To Yick Wo, Thanks For Nothing!: Citizenship For Filipino Veterans, Kevin Pimentel Jan 1999

To Yick Wo, Thanks For Nothing!: Citizenship For Filipino Veterans, Kevin Pimentel

Michigan Journal of Race and Law

In this Note, the Author uses science fiction novelist Robert Heinlein's model of citizenship as an analytical framework for examining the historical treatment of Filipino veterans of World War II. The Author Heinlein's conception of citizenship in Starship Troopers was one in which a person can acquire citizenship only through a term of service in the state's armed forces. Similarly, the United States provided immediate eligibility for citizenship to World War II era foreign veterans, but it effectively excluded Filipino veterans from this benefit. The Author examines how the plenary power doctrine in immigration law, has quashed legal challenges by …

Beyond The Rhetoric Of "Dirty Laundry": Examining The Value Of Internal Criticism Within Progressive Social Movements And Oppressed Communities, Darren Lenard Hutchinson Jan 1999

Beyond The Rhetoric Of "Dirty Laundry": Examining The Value Of Internal Criticism Within Progressive Social Movements And Oppressed Communities, Darren Lenard Hutchinson

Michigan Journal of Race and Law

Part I of this Article discusses examples of resistance to internal criticism within progressive social movements in order to demonstrate the extent to which such opposition operates as a barrier to constructive dissent. Part II argues that resistance to internal criticism may often result from the embrace of heterosexism, patriarchy, and racism within oppressed communities and among progressive intellectuals, and that any remaining explanations for such resistance are outweighed by the value of internal criticism to progressive theory and politics. Part III offers suggestions-to both internal critics and to the objects of their critiques-for minimizing the potentially negative effects of …

Expert Report Of Thomas J. Sugrue, Thomas J. Sugrue Jan 1999

Expert Report Of Thomas J. Sugrue, Thomas J. Sugrue

Michigan Journal of Race and Law

At the end of the twentieth century, the United States is a remarkably diverse society. It grows more diverse by the day, transformed by an enormous influx of immigrants from Latin America, the Caribbean, Africa, and Asia. In an increasingly global economy, Americans are coming into contact with others of different cultures to an extent seen only in times of world war. Yet amidst this diversity remains great division. When the young black academic W.E.B. DuBois looked out onto America in 1903, he memorably proclaimed that "the problem of the twentieth century is the problem of the color line." Over …

Introduction, Michigan Journal Of Race & Law

Michigan Journal of Race and Law

The last Supreme Court decision addressing the use of race in admissions to institutions of higher education, Bakke v. Regents of the University of California, affirmed that the role of diversity in colleges and universities is both essential and compelling. Since Bakke, opponents and proponents have wrestled with ideology and theory, but have never had the benefit of a comprehensive theoretical framework that has been tested by reliable empirical data. The University of Michigan has drawn on several of the nation's leading, and most respected, researchers and scholars, to develop such a framework and verify its legitimacy with …

Sorting Out The American Dream - The Short Stories Of Raymond Carver, Matt Williams Jan 1999

Sorting Out The American Dream - The Short Stories Of Raymond Carver, Matt Williams

Honors Theses

As Robert Stone says of his friend and his friend's work, "People will always want to read him to get an insight into the life and art of the late-twentieth century America ... he will stand high" (Halpert 131), Carver's life and work started out in the "rag and bone shop of the heart" (Nesset 103). He started out telling us about the hardships and misfortunes that go along with being not only an American, but human. Carver showed us the darker side of the American experience, but with it, showed us that with time, hope can triumph. "Reaching deep, …

Shaping Realities: A Study Of The Connection Between White Hegemony In Popular Culture And The Deprecatory Self-Image Of African Americans, Rebecca Thornton Jan 1999

Shaping Realities: A Study Of The Connection Between White Hegemony In Popular Culture And The Deprecatory Self-Image Of African Americans, Rebecca Thornton

Honors Theses

The following paper will examine how the breakdown of politically motivated racism easily translated into popular culture. Defining African Americans only as stereotypes allowed for the hegemony that had kept African Americans inferior, to endure into a new era, one dominated almost wholly by popular culture. Divided into three chapters, this paper will systematically demonstrate how historically, politically, socially, and ideologically the African American race has been castigated and prostrated by those in power.

Effectiveness Of The "Baby Think It Over" Program On Adolescents' Contraceptive And Child-Rearing Attitudes, Stephanie Ann Johnson Jan 1999

Effectiveness Of The "Baby Think It Over" Program On Adolescents' Contraceptive And Child-Rearing Attitudes, Stephanie Ann Johnson

Masters Theses

An increasing number of high schools in the United States have begun to use the "Baby Think It Over" doll as part of their curriculum in certain classes. This study examined the effectiveness of this doll on influencing 46 male and female adolescents' attitudes and behaviors regarding pregnancy, sexual activity, and contraceptives. Five specific subscales were developed to measure the teens' contraceptive attitudes and behaviors before and after using the doll regarding their feelings about becoming pregnant, understanding/comprehension of the responsibilities of child-rearing, appreciation of the impact of child-bearing on their lives/future, and attitudes toward premarital sex. Also, a qualitative …

Symbol Of Youth, Savior From Aging: Dialectical Relationship Between American Attitudes On Vitamin E And Toward Aging, Thalia Rios Jan 1999

Symbol Of Youth, Savior From Aging: Dialectical Relationship Between American Attitudes On Vitamin E And Toward Aging, Thalia Rios

Masters Theses

This study explores the dialectical relationship between American attitudes about Vitamin E and American attitudes toward aging. Through an examination of this dialectic, I will demonstrate that Vitamin E's history has contributed greatly to current American discourses on aging. For many Americans, the vitamin symbolizes youth and health because they perceive that its use can prevent or slow the aging process. During the 1990s, many Americans' early negative perceptions of Vitamin E as a quack substance have changed, partly due to recent research advances and studies that have further elucidated its powerful antioxidant function against harmful free radicals. Meanwhile, many …

Labor Law Access Rules And Stare Decisis: Developing A Planned Parenthood-Based Model Of Reform, Rafael Gely, Leonard Bierman Jan 1999

Labor Law Access Rules And Stare Decisis: Developing A Planned Parenthood-Based Model Of Reform, Rafael Gely, Leonard Bierman

Faculty Publications

This article deals with labor law access rules, particularly the rights of unions to gain access to employers' private property for organizing purposes. Professors Gely and Bierman provide a comprehensive analysis of the access issue and identify two major problems with the manner in which the Supreme Court has approached this area. First, the Supreme Court has dealt piecemeal with the various aspects of this problem without attempting to develop a coherent framework. Second, the Court has been reluctant to analyze the access issue within the context of today's workplace.Professors Gely and Bierman attribute the Supreme Court's flawed approach to …

Maternal-Fetal Conflicts, The Social Construction Of Maternal Deviance, And Some Thoughts About Love And Justice, April L. Cherry

Law Faculty Articles and Essays

FIRST PARAGRAPH: In the short amount of time that we have together today, I would like to accomplish three tasks. First, I would like to offer a brief overview of what and whom we are talking about when we talk about "maternal-fetal conflicts." Second, I would like to discuss some of the assumptions that are held about the women involved in these "conflicts," with the hope that giving voice to these assumptions might help us better understand why we may be willing to accept the coerced medical treatment of pregnant women, or legal sanctions against pregnant women who refuse treatment …
