates the providers of traditional electronic payment services with the Titans of Greek mythology, and the providers of new electronic payment technologies with the Olympians. Professor Winn concludes, however, that unlike the Titans of Greek mythology, these modern Titans appear to be winning in their battle with the upstart Olympians. This article describes the fundamental characteristics of payment systems, reviews the applicable law, and describes the new technologies that were, until quite recently, expected to displace older electronic payment systems. Professor Winn finds that consumers and merchants, by and large, are happy with the existing regulatory structure. And, …

Transcriptional Up-Regulation Of The Cyclin D2 Gene And Acquisition Of New Cyclin-Dependent Kinase Partners In Human T-Cell Leukemia Virus Type 1- Infected Cells, Francisco Santiago, Elizabeth Clark, Siewyen Chong, Carlos Molina, Fariba Mozafari, Renaud Mahieux, Masahiro Fujii, Nazli Azimi, Fatah Kashanchi Dec 1999

Transcriptional Up-Regulation Of The Cyclin D2 Gene And Acquisition Of New Cyclin-Dependent Kinase Partners In Human T-Cell Leukemia Virus Type 1- Infected Cells, Francisco Santiago, Elizabeth Clark, Siewyen Chong, Carlos Molina, Fariba Mozafari, Renaud Mahieux, Masahiro Fujii, Nazli Azimi, Fatah Kashanchi

Department of Biology Faculty Scholarship and Creative Works

Human T-cell leukemia virus type 1 (HTLV-1) is the etiologic agent for adult T-cell leukemia/lymphoma (ATL) and HTLV-1-associated myelopathy/tropical spastic paraparesis. Tax1 is a 40-kDa phosphoprotein, predominantly localized in the nucleus of the host cell, which functions to transactivate both viral and cellular promoters. It seems likely that HTLV-1, through expression of the viral regulatory protein Tax1, provides some initial alteration in cell metabolism predisposing the development of ATL. Here, we demonstrate that HTLV-1 infection in T-cell lines and patient samples causes overexpression of an early G1 cyclin, cyclin D2. The transcriptional up-regulation of the cyclin D2 gene is due …

Self-Esteem: The Impact Of A Course In Growth And Development On Fifth Grade Students, Mary Jang Dec 1999

Self-Esteem: The Impact Of A Course In Growth And Development On Fifth Grade Students, Mary Jang

Master's Projects

Teens in the United States have the highest pregnancy, abortion, and sexually transmitted disease rates among the developed countries. The social and financial costs of teen births are staggering. Research shows that high self-esteem is significantly related to resistance to group pressures, willingness to express unpopular opinions, family adjustment, creativity, and effective communication between parents and youth. The research question is: Will a 5-hour course in growth and development increase the level of self-esteem in fifth grade students? A convenience sample of 20 students (13 girls and 7 boys) who attend a public elementary school in San Jose, California, comprised …

The Effect Of Pain Management Education On Nurses' Knowledge And Attitudes Regarding Opioids And Adjuvants, Lynne Hopper Mccoy Dec 1999

The Effect Of Pain Management Education On Nurses' Knowledge And Attitudes Regarding Opioids And Adjuvants, Lynne Hopper Mccoy

Master's Projects

The purpose of this research was to determine if a pain management class improved nurses' knowledge and influenced nurses' attitudes regarding pain management. The design was quasi-experimental using pretest-posttest intervention. 83 participants completed the Nurses Knowledge and Attitude Survey Regarding Pain twice. Those who attended a class showed improvement in their pain management knowledge and attitude scores on the survey. Implications for staff development and inservice educators are that continuing education increases nurses knowledge about pain management and must include opportunities for class members to apply concepts.

Differentiation In Roles Of School Nurse And Unlicensed Assistive Personnel, Lynn Shieh Dec 1999

Differentiation In Roles Of School Nurse And Unlicensed Assistive Personnel, Lynn Shieh

Master's Projects

School nurses provide a vast number of health services for students, teachers, and staff. Despite school nurses' important contributions to the health status of students, through the years their positions have been gradually supplemented by Unlicensed Assistive Personnel (UAP)/ Health Clerks. With the number of UAPs increasing in the school setting, roles and responsibilities of school nurses and UAPs need to be clearly differentiated in order to utilize the UAP's services legally and efficiently. This research used a descriptive survey to investigate the perceptions that differentiate the role of school nurses and UAPs among school administrators, nurses, UAPs, secretaries, and …

Evaluation Of The Effectiveness Of A Health Education Program For Classroom Assistants, Patricia A. Robinson

Master's Projects

Classroom Instructional Assistants are being used more frequently to provide care for medically fragile children who are mainstreamed into the regular education setting. The purpose of this evaluative study was to develop a beginning health curriculum that could be provided as an inservice program for classroom Instructional Assistants. Content for the inservice consisted of handwashing, medication administration, asthma, and seizures. This study used a pretest and posttest design to look at the effectiveness of the educational inservice. There were 17 participants, 16 of whom completed the pretest and posttest. A pretest was administered prior to the inservice followed by a …

Strategy And Circumstance: The Response Of American Firms To Japanese Competition In Semiconductors, 1980-1995, Richard N. Langlois, W. Edward Steinmueller Dec 1999

Strategy And Circumstance: The Response Of American Firms To Japanese Competition In Semiconductors, 1980-1995, Richard N. Langlois, W. Edward Steinmueller

Economics Working Papers

The transistor was an American invention, and American firms led the world in semiconductor production and innovation for the first three decades of that industry's existence. In the 1980s, however, Japanese producers began to challenge American dominance. Shrill cries arose from the literature of public policy, warning that the American semiconductor industry would soon share the fate of the lamented American consumer electronics business. Few dissented from the implications: the only hope for salvation would be to adopt Japanese-style public policies and imitate the kinds of capabilities Japanese firms possessed. But the predicted extinction never occurred. Instead, American firms surged …
