Information As Verb: Re-Conceptualizing Information For Cognitive And Ecological Models, David G. Casagrande Jan 1999

Information As Verb: Re-Conceptualizing Information For Cognitive And Ecological Models, David G. Casagrande

Journal of Ecological Anthropology

Current notions of information are inadequate for ecological and cognitive models because they: 1) only account for information gain that results from reducing uncertainty; 2) assume binary logic; 3) fail to account for semantics and pragmatics; and 4) can not account for shared and externalized cognition. A different model of information is presented here, which treats information as a process of state change (i.e., the term is used as a verb), rather than as a variable. The potential for information is defined to include not only stimuli, but the context of the informational moment; and is distinguished from realized information, …

An Explanatory Model For The Maya Ethnomedical Syndrome Cha'lam Tsots, George E. Luber Jan 1999

An Explanatory Model For The Maya Ethnomedical Syndrome Cha'lam Tsots, George E. Luber

Journal of Ecological Anthropology

Although the ethnomedical system of the Highland Maya is generally well understood, little is known about the Tzeltal Maya ethnomedical syndrome Cha'lam tsots, or "second hair." In an attempt to better understand the emic conceptualization, and possible biomedical equivalence of Cha'lam tsots, ethnographic data from semi-structured interviews was collected from the Tzeltal Maya municipality of Tenejapa, in the central highlands of Chiapas, Mexico. Analysis of explanatory models elicited from 20 informants revealed a generalized agreement as to the etiology, symptomatology, course, prognosis, and treatments of this illness. Analysis of these findings will help guide further research into the …

Licensing Lies: Merger Clauses, The Parol Evidence Rule And Precontractual Misrepresentations, Kevin E. Davis Jan 1999

Licensing Lies: Merger Clauses, The Parol Evidence Rule And Precontractual Misrepresentations, Kevin E. Davis

Faculty Articles

Many judges and scholars seem to consider the rules assigning liability for fraud-and sometimes even negligence-in contract formation to be among the few mandatory rules of the contracting game. This belief persists in spite of the fact that virtually every other rule of contract law is treated as a default rule, and therefore, subject to modification by agreement of the parties. The leading case of Bates v. Southgate provides a classic demonstration of this belief. Justice Qua, writing for the court held, "the same public policy that in general sanctions the avoidance of a promise obtained by deceit strikes down …

Crimes Of States/Crimes Of Hate: Lessons From Rwanda, José E. Alvarez Jan 1999

Crimes Of States/Crimes Of Hate: Lessons From Rwanda, José E. Alvarez

Faculty Articles

This Article examines the arguments of the epistemic community of international lawyers (primarily scholars, human rights activists, and others involved in the establishment or the operation of the ad hoc tribunals) that have been used to justify the creation, jurisdiction, and ongoing operation of the Balkan and Rwanda tribunals. First, international lawyers characterize offenses in both regions as crimes of states, because such offenses, either by definition or because of their scale or scope, tend to require the connivance or at least acquiescence of governmental authority. They are seen as crimes committed by states. Second, they are seen as crimes …

Lessons From The Akayesu Judgment, José E. Alvarez Jan 1999

Lessons From The Akayesu Judgment, José E. Alvarez

Faculty Articles

The judgment issued on September 2, 1998 by the International Criminal Tribunal for Rwanda finding Jean-Paul Akayesu guilty on various charges of genocide and crimes against humanity is likely to please those who have long struggled for the progressive development and effective enforcement of international criminal law. This judgment, directed at the bourgmestre of the Taba commune in the Prefecture of Gitarama in Rwanda, is the first international conviction of an individual for genocide. Its symbolic significance is not likely to be lost on international lawyers.

Arbitral Situs: Considerations And Consequences, Rajdeep Singh Jan 1999

Arbitral Situs: Considerations And Consequences, Rajdeep Singh

LLM Theses and Essays

It is the law of the forum that is applicable to matters like arbitrability of the dispute, the validity of the arbitration agreement, the jurisdiction of the arbitrators, their appointment, removal and replacement and the challenge to their authority. Apart from these matters the law of the arbitral situs also governs the conflict of laws rules applicable to the dispute. Though the principle of party autonomy allows the parties to agree to a procedural law other than that of the arbitral situs, they still have to comply with the mandatory provisions of the law of the venue. In case they …
