Applying The Ada To Mitigating Measures Cases: A Choice Of Statutory Evils, Lisa A. Eichhorn Jan 1999

Applying The Ada To Mitigating Measures Cases: A Choice Of Statutory Evils, Lisa A. Eichhorn

Faculty Publications

This Article critiques the idea that the ADA should exclude from its coverage people who use mitigating measures, such as medications and medical devices, to alleviate the effects of their mental and physical impairments. After describing the statute as an expansive but flawed tool for combating disability-based discrimination, the Article analyzes a 1999 trilogy of Supreme Court cases holding that in determining whether a person has a disability for purposes of ADA coverage, courts should take account of the ameliorative effects of so-called mitigating measures on the person’s impairments. Through this holding, the Court inappropriately constricted the scope of the …

Major Litigation Activities Regarding Major Life Activities: The Failure Of The Disability Definition In The Americans With Disabilities Act Of 1990, Lisa A. Eichhorn Jan 1999

Major Litigation Activities Regarding Major Life Activities: The Failure Of The Disability Definition In The Americans With Disabilities Act Of 1990, Lisa A. Eichhorn

Faculty Publications

The passage of the Americans with Disabilities Act ("ADA") in 1990 has been praised as the major accomplishment of the disability rights movement. This statute, however, is not without its flaws. Perhaps the most problematic one is the way in which “disability” is defined. Lisa Eichhorn argues that the definition undercuts the effectiveness of the ADA. She begins with a historical look at society’s concepts of disability and discusses how these concepts were incorporated into the Rehabilitation Act of 1973 and the ADA. She then examines cases that have been dismissed because plaintiffs cannot prove disabled status, which illustrate the …

Teachers' Concerns About Technology As A Classroom Innovation, Elizabeth Ann Stroh Jan 1999

Teachers' Concerns About Technology As A Classroom Innovation, Elizabeth Ann Stroh

All-Inclusive List of Electronic Theses and Dissertations

American schools are rapidly introducing new technological tools to their staff members and students. Using both quantitative tools and qualitative strategies, the researcher undertook a case study at a small Midwestern school to determine whether teachers have concerns about technological innovations and if so, to specifically identify and measure teachers' levels of concerns about the introduction of computers to their classrooms. The quantitative data, collected from instruments developed by Concerns-Based Adoption Model theorists, revealed that teachers do have concerns about technology, and their concerns are most often centered in the self” domain. No matter how experienced the teachers were, they …

The Evolution Of The Cooperative Historically Black College And University Archival Survey Project (Chasp), Taronda Spencer Jan 1999

The Evolution Of The Cooperative Historically Black College And University Archival Survey Project (Chasp), Taronda Spencer

Provenance, Journal of the Society of Georgia Archivists

In 1987 Robert Smith, then director of Library and Media Services for the Highland Park (MI) School District, created an audiovisual presentation on the history of African American education for the training academy of the National Alliance of Black School Educators (NABSE). Moved by the presentation, many of the academy participants encouraged Smith to expand it into a documentary film. A year later Smith, intrigued by the idea and armed with a $5000 planning grant from the National Alliance, began research to determine the feasibility of such a venture. He discovered in the process that much of the material needed …

Fresh Focus: Mississippi's 'Spy Files': The State Sovereignty Commission Records Controversy, 1977-1999, Lisa K. Speer Jan 1999

Fresh Focus: Mississippi's 'Spy Files': The State Sovereignty Commission Records Controversy, 1977-1999, Lisa K. Speer

Provenance, Journal of the Society of Georgia Archivists

Too often the pressure of the present day work environment lures archivists into ignoring their professional past or advancing shortsightedly into the future. To encourage such reflection on the archival enterprise, Provenance includes this section, Fresh Focus. We invite contributors to explore neglected chapters in archival history or to share an original, especially historical, perspective on the current world of archival affairs. Provenance particularly encourages submissions for Fresh Focus from new or student archivists who are, after all, the future of the profession. Foil owing is the third in a series of occasional essays or papers meeting these criteria.

Doing Well & Doing Good: The Careers Of Minority And White Graduates Of The University Of Michigan Law School, 1970 - 1996, David L. Chambers, Richard O. Lempert, Terry K. Adams

Law Quadrangle (formerly Law Quad Notes)

In the last few yearsm affirmative action in higher education has faced increasing legal scrutiny, in part because of doubts about the kinds of graduates these programs produce. A few years ago, we and some of our colleagues at Michigan started asking whether we could learn the answers to these questions about the careers of our graduates. The Law School already possessed considerable information about our minority graduates - from the surveys we have conducted each year for over 30 years of our alumni five and 15 years after graduation. But, while the annual survey asks many questions about careers …

When Does Gender Matter? Explaining The Transition To Adulthood As A Gendered Process, Kimberly Autumn Mahaffy Jan 1999

When Does Gender Matter? Explaining The Transition To Adulthood As A Gendered Process, Kimberly Autumn Mahaffy

Doctoral Dissertations

Most gender theory and research focuses on two points in the life course: childhood and middle adulthood. Less attention is given to the period in between. The purpose of this dissertation is to determine whether and how the transition to adulthood is gendered. To what extent do school, family, and labor market contexts have a different effect on adolescent girls and boys as they become adults?

Using data from the High School and Beyond 1980 Sophomore Cohort Study (1980--1992), 1 examine how social context differentially affects the plans for the future and adult status outcomes of young women and men. …

The Native American Patient Population: A Guide For Physical Therapists, Carrie Luiken

Physical Therapy Scholarly Projects

Enhanced communication also establishes the physical therapist's credibility and trustworthiness in the eyes of the patient.

The purpose of this paper is to orient the physical therapist to some shared aspects of Native American cultures and to provide information to facilitate effective communication between …

Marital Satisfaction Factors For Korean-Americans, Soonja Choi Lee Jan 1999

Marital Satisfaction Factors For Korean-Americans, Soonja Choi Lee

Dissertations

Problem. Many marital satisfaction studies have focused on many sub-groups: Caucasians, Blacks, and many ethnic groups such as Japanese, German, Polish, Indian, Chinese-American, Swedish, Mexican-American, Nigerian, and Koreans in Korea. No study was found that has investigated marital satisfaction factors for Korean-American couples.

Method. This study evaluated marital satisfaction factors that were important to Korean Americans. The Korean-American population for this study was reached through the Korean-American church organizations in America by random selection of churches.

A total of 558 surveys was usable for analyses. Of the 558 subjects, approximately 49% were husbands and 51% were wives. Three hundred …
